" ~ /'" PLANNING AND ZONING MUiUTES The Planning and Zoning Commission of the City of Schertz convened in regular session, Tuesday, June 12, 1979, in the Municipal Complex Con- ference Room, 1400 Live Oak Road. The following were present: Commission Members Adolph Aguilar, Chairman John Linebarger, Vice-Chairman Jacqueline Lawler, Secretary Charles Sharp Kenneth Greenwald Merwin Willman City Staff Walter W. Hill, Jr., City Manager Malcolm Scott, Administrative Assistant Mark ~rahm, Consultant Ron Garrision, Building Inspector Others Present Mike Lawler III CALL TO ORDER The meeting was called to order by Chairman Aguilar at 7:00 PM. 112 READING OF MINUTES - Of May 22, 1979 meeting. Correction was made of the wording of a motion made by Mr. Sharp on Case BOA-9 of May 8, 1979, to read "Mr. Sharp further recommended that Mr. Kuechler be charged a building permit fee as called for in the Building Code." Correc tion was ma:d~ of spelling of property on P. C. 32. Motion was made by Mr. Linebarger to accept the minutes with the corrections. The motion was seconded by Mr. Willman. The motion carried unanimously. 113 CONSIDERATION OF PRELIMINARY AND FINAL APPROVAL-P.C. 29, Northcliffe Country Club Estates, Section 2, Vacating and Resubdivision Plat. City Staff advised Planning and Zoning Commission that PC 29 had been approved May 24, 1978, and that all that was needed was signing. 114 CONSIDERATION OF PRELIMINARY AND FINAL APPROVAL-P. C. 23, Northcliffe Country Club Estates, Section 2, Vacating and Resubdivision Plat. City Staff advised Planning and Zoning Commission same as above for 113. 115 CONSIDERATION OF PRELIMINARY APPROVAL-P.C. 28, Northcliffe Community, Section 4. Mr. Scott stated that for some unknown reason this case had not been acted upon. He also said that Joe Garza told him that Northcliffe officials had asked that no action be..taken on, this matter until they give further notice. Mr. Aguilar-made a request that the City Staff notify Northcliffe Officials that the Commission would like a representative of the Northcliffe Developers present at future meet~ngs wh~n the Commission is taking action on their request. ,J. , . . "- .". Mr. Sharp made a motion that PC 28 be tabled until a later date. The motion was seconded by Mr. Linebarger. The motion carried unanimously. 116 CONSIDERATION OF PRELIMINARY APPROVAL-'-P. C. 25, Northcliffe ~ast Community, Section 3. Mr. Graham made a presentation of the recommendations made by his firm. Mr. Graham also asked that the Commission make their final approval of subdivision plats, contingent upon review and approval of construction plans submitted to his firm. He also stated that in his opinion North- cliffe Developers would not incur significant costs by replatting this unit to meet the standards of the subdivision ordinance. Mr. Linebarger made a motion that a letter be sent to Northcliffe Officials stating that, "In reviewing the preliminary plat of PC 25, Northcliffe East Community, Section 3, it is noted that numerous lots do not meet the required lot size and that the Commission recommends that this unit be replatted to comply with the Subdivision Ordinance". The motion was seconded by Mr. Greenwald. The motion carried unanimously. Mr. Linebarger made a motion that a letter be sent toU. S. Homes that,the Commission requests the following: a. That a knowledgeable representative be present for questioning when they (U. S. Homes) submit a plat, b. That plats identify adjacent land, c. That the location map be in more detail so that the area in question can be readily located in relation to the entire Northcliffe Develop- ment. The motion was seconded by Mr. Sharp. The motion carried unanimously. #7 CONSIDERATION OF CURB CUT REQUEST - By Rudy S. Martinez. Mr. Hill stated that the City Staff had no objections to granting Mr. Martinez request. Mr. Sharp made a motion that the Commission recommend that Mr. Martinez request for a curb cut be granted. by Mr. Willman. The motion carried unanimously. to the City Council The motion was seconded #8 REVIEW OF PROPOSED ZONING ORDINANCE The Commissioncreviewed the proposed Zoning Ordinance-and some minor changes were made. Mr. Scott pointed out some'areas where words had to be inserted due to typing errors. - 2 - ~ ~ , . - Mr. Linebarger made amotion to recommend to the City Council to set a Public Hearing ~n July 10, 1978, concerning the proposed Zoning Ordinance. The motion was seconded by Mr. G~eenwal~. The motion carried unanimously! #9 GENERAL DISCUSSION Mr. Hill asked for the oplnlon of the Commission concerning three areas on the Proposed Zoning Map: a. Mr. Hardin has requested that the parcel of land he recently purchased next to Mobil Villa, which is now zoned M1 be rezoned P.D. as part of the new Zoning Map. The Commission generally agreed that they would not take this action their own volition, however, they would consider this request if Mr: would make a formal rezoning request. on Hardin b. Mr. Coy Simmons has requested thatcthe vacant lots in that part of Oak Forest which fronts FM 3009 be rezoned on the proposed zoning map. The Commission again agreed that they would not take this action on their own volition, however, Mr. Simmons could seek rezoning through the normal rezoning procedure. c. Mr. Hill asked if the Commission wanted to show any areas on the map zoned as R-5 (Garden Home District). The Commission stated that only that portion of Oak Forest Unit 3, designated for Garden Homes would be shown on the map. There was some general discussion concerning recent annexation decisions. #10 ADJOUNMENT There being no further business, the-meeting was adjourned-by Chairman Aguilar at 9:25 PM. - 3 -
