PLANNING lLND ZONING MINUTES The Planning and Zoning Commission of the City of Schertz convened in Regular Session, Tuesday, May 13, 1980, at 7:00 PM, in the Municipal Council Chamber, 1400 Live Oak Road. The following members were present: MEMBERS PRESENT: Adolph Aguilar, Chairman John Linebarger, Vice-Chairman Kenneth Greenwald Charles Sharp Merwin Willman Frederick Martin MEMBERS ABSENT: Ray Stanhope CITY COUNCIL MEMBERS: Jack M. McCabe Bob' Jordan Kevin Jul Jim Jones Chairman Aguilar open the Public Hearing at 7:00 PM. Mr. Riedel stated he plans to build ten one-bedroom quadplex units and one-bedroom triplex. The unit will be all brick. The apart- ments will be 'single storey. VIEWS EXPRESSED FOR REZONING: Roy Richard, attorney representing Mr. Riedel stated that the land is not suitable for R-2 zoning classification and that it is not economically feasible to build residential units on such a small tract. He pointed out that side of Live Oak Road has 200feet zoned General Business while the other side of Live Oak Road has 600 feet zoned General Business. Mr. Richard stated that Mr. Riedel is utilizing less living space than he is fully entitled to. - 2 - e Mrs. Bill Hardin stated that she was for the rezoning for as it stands now the lot constitute a fire hazard. Mr. Max Toombe, co-owner of Quik--Six" stated that the rezoning would bring in more people, business and is ideal development for the area. VIEWS EXPRESSED AGAINST: Mr. Rick 1. 2. 3. 4. 5. 6. 7. 8. Tobermann stated the following: This is the third time the rezoning has been considered for this area, Adjacent property owners do not want multi-family in their area, That the issue was not the apartments themselves but actually the location of where the apartments will be, What does the Commission consider in Section 2.2.2, There will be 43 units which means approximately 86 people and 86 vehicles, Are the members of the Commission considering the social economic factors, The petition was signed by people who will be directly affected by the rezoning, The City of Schertz doesn(t have enough supportive City Staff to provide the public services as it is. e Chairman Aguilar reiterate the purpose and the reason for having a Public Hearing. Mr. Riedel stated that the land was expensive, there is a demand for apartments and that these apartments will be single storey. #3 ADJOURNMENT OF PUBLIC HEARING Being there was no further discussion, Chairman Aguilar adjourned the Public Hearing at 7:40 PM. 113 CALL TO ORDER Chairman Aguilar called the Regular Session to order at 7:48 PM. #4 READING OF MINUTES - April 22, 1980 Mr. Willman stated that the minutes should be amended to correct 113, paragraph 4, to read "200 feet on the north side of Green Valley Road and 200 feet on the east side of FM 3009". Mr. Greenwald so moved and Mr. Linebarger seconded. The motion was carried unanimously. - April 29, 1980 Mr. Willman moved that the minutes be approved as written. Mr. Greenwald seconded the motion. The motion was carried unanimously. - 3 - e #5 HEARING OF RESIDENTS There was no one wishing to be heard at this time. #6 PRE-APPLICATION CONFERENCE - Oak Forest Unit IV, Coy Simmons The new concept to Unit IV was to have four cul-de-sac 50' x 50' off of Lazy Oak. Mr. Simmons pointed out there exist an agreement that the City was to improve the existing entrance way on Circle Oak Drive and provide curbing 'from the east side of the entrance way up to the intersection with Lazy Oak Lane. This agreement has not yet been fulfilled by the City. This statement was vertified by Planning and Zoning minutes of April 12, 1978 and the Schertz City Council minutes of April 18, 1978. Mr. Simmons also asked if the Commission would be more agreeable to widen Lazy Oak instead of using the cul-de-sac concept. At this point Mr. Gilmore interrupted and stated that the area was under severe storm warning. tI7 RECOMMENDATION TO CITY COUNCIL ON ZC-26 e It was agreeable to the members present to meet in Special Session on Tuesday, May 20, 1980. 118 ADJOURNMENT The Meeting was adjourned at 8:45 PM due to the severe weather warning. e
