07-09-03 CITY COUNCIL MINUTES SPECIAL WORKSHOP SESSION July 9, 2003 The Schertz City Council convened in Special Workshop Session on Wednesday, July 9, 2003 at 7:00 p.m. in the Municipal Complex Conference Room, 1400 Schertz Parkway, Schertz, Texas. Those present were Mayor Hal Baldwin, presiding; Councilmembers . Carl Douglas, Steve Simonson, Reginna Agee, Tony Wilenchik and Ken Greenwald. Staff present were City Manager Mark Marquez and City Secretary Norma Althouse. #1 HEARING OF RESIDENTS Henry Gutierrez of2221 FM 3009 spoke regarding the Bexar Waste Franchise agreement with the City of Schertz. Mr. Gutierrez mentioned he had met recently with City Manager Mark Marquez and Assistant City Manager John. Bierschwale. They are two and one- half years into their three-year agreement with the City and beyond that there is a two- year option available. Mr. Gutierrez went on to say their equipment needs are sizable. They have four trucks on order and two and one-half of those would be used in Schertz. He is asking Mr. Marquez to exercise the option now and to add the additional two-year option onto it. The finance i people think a forty-eight month commitment from the City of Schertz looks good. Mr. Gutierrez then commented growth has been more than they expected. They service Schertz, Cibolo and Selma and plan to stay here - this is home. Mayor Baldwin asked Mr. Gutierrez how soon he is asking for the City to up the option. Mr. Gutierrez replied sometime in the next two weeks. Mr. Marquez questioned the need for it so soon and Mr. Gutierrez then said he would settle for maybe two months. Mr. Marquez reminded Council it is in their packets as an FYI item, but will be on a future agenda for discussion. Mr. Douglas asked Mr. Marquez to clarify the length of time and Mr. Marquez explained it could be five years if the agreement is renewed. Mayor Baldwin questioned if they would need to go out for bids and Mr. Marquez answered he doesn't think so on a renewal, but jokingly asked Mr. Gutierrez to promise not to sell out. He then told Mr. Gutierrez he thought they could do a renewal by Resolution. Mr. Gutierrez advised Council that Bexar Waste buys from MAX and they are the best out there. There is usually a nine-month delay in delivery. He also reminded Council that the City of Schertz has the best rates around. He then thanked them for their time. 302 [ Robert Brockman of 4505 Grand Forrest brought up a problem with the Police J Department door and said he had mentioned it to the Police Department about three weeks ago. Mr. Marquez told him the problem was fixed toady. #2 Discuss final reading of Ordinance rezoning 12 acres from General Business (GB) to Apartment Multi-Family Residential District (R-4) for Legacy Oaks. Mr. Marquez noted there have been no changes since the first reading was approved. Council indicated they were ready for this item to be included on next Tuesday night's agenda. #3 Discuss final reading of Ordinance regarding speed limits on FM 78. Mr. Marquez reported there have been no changes since the first reading was approved. Council indicated they were prepared for this item to be included on next Tuesday night's agenda. #4 Discuss upcoming public hearing (July 15th) on request from Franklin Moore for a Specific Use Permit allowing development in the AIeuz. Mr. Marquez explained that Mr. Moore has a power-washing company and this request has been through the Planning and Zoning process, as a result of which approval was J recommended. Amy Madison, Community Development Director, stated that Mr. Moore does power washing for commercial businesses. Mr. Marquez then mentioned he is a water user and Mrs. Madison agreed. Mayor Baldwin inquired if he is going to use all three lots and Mrs. Madison replied no - she thinks he is on lot 2. Mr. Simonson noted Lot 3 has a church sign on it. Mrs. Madison pointed out it is not his subdivision. He has to have approval of a Specific Use Permit in order to use the building. Mr. Greenwald added the developer is Joel Davis. Mr. Marquez mentioned he would have responses, from notification letters sent out, at the public hearing Mr. Douglas asked for someone to explain the AICUZ. Mr. Simonson said the initials stand for Air Installation Compatible Use Zone and is a flight zone that the Air Force set up. There's a 3,000-foot clear zone that the Air Force bought up. The City of Schertz is the first and only entity to adopt the AICUZ in total. When a new one comes out, it is automatically adopted. The AlCUZ is the reason Windy Meadow didn't build out to FM 1518. Mr. Marquez related that south on FM 1518, the AICUZ is very restrictive. It has always been the consensus of City Council to support the Randolph Air Force Base flight zones. He has a book on the AlCUZ if anyone is interested. 