05-20-1980 r e e e .~ PLANNING AND ZONING MINUTES The Planning and Zoning COmmission of the City of Schertz convened in Special Session, Tuesday, May 20, 1980, at 6:53 PM, in the Municipal ,Complex Conference Room, 1400 Live Oak Road. The follow- ing members were present: MEMBERS PRESENT: OTHERS PRESENT: Adolph Aguilar, Chairman Coy Simmons John Linebarger, Vice-Chairman Jackie Lawler Kenneth Greenwald - Mike Lawler Frederick Martin John Gardner Charles Sharp Odo Riedel Merwin Willman Reve. Church Bob Jordan MEMBERS ABSENT: Wanda Koch Raymond Stanhope Kenneth Shelton Malford Koch CITY STAFF: Claire Gilbert, Herald Reporter Ray Upton, City Inspector Glynn Stanhope, Administrative Assistant #1 CALL TO ORDER Chairman Aguilar called the Special Session to order at 6:53 PM. #2 RECOMMENDATION TO THE CITY COUNCIL ON ZC-26 Chairman Aguilar clarified the procedures set forth in the Zoning Ordinance. Mr. Sharp pointed out the pros and cons stated at the Public Hearing. He also stated that Live Oak Road will develope so will FM 3009, that the Citizens did not oppose the apartments, but oppose the location, that he could not see anything against Mr. Riedel's present plans for apartments as compare to what was presented before and that by re- zoning we would not loose control if the Zoning and Building Codes are enforced. Mr. Greenwald pointed out that the traffic from the apartment would be coming out on Pfeil Street and that the elememtary school play- ground was not fenced. Mr. Willman stated that there is 9 acres that has been divided into 3-3 acre tracts. This kind of eliminated the R-2 Zoning. I have figured out 6 homes per 3 acres. The cul-de-sac will have to be 50 feet. I doubt if contractors will build 6 homestbere at today's cost. We should look at the 9 acres for the best land use for the area for the City as a whole. r " e e e ., - 2 - Chairman Aguilar pointed out that whether we want to or not, we are going to progress and that the current zoning is not doing anyone any good the way it is. He also stated that this vote would prob- ably set a precedent for the remaining acreage. Mr. Sharp moved to recommend to the City Council to rezone the first 508 feet from Pfeil Street out of the G. Malpaz Survey 67 and out of Koch Addition, Lot 13-16, Block 6, from R-2, Single- Family Dwelling District to R-4, Apartment/Multi-Family Dwelling District. Mr. Willman seconded the motion. AYES: NAYES: Chairman Aguilar, Mr. Martin, Mr. Willman, and Mr. Sharp Mr. Linebarger and Mr. Greenwald #3 PRE-APPLICATION CONFERENCE - Oak Forest Unit IV, Coy Simmons Mr. Simmons stated that he would prefer to widen Lazy Oak Lane to building cul-de-sacs. He wants to construct houses on the lots with the least amount of damage to the trees. Mr. Simmons was asked how he plans to run a sewer line uphill to the sewer main on Lazy Oak Lane. Mr. Simmons stated that he be- leived that the sewer line was deep enough not to present any problems of connecting lines from the lots. There will be 8 lots with approximately 249 trees. Mr. Simmons made reference to the variance granted Unit IV in March 13, 1979 Planning and Zoning Minutes. Chairman Aguilar pointed out that the variance was granted when Mr. Simmons had proposed 15 lots at the time for Garden Homes and that Garden Homes were not provided for in the Zoning Ordinance at that time. The Commission then convey to Mr. Simmons that so far what he had said and plans for Unit IV is acceptable for a preliminary plat review. #4 STAFF BRIEFING Mr. Upton brief the Commission on Rev. Church's proposal for a 3 acre tract just pass the cut off of Nell Deane on Oak Street. The question came up as to who was responsible to extend Nell Deane and how far. Ms. Stanhope passed out to members of the Commission copies of Suggested Ordinance Regulating Mobile Home Parks for their review. 115 GENERAL DISCUSSION Chairman Aguilar requested that in the future that all meetings are to be scheduled at 7:00 PM. Furthermore, that Special Sessions are to contain only the issue for which they are called for. . ..; - 3 - e 116 ADJOURNMENT Being there were no further discussions the meeting was adjourned by Chairman Aguilar at 8:20 PM. e e
