" PLANNING AND ZONING MINUTES The Planning and Zoning Commission of the City of Schertz convened in Regular Session Wednesday, July 12, 1978, at 7:00 p.m. in the Municipal Complex Conference room, 1400 Live Oak Road. The follow- ing members were present: Members Present City Staff Walter W. Hill, Jr., City Manager Joe C. Schneider Gail Hyatt Earl Sawyer Earl Johnson #1 CALL TO ORDER The Joint Public Zoning Hearing of the Planning and Zoning Commission and the City Council was called to order by Chair- man Adolph Aguilar at 7:00 p.m. #2 JOINT PUBLIC ZONING HEARING The Joint Public Zoning Hearing was to hear all parties con- cerned with the rezoning of the following parcels. A. ZC-9 A. Rezoning request by Mr. Odo Riedel to rezone Lot 2, Block 2 of Biegert Subdivision from R-2 Single Family Dwelling District to R-4 Multiple Residence Dwelling District. Chairman Aguilar asked for names of persons wishing to be heard on this item. The following persons identified themselves: Mrs. Pat Hand Mrs. Diana Bornman Mrs. Roberta Schnieder Mr . . Odo Riedel Mr. Riedel expressed his wishes to build a 16 unit apart- ment. The residents which abutt the Riedel property voiced their opinion against the proposed rezoning. ZC-ll The City ini tiated a rezoning recommendat"ion to rezone 100 feet by 150 feet area of land on which El Rancho Lounge is situated from Temporary Pre- Development to G.B. General Business District. No residents or property owners voiced their opinion on this matter. C. ZC-12 The City initiated a rezoning recommendation to rezone approximately 50 acres of land on which Mono- tech Corporation is situated from Temporary Pre- Development to M-l Industrial District. No residents or property owners wished to voice their opinions on this matter. e D. ZC-13 The City ini~tiated a rezoning recommendation to rezone four parcels located in front of Mobile Villa Estates Unit 1, from Temporary Pre-Development to NS-Neighborhood Services. These parcels being .284 acres, .670 acres, .663 acres and .352 acres of land being out of a 29.075 acre tract out of the Torribo Herrera Survey No. 68. The following residents re- quested to be heard on this item: Joe Potempa Clayton Fifield Eugene Biggs Donald Meyer May Warnock Mr. & Mrs. Floyd Landry Don Laver Bill Strickland AIl the above mentioned property owners were against the pro- posed rezoning. In addition staff presented a letter to the P & Z Commission in which Mr. Jim Brunson Executor for the Don 'Gardner: estate expressed his desire to see those four parcels rezoned to commercial zoning. After considerable discussion this item was closed. E. ZC-14 The Ci ty ini tiateda recommendation to rezone a two acre tract of land being out of the Torribo Herrera Survey, abstract No. 153 and being the John Welding Shops, from Temporary Pre-Development District to a M-l Industrial District. Mr. Paul John was the only resi- dent voicing his opinion. He expressed no opposition to the rezoning. "Mr. John was concerned on how his pro- perty taxes would he effected by the proposed rezoning. F. ZC-15 The City ini.tia_ted a Tecommenda'tiorito rezone approxi- mately one acre of land located in the Torribo Herrera Survey No. 153 and being out of the Frank P. Fey estate from Temporary Pre-Development to G.B. General Business District. The current business located in this tract of land is the Texas Tomato Company. There were no residents to be heard on this item. . E. ZC-16 The City Council initiated a recommendation to amend Section 10.5 of the City of Schertz Zoning Ordinance to only read: Page 3 P&Z Minutes <(/2-,4 - L;; 11 . (, . "All Land within Schertz, Texas, including Public Properties and Rights of Way shall be classified with a zoning district." City staff briefed all persons in attendance why the council is requesting this amendment to the Zoning Ordinance. There were no persons against the proposed zoning amendment. With this item completed the Public Zoning Hearing was brought to a close. #3 READING OF MINUTES The minutes of June 28, 1978 were read and approved as read. Charles Sharp made a motion to approve and was seconded by John Linebarger. All members were in favor. #4 RECOMMENDATIONS TO CITY COUNCIL On the rezoning of ZC-9, ZC-ll, ZC-12, ZC-13, ZC-14, ZC-15, and ZC-16. A. ZC-g Mr. Linebarger made a motion to recommend denial of Mr. Odo Riedel's request to rezone Lot 2, Block 2 of ~Biegert Subdivision from R-2 Single Family Dwelling Dis- trict to R-4 Multiple Residence Dwelling District. Mrs. Wise seconded the motion. The following members voted "aye": Mr. Stanhope, Mrs. Wise, Mr. Linebarger. The following members voted "nay": Mr. Marquette, Mr. Sharp"- e B. ZC-ll Mr. Marquette made a motion to recommend that per- manent zoning be established a 100 feet by 150 feet area of land on which El Rancho Lounge from Temporary Pre- Development District to GB-General Business District. Mr. Linebarger seconded the motion, all members were in favor. C. ZC-12 Mr. Marquette made a motion to recommend that per- manent zoning be established for Monotech Corporation from Temporary Pre-Development to M-l Industrial District. Mr. Linebarger seconded the motion. All members were in favor. D~ ZC-13 Mr. Sharp made a motion to recommend that no action be taken on the rezoning of four parcels located in front of Mobile Villa Estates Unit 1, from Temporary Pre-Develop- ment to NS-Neighborhood Services. Planning and Zoning Commission is recommending rescheduling a Joint Public Zoning Hearing for Tuesday, August 8, 1978 at 7:00 p.m. The purpose for this Joint Meeting is to consider additional information requested by the Commission. Mr. Stanhope se- conded the motion. All members were in favor. . E. ZC-14 Mr. Linebarger made a motion to recommend that no action be taken on Mr. Paul John's property at this time. Planning and Zoning Commission has requested additional information and has scheduled a Special Meeting to con- sider this information. Mr. Stanhope seconded the motion. All members were in favor. Fey Estate from Temporary Pre- Development to GB-General Business District. Mr. Marquette seconded the motion. All members were in favor. G. ZC-16 Mr. Marquette made a motion to recommend that Section 10.5 of the City of Schertz, Zoning Ordinance be amended to read only: "ALL LAND WITHIN SCHERTZ, TEXAS INCLUDING PUBLIC PROPERTIES AND RIGHTS OF WAY SHALL BE CLASSIFIED WITH A ZONING DISTRICT." Mr. Linebarger seconded the motion. All members were in favor. #5 PC-25 NORTHCLIFFE EAST COMMUNITY SECTION 3 This item was tabled upon recommendation of City Staff until the next meeting. #6 PC-26 HARDIN SUBDIVISION This item was tabled upon recommendation of City Staff until the next meeting. #7 GENERAL DISCUSSION e#8 ADJOURNMENT The meeting was adjourned at 10:05 p.m. .