303 J Council indicated their readiness for this item to be included on next Tuesday night's agenda. #5 Discussion regarding appointment and nomination of Schertz Economic Development eommission members. Mr. Marquez remarked that the memo in Council's packets from Mrs. Madison is self- explanatory. The only error in it is in the list of individuals who are willing to accept reappointments, She has Carl Douglas listed and he is the liaison to the EDC from Council. Mr. Bob Valance, Sr. declined reappointment and Ron Gonzales has submitted his resignation. Those willing to serve are Chairman Jackie Jones, Vice-Chairman Arnold Barrett, Harry Richburg, Abbie Brown, Henry Gutierrez, Klaus Weisworm, Robert Statzer, Charles McDonald and Bob Vallance II. It is recommended the appointments be approved by Council. Mr. Marquez stated the original EDC was formed with seven people. A quorum is four. Jackie Jones does well in managing the members and Robert Statzer comes in with lots of qualifications. Council stated they were prepared for this item to be included on next Tuesday night's \ agenda. ) #6 Discuss proposed changes to Exhibit 1 - By-Laws for the Economic Development eommission. Mrs. Madison advised Council most of the changes have to do with semantics and spelling corrections. These changes are to the Exhibit, not the Ordinance. Mr. Marquez mentioned they could be approved by minute order. Council agreed they had enough information to include this item on next Tuesday night's agenda. #7 eONTRAeT AND AGREEMENT: Discuss and take action on contract and agreement for provision of sanitation services. Mr. Marquez reported that Nancy Vaughan, auditor for Guadalupe County, found no agreement for septic tank inspections, etc. and suggested that the City of Schertz needs a formal agreement. with Guadalupe County. There would be no cost to the City and it is exactly what they have been doing. Mrs. Madison stated it saves the inspectors a lot of hassle. Mr. Simonson moved to approve a contract and agreement for the provision of sanitation services between the City of Schertz and the County of Guadalupe. Mr. Greenwald seconded the motion, which carried with the following votes: 304 ) AYES: Council members Douglas, Simonson, Agee, Wilenchik and Greenwald. NAYS: None. #8 Items by eity Manager General Announcements Schertz Parkway Celebration Review of Old Ordinances . Mentioned they are seeking guidance on a date for the Schertz Parkway Celebration - perhaps either August 15th or August 16th. Mayor Baldwin asked if Schertz Parkway would be repaired in time. Mr. Marquez answered they can always change the date if it's not finished. Mrs. Madison said they would like to know if a Saturday works for Council. Mr. Marquez indicated they would like to have it before school starts. John Bierschwale, Asst. City Manager, advised that because of weather delays, it would not be done in August. Mayor Baldwin then asked if Saturday is a good day for Council. Everyone except Mr. Wilenchik agreed it was a good day. He works on Saturday. Mr. Marquez said they would adjust the date. They would also invite dignitaries. Mayor Baldwin told him not to forget to invite Joe Potempa. Mr. Simonson suggested they might want to invite former City Manager Jimmy Gilmore. Mr. Marques commented they are looking for the f, right site along Schertz Parkway. J . Mentioned they haven't forgotten about reviewing the older ordinances. The City Secretary has several pulled out that need to be reviewed and brought up to date. He doesn't want to burden the staffwith it right now because they are all tied up with their budgets. . Reported they now have a different architect for the EMS and Public Works projects. His name is Jerry Mendenhall and he is associated with Don McCrary. He has worked with the City before. This item will be on the agenda for action if there are no objections. #9 Items by eity eouncil General Announcements Council member Douglas Liaison EDC . Stated the City Manager had given him a copy of the revised Sign Ordinance. He would like for the City Secretary to provide him a copy of the Sign Ordinance before it was revised. His desire to have the Arroyo sign on the comer of FM 3009 and Live Oak Road removed. It may be a moot point anyway because of the installation of the traffic signal. 