04-12-1978 , e f/ PLANNING AND ZONING COMMISSION APRIL 12, 1978 The Planning and Zoning Commission convened in Regular Session WednesdaY., April 12, 1978, at 7:00 p.m. in the Municiapl Complex City Council Chambers, 1400 Live Oak Road. Gillam - Attorney at Law Mr. Jim Bronson - Realtor #1 CALL TO ORDER The meeting was called to order by the Chairman~ Mr. Aguilar, at 7:00 p.m. #2 Rezoning Request by Mr. George Barnard: The Planning and Zoning Commission and the Schertz City Council met in a Joint Public Zoning Hearing to discuss Mr. Barnard's request to rezone Lot 21 Block 45, Aviation Heights from R-2 Single Family Residence District to R-3 Two and Four Family Dwelling District. Chairman Aguilar opened the Publ ic Hearing and asked for proponents and oppon- ents on this rezoning request. Mr. Barnard briefed both bodies on his intended use of the property. With no further discussion on this item the Public Zoning Hearing was closed. #3 The Planning and Zoning Commission and the City Council met in Joint Session on the following three items: A. It is the purpose of the Joint Meeting to determine if the rezoning request meets the four criteria as setforth in Section 12.2.2 of the Zoning Ordin- ance. The rezoning request consists of the three parcels, 3.016 acres, 3.017 acres, and 3.169 acres which also includes Lots 13 through 16, which is situated in the G. Malpaz survey. The owners are requesting that these tracts be rezoned from R-2 Single Family Dwelling Districts to G.B. General Business District. Chairman Aguilar asked if there were any questions from the-public, there being none, he then asked for questions from the P & Z Commission. The P & Z Commission concurred that the rezoning request of the Koch property does not violate the four criteria. Mr. Stanhope made a motion to set April 26, 1'978 as a date for the Public Zoning Hearing. Mr. John Marquette seconded the motion. All were in favor. B. Rezoning of Mobile Villa Estates Unit I and II and El Rancho Mobile Home Park. Chairman Aguilar asked for any comments in regard to the proposed rezoning of these areas. Mr. Brunson requested that Unit II be not re- zoned at this time until a definite use,is established. , e .. c. Mr. Sharp made a motion that Mobile Villa Unit I and El Rancho Mobile Home Park be scheduled for a Public Zoning Hearing on May 10, 1978, and that Mobile Villa Unit II not be rezoned at this time. Mr. Ray Stan- hope seconded the motion. All members were in favor. Specific Use Permit Request. Mrs. Clarfe R. Eitman requests a Specific Use Permit allowing her to establish a pet shop at 5206 Cabana Drive (Lot' 50, Block 1) Mobile Villa Estates Unit I, After a discussion from her lawyer, and hearing of residents of Mobile Villa Estates, the request was denied. The Specific Use Permit does not meet the criteria outlined in the City Zoning Orrlinnnce, Article 3, Amendments 12.2.2, para.,d. Mo- tion not to grant a Public Zoning Hearing was made by Jack Sto~ackin, se- conded by Charles Sharp. The vote was unanimous. #4 APPROVAL OF MINUTES The minutes of March 22, 1978 were read and approved unanimously. #5 HEARING OF RESIDENTS Residents. remarks were noted throughout the meeting. All were given atten- tion and appropriate action was taken when necessary. #6 DISCUSSION OF OAK FOREST SUBDIVISION ENTRANCE SITUATION Chairman Aguilar called the regular meeting of the P & Z Commission to dis- cuss the Oak Forest Entrance situation. The P & Z Commission then read the recommendations of the City Staff and for the benefit of all interested per- sons present had read them aloud. Inquiries and discussion by the citizens present followed and all questions then were clarified. Chairman Aguilar then brought up the minutes of January 25, 1978, page 2, para. 1, 2 a,b .and c. Motion of January 25, 1978 be amended that para. 1, 2 a;b,and:d be deleted. Motion by Ray Stanhope, seconded by Charles Sharp, the vote was unanimous. The P & Z Commission discussed the two options on the Oak Forest Subdivision Entrance and concurred that both options are favorable. The P & Z Commission feels that Option B is the better of the two options. A motion was made by Mr. Charles Sharp, seconded by Ray Stanhope. All members were in favor. Seconded by Ray Stanhope. All were in favor. #8 GENERAL DISCUSSION A. ZC-6 Recommendation - Mr. Marquette made a motion recommending favorable approved of Mr. Barnard's rezoning request on Lot 21, Block 45, Aviation Heights. This motion was seconded by Mr. Stanhope. All members were in favor. B. The proposed Zoning Ordinance will be discussed in Workship on April 26, 1978 at 6:00 p.m. #9 ADJOURN~1ENT Being no further business, the meeting of the Zoning Board was adjourned.
