(Staff) Mayor Pro-Tem Wilenchik called the workshop to order at 5:00 p.m. Mayor Pro-Tem Wilenchik introduced Assistant City Manager David Harris who briefed the Council on the various city fees, various departments and addressed Council questions. Mr. Harris also addressed sewer, water, garbage and business office rates and fees. PRESENTATION • Proclamation for National Payroll Week (Cecilia Settle) Mayor Baldwin read and presented the proclamation for National Payroll Week. City Council Regular Meeting August 26, 2008 244 • Explorers Post (D. Covington) Mayor Baldwin recognized Fire Chief Covington who introduced item. Chief Covington introduced Fire Fighter Chris King who gave a brief power point presentation on the Explorers Post objectives answering questions from Council. Mayor and Council congratulated Chief Covington and Chris King for their involvement in making this happen. Chief Covington also introduced Exploring Executive Mike Anastasio with the Alamo Area Council Boy Scouts of America. HEARING OF RESIDENTS Mayor Baldwin recognized the following: • Frances Rushing, Schertz Chamber of Commerce President who provided the following announcements: -This Thursday, August 28th – 10 a.m. -Ribbon Cutting Walgreen’s at I-35 & 1103 -This Friday, August 29th -monthly luncheon – 11:30 a.m. Civic Center – Banking Crisis presented by Schertz Bank & Trust – FDIC Information -October 20, 2008 – Frost Bank Ribbon Cutting -9 a.m. – Breakfast everyday for a week starting at 7 a.m. -Attended Commissioner’s Court today: o Public Hearing held: Consideration and discussion regarding the proposed tax rate increase of $0.3895 over the effective tax rate of $0.3674. Commissioner’s Court will meet on September 16, 2008, during Open Session to adopt the fiscal year 2008-2009 Tax Rate. o The filing of the proposed budget with the County Clerk for fiscal year 2008-09 Budget was passed and has been made available for public inspection. o A call for a County General Election to be held on Nov. 4, 2008 was passed along with the Early Voting Schedule, Voting locations, etc. It was noted by Commissioner Wolverton that there has been some communication/voting problems in the past. The Court was assured those problems are being addressed to enhance flow of traffic (voters) and to clear up confusion as to whether the voter is in the right place to vote, hoping to eliminate some of the frustration. It was also discussed that an additional voting location may be added for next year; location being considered considered is the Guadalupe County extension on Elbel road. o No Action taken on a “Notice to Proceed” with Tyler Technologies regarding implementation plan for Odyssey, web based courts and justice solution computer software and funding of monies associated therewith. Set City Council Regular Meeting August 26, 2008 245 to go back on the agenda of Sept 9th. The total cost of this project is estimated to be in the $669,000 +/-. Although this program has full support of the Commissioner’s Court, the extra time was necessary to review financial options for funding of the program. • Mr. Robert Brockman, 1000 Elbel Road spoke on new traffic signals having LED’s, and Schertz Parkway Street lights. Mayor Baldwin recognized Mr. Terry Hinze from the School Board who was in the audience and mentioned that he was also excited about the new Explorers Post. Council General Announcements: Mayor Pro-Tem Wilenchik • That he had provided the Council with the latest TML final report on the Texas Municipal League taxation and revenue committee, (he sits on this committee); the report has a list of items that TML has voted to advocate for or against in the 2009-10 Legislative Session. Mayor Pro-Tem Wilenchik stated that there is a list of contact points for Council to consider and that he would would relay Councils points to the board. Council Member Fowler • None. Council Member Scagliola • None. Council Member Trayhan • None. Council Member Carpenter • Requested an item be placed on the next agenda to discuss a policy for providing all agenda items in advance as part of their packet. Mayor Baldwin concurred and instructed staff to place this on the next agenda. • General Announcements on meetings/events attended and upcoming events (Mayor) Mayor Baldwin reported that the committee he is on to select a branding company for the Austin-San Antonio Rail District logo interviewed four different candidates and chose Tate Austin Agency in Austin. The company of Tate Austin will also subcontract