08-16-1983 l ,~ e e e PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission and Schertz City Council convened in a Joint Public Hearing on Tuesday, August 16, 1983 at 7:00 PM, in the Council Chamber of the Municipal Complex, 1400 Live Oak Road. Members present were as follows: PLANNING AND ZONING COMMISSION John Linebarger, Chairman Ken Greenwald, Vice Chairman Clay McMahan, Secretary Merwin Willman Ray Stanhope Lee Boswell ;'-"1 CITY COUNCIL Earl W. Lawler MEMBERS ABSENT Cam Beauchemin CITY STAFF Earl Hartzog, Planning and Zoning Coordinator June Krause, City Secretary OTHERS PRESENT Glen Westrom Nei 1 Fi scher Darwin Peek Raymond Swan #1 CALL TO ORDER Mayor Sawyer called the meeting to order and turned the meeting over to Chairman John Linebarger. #2 PUBLIC HEARING: Zoning Change No. 44 Receive input from the Public for request of Mr. Glen Westrom to rezone approximately four (4) acres of land to General Business (GB) and approx- imately one hundred seventy-nine (179) acres to a Planned Residential Unit Development (PRUD). Said land being 199.18 acre tract out of the Toribio Herrera Survey No. 68, Abstract A-205, Guadalupe County, at 2500 through 3000 block of Farm to Market Road 3009, being approximately 1900 feet along the westerly side of Farm to Market Road 3009, approximately 2000 feet north of Live Oak Road and approximately 4400 feet in dept from Farm to Market Road 3009 in a westerly direction. Chairman Linebarger advised all persons present about the purpose of the Public Hearing and the procedures that would be followed during tve hearing. , ~. e e e PLANNING AND ZONING MINUTES, DATED: 8016-83, PAGE 2 He then asked Mr. Westrom to present his request for zoning. Mr. Westrom presented site plans showing the general layout of the area to be zoned. Several questions were asked by Council regarding time frame for each phase and questions about drainage. Mr. Westrom and Neil Fischer answered these questions satisfactorily. #3 GENERAL DISCUSSION Chairman Linebarger asked the audience if anyone had any questions. Mr. Peek advised those present that access to Maske Road should be provided for in this development. Earl Hartzog, Planning and Zoning Coordinator #1 CALL TO ORDER John linebarger, Chairman, called the meeting to order at 7:25 PM. #2 READING OF MINUTES: Regular Meeting August 1; 1983 Merwin Willman made motion to accept minutes, Lee Boswell second the motion and vote was unanimous in favor. #3 CONSIDER AND MAKE RECOMMENDATION ON ZONING CHANGE NO. 44 After a short discussion, Lee Boswell motion to approve rezoning request. Ken Greenwald second the motion and vote was unanimous in favor. #4 CONSIDER AND MAKE RECOMMENDATION: Fence Ordinance The Commission was provided a proposed change to the fence ordinance. It was noted the Zoning Ordinance, Artilce XVI, restrict the size of fence in the front yard at the 48 inches and side yards are not to be open and unobstructed. After a 1 engt.hy di scussion about side yards, it was determined the city ordinances have sufficient restrictions at the present time and exceptions should be approved by City Council. It was agreed the wording in Article XVI should be changed to make the restrictions clear. It was noted many side yards are fenced in the city and maybe this needs to be changed. . DATED: 8-16-83, PAGE 2 ~ #5 GENERAL DISCUSSION Earl Hartzog advised the Commission of item to be on the Agenda for the next meeting August 23, 1983, and provide a copy of the preliminary plat for Garden Homes in Northcliffe. Members on the Commission asked the status of their drainage letter to Council. Earl Hartzog advised the Commission that each council member had been provided a copy of the letter and it had not been on their Agenda. It was recommended another letter be sent to Council. The Commission agreed development would need to stop if action is not taken to open up the creek going through the City. Earl Hartzog advised the Commission of plan to have someone from the Water Resources attend a Council meeting in the very near future to present a Flood Plain Manage- ment briefing and recommend the Commission should attend. #6 ADJOURNMENT Chairman Linebarger adjourned the meeting at 8:30 PM. ~ r e e