305 ) . Mentioned the 4th of July Jubilee was great. He didn't get to see the parade, but his wife said it was great too. Mayor Baldwin said the Schertz contingent was in the wrong place in the parade. Mr. Douglas asked how much the City spent on the Jubilee and was told anywhere from $8,000 to $10,000. He then wondered why the City doesn't take it over if they spend that much. Mrs. Agee said the City gets treated like a stepchild. Mr. Marquez admitted there's a plan afoot for the City to take it over. He also mentioned the Council would have lighter colored shirts in the future. Mrs. Madison noted that the Health Ordinance didn't deter vendors. Councilmember Simonson 4-B Board Liaison BVY A . Commented his family was impressed by the 4th of July Jubilee. They enjoyed the friendliness of the people and enjoyed the fireworks. . Stressed he doesn't want to lose sight of the annexation issues. Councilmember Agee 4-B Board Liaison Schertz Housing Authority J Liaison Schertz Library Board . Mrs. Agee had nothing to report. Councilmember Wilenchik 4-B Board Liaison Schertz Humane Society Liaison HOA Coalition . Noted he and Mr. Marquez attended the Oak Trails Homeowners Association meeting last week. He asked Mr. Marquez if the lady got back with him about the contractor dumping issue and the mowing issue, but Mr. Marquez said she was supposed to call him and he hadn't heard anything. Mr. Wilenchik then said the Northcliffe Homeowners Association meeting is tomorrow night. All their issues seem to have been resolved. It was decided that those who wish to attend would meet at 6:45 p.m. at City Hall. . Remarked he had attended a TSAC meeting and they said they had sent a letter to Mr. Marquez asking for a liaison from Council to the TSAC. They are also working on an ordinance formalizing the Transportation Safety Advisory Committee (TSAC). A problem at the railroad track at FM 1518 and FM 78 was mentioned and they were told someone would be contacted about it. The crosswalks on Elbel Road were mentioned. Are they supposed to have sidewalks? Mr. Marquez replied they would have to meet the ADA requirements. 306 - ...~ } Mayor Baldwin asked if there's supposed to be sidewalks in front of the whole property and Mr. Bierschwale replied yes There were questions about the effectiveness of the recycling program. Henry Gutierrez agreed to do additional publicity about it. They asked why the $1.25 recycling fee couldn't be discontinued and reverted to the drainage fee. Mayor Baldwin said it has been talked about, but he still thinks it needs to be on an election ballot. It will cost more to toss all that stuff into a landfill. Mr. Marquez reminded Council the recycling funds pay for the Spring and Fall Clean-Ups. . Advised the VFW asked him to judge their Chili Cook-Off this Sunday. . Asked about the possibility of the Humane Society using the old Animal Control building. He was advised the building is no longer there. It was destroyed in a flood. Councilmember Greenwald 4-B Board Ex-officio P & Z Commission Ex-officio S/SLGC . Commented he thought the parade was fantastic. Next year they need to have some insulation on the floorboard of the old fire truck and they need to sparkle it } up a little. J . Mentioned he had distributed copies of Planning and Zoning minutes for June 10, 2003 to everyone. Also included was the Planning and Zoning Activity Report. It is short, concise and helpful . Reported Papa John's Pizza is coming to the City and will be located south of Boswell Niemietz onFM 3009. . Related the school district wants to put in a berm in place of a concrete wall at the new Norma Paschal Elementary School. The Paschal family wants to pay for the sign on the comer. It will match up with the masonry fence. . Reminded Council they need to discuss the Hometown Hero nominations and they need to agree on one name. Mayor Baldwin said he would nominate Zenobia Coverson because she helps a lot of children. . Stated Joyce Briscoe called the Attorney General's Office and got the Open Meetings pamphlets. Tony Wilson, Public Information Officer, said you could also get the Public Information Act from the same place. # 10 Items by Mayor General Announcements 307 . Mentioned attending the Grand Opening for Blake's Cafe today and it was real mce. . Announced tomorrow is the Northeast Partnership Meeting and everyone on Council is welcome to go. Mr. Simonsob. said he would like to go. . Reminded everyone that at the Council meeting next Tuesday they will do Mr. Marquez's evaluation in an Executive Session. Mr. Marquez said he would put the evaluation forms in the packet if needed. Mr. Marquez reminded everyone the Big Splash #2 at Gonzales Texas for the Schertz/Seguin Local Goivemment Corporation IS next Thursday, July 17th. Transportation leaves City Hall at 4:00 p.m. City Code Enforcement Officer Leonard Truitt stepped into the room for a minute and said the school district wants to build the sidewalk on Elbel Road in conjunction with building the bridge. He has no problem with that. Mrs. Agee asked if they're still on tract for closing Elbel Road. Mr. Bierschwale replied they are behind because of weather delays. She then asked Mr. Bierschwale to notify the school district when they close Elbel Road. Mr. Greenwald also asked to be notified. ) Mrs. Agee asked Chief Cantrell if he has a traffic control plan for the football games and J he replied he does. Mr. Wilenchik asked if the traffic signal at FM 3009 and Live Oak Road is still on schedule and Mr. Marquez replied it is. Mr. Marquez also mentioned he is waiting on appraisals before the PID Committee can move forward.