with a small agency in San Antonio to come up with a logo for the Austin-San Antonio Rail District. Resolution No. 08-R-43 – Consideration and/or action approving a resolution designating a particular area, particular dates and times for which alcoholic beverages may not be brought into or removed from Pickrell Park, authorizing extension of park hours, extension of noise hours and authorizing other motorized vehicles in park areas. Mayor Baldwin recognized Council Member Scagliola who moved, seconded by Mayor Pro-Tem Wilenchik that the city settle a condemnation lawsuit with Robert and June Dale to confirm a permanent sewer line easement and to acquire a temporary construction easement to complete the final link in Phase One of the Town Creek Sewer line for a total payment to Mr. and Mrs. Dale of $36,500, and that we direct the City City Manager to sign all necessary documents to implement this settlement. Vote was unanimous. City Council passed this by unanimous vote. FISCAL IMPACT None RECOMMENDATION Staff recommends City Council approve final reading of Ordinance No. 08-M-42. ATTACHMENT Ordinance No. 08-M-42 (Corrected) ORDINANCE NO. 08-M-42 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS CREATING THE POSITION OF CITY MARSHAL; ESTABLISHING THE DUTIES OF THE OFFICE OF CITY MARSHAL; AUTHORIZING THE CITY MANAGER TO MAKE APPLICATION FOR ALL APPROPRIATE LICENSES FOR THE CITY MARSHAL AND ANY AND ALL DEPUTY MARSHALS AND TO TAKE OTHER ACTIONS NECESSARY TO CREATE AND STAFF THE OFFICE OF CITY MARSHAL; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION I There is hereby created the position of City Marshal of the City of Schertz, to be filled by a qualified person appointed by and reporting to the City Manager or his/her designee. The City Marshal shall meet all qualifications necessary to be certified as a peace officer by the State of Texas. The City Manager may appoint qualified persons to serve as Deputy City Marshals and non-commissioned Deputies upon the recommendation of the City Marshal. SECTION II (a) The City Marshal shall act under the direction of the City Manager or his/her designee, and the City Marshal’s office shall perform the following duties: (i) execute warrants of arrest, subpoenas, and other legal process issuing out of the City’s Municipal Court; (ii) execute other warrants of arrest, subpoenas, and legal process as authorized or directed by the City’s Municipal Court Judge(s); (iii) serve as court bailiffs in the City’s Municipal Court; (iv) carry out the City’s obligations under, and comply with directives set forth in, the National Incident Management System/Department of Homeland Security; (v) enforce all codes of the City (excluding the Fire Code) in force from time to time; (vi) enforce Texas environmental laws applicable to the City and residents and other persons and entities within the City, which includes but is not limited to the Texas Health & Safety Code, the Texas Litter Abatement Act, the Texas Water Code, and other similar laws and regulations created or adopted by the State of Texas, all as in effect from time to time; (vii) oversee staff of the City’s Marshal’s office, including Reserves and noncommissioned Deputies; Ordinance 08-M-42.doc Ordinance 08-M-42.doc (viii) enforce other City Ordinances designated for enforcement by the City Marshal; and (ix) perform such other duties necessary and approved in writing by the City Manager to aid in the proper functioning of this office. (b) The duties of the City Marshal’s office described in parts (a)(i)-(iii) above shall no longer be included in the duties of the City’s Police Department, and the duties of the City Marshal’s office described in parts (a)(v) and (vi) above shall no longer be included in the duties of the City’s Inspection Department. SECTION III The City Marshal and his/her commissioned Deputies shall serve as peace officers of the City and have full police authority in the exercise of their assigned duties, but the City Marshal and his/her Deputies shall not be members of the City’s Police Department. The City Marshal and his/her Deputies are paid Law Enforcement Officers for the purpose of qualifying for survivor’s assistance benefits under the provisions of Chapter 615 of the Texas Government Code, as amended. The City Marshal and his/her Deputies shall carry the commission of the Texas Commission on Law Enforcement Officer Standards and Education, or any successor agency of the State of Texas. The City Manager or his/her designee is hereby