11-28-1978 I~, "~ -- e I PLANNING ANn ZONING MINUTES The Planning and Zoning Commission of the City of Schertz convened in Regular Session, Tuesday, November 28, 1978, at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Live Oak Road. Garza, Administrative Assistant Ron Garrison, Building Official Hal Baldwin, Assistant City Manager #1 CALL TO ORDER The Joint Public Zoning Hearing of the Planning and Zoning Commission and the city Council was called to order by Chairman Aguilar at 7:00 p.m. #2 JOINT PUBLIC ZONING HEARING The Joint Public Hearing was to hear all parties concerned. ZC-19 Request by Mr. Oswald Fey and Robert Fey to rezone a 16.34 acre tract of land out of the Torbio Herrera Survey, which contains 104.5 feet of frontage on IH 35 and abutts the Hardin Subdivision on the west, Mobile Villa Unit One on the east and abutts Mrs. Bertha Oberkampfs' property on the North side. The owners are wishing to rezone the property from PO Pre-Development District to M-l Industrial District Performance Standard A (Light Industrial) Zoning District. Chairman Aguilar opened the Public Hearing to all persons wishing to be heard. Mrs. Wanda Koch representing the owners briefed the commission and Council on what the proposed use ,for the 16.34 acre site would be. Mr. Martin the pr09pective buyer briefed the Commission and Council, that.he proposes to create a small Industrial park. He will relocate his con- struction business from San Antonio to the propose site. He also stated that he will cut a road throagh the site where he has 104.5 feet of frontage on IH 35, and park his con- struction equipment on the site. Two residents from Mobile Villa, Mr. Joe Potempa, and Mr. Floyd Landry were not in' favor of the rezoning they.both express concem,'with heavy equipment being driven down the streets of Mobile Villa and the possible, danger of children playing near construction equipment. Mr. Martin and Mrs. Koch stated that a privacy j . fence would be erected between the industrial site and r.1o b i 1 e V i 11 a. - Being no further discussion by anyone, Chairman Aguilar then closed the Public Joint Zoning Hearing at 7:35 and declared a 5 minute recess. #3 READING OF THE MINUTES The minutes of November 14, 1978 were read, there being no corrections a motion was made by John Marquette to accept the minutes, seconded by John Linebarger. All members were in favor. " #4 RECOMMENDATION TO CITY COUNCIL ON ZC-19 Mr. Jack Stomackin made a motion to recommend to the City (ouncil the rezoning of the 16.34 acres of land out of the Toribio Herrera Survey from PO Pre-Development District to M-l Industrial District - Performance Standard Group A (Light Industrial) District. Motion was seconded by Mr. John Marquette all members were in favor. #5 REVIEW OF PROPOSED ZONING ORDINANCE The Planning and Zoning Commission finished with the Article 19, Section 3.3. e #6 ADJOURNMENT Motion by Mr. John Marquette to adjourn, seconded by Mr. Jack Stomackin.