authorized and directed to make application to the Texas Commission on Law Enforcement Standards and Education for the City Marshal and all of his/her Deputy Marshals to be duly licensed for their positions. SECTION IV The City Marshal and his/her Deputies shall be required to take the appropriate oath of office before entering upon the discharge of their duties. The oath shall be subscribed by the person taking it and shall be filed and preserved in the office of the City Secretary. SECTION V This Ordinance shall take effect immediately from and after its passage by the City Council of the City of Schertz, and any publications required by law. Staff has reviewed many of these fees and in some cases has recommended modifications. The attached Ordinance 08-M-43 consolidates many City fees into a single Fee Schedule (Exhibit A to the Ordinance). Additional City fees may be added to the Fee Schedule in the future. The Ordinance also provides that future modifications of the fees on the Fee Schedule may be added by resolution rather than by ordinance. FISCAL IMPACT None RECOMMENDATION Staff recommends Council approve first reading of Ordinance 08-M-43 establishing a City of Schertz Consolidated Fee Schedule ATTACHMENT Ordinance No. 08-M-43 ORDINANCE NO. 08-M-43 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING THE CITY OF SCHERTZ CODE OF ORDINANCES AND CERTAIN OTHER ORDINANCES BY AMENDING AND ESTABISHING FEES FOR CERTAIN LICENSES, PERMITS, AND OTHER SERVICES PROVIDED BY THE CITY OF SCHERTZ; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AS TO SUCH SUBJECT; PROVIDING FOR FUTURE AMENDMENT OF THIS ORDINANCE BY RESOLUTION; PROVIDING A SEVERABILTY CLAUSE; PROVIDING FOR A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Schertz (the “City”) has established by ordinances and resolutions fees for licenses, permits, and services provided by the City; and WHEREAS, the City Council has authorized a review and a consolidation of certain fees for licenses, permits, and services provided by the City; and WHEREAS, the Schedule of Fees attached as Exhibit A reflects revisions to certain fees, a restatement of certain fees not revised, and a consolidation of all such fees; and WHEREAS, due to the need for periodic modification of said fees and for the purposes of efficiency, the City Council desires to adopt future fee changes by resolution rather than by ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: SECTION 1. All persons, firms, or corporations applying for licenses or permits or receiving other City services described on Exhibit A that require the payment of a fee incident to such application or service shall pay the fees as prescribed in the Fee Schedule attached hereto as Exhibit A and made a part of hereof. It shall be a violation of this Ordinance to conduct any activity or commence any use or receive any service for which payment of a fee described herein is required until such fee has been paid (if required to be paid in advance) or to fail to pay such fee when properly billed. SECTION 2. This Ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of Schertz, Texas as to the fees set forth on Exhibit A in Ordn 08-M-43.doc effect on the effective date of this Ordinance, except where the provisions of this Ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. The City Council may, from time to time, by ordinance add to the fees set forth on Exhibit A, and the fees now or hereafter set forth on Exhibit A may be modified from time to time by resolution of the City Council. SECTION 4. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 5. Subject to the last sentence of this Section, any person, firm, or corporation who violates, disobeys, omits, neglects, or refuses to comply with or who resists the enforcement of any of provisions of this Ordinance shall be fined not more than Five Hundred Dollars ($500.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. If any other ordinance, including the Code of Ordinances, establishes a different penalty for the failure to pay any fee on Exhibit A, the provisions of such other ordinance or the Code of Ordinances shall control with respect to such penalty. SECTION 6. All rights and remedies of the City are expressly saved as to any and all violations of the provisions of the Code of Ordinances in effect on the effective date of this Ordinance and modified by this Ordinance or any other ordinances in in effect on the effective date of this Ordinance and modified by this Ordinance and requiring the payment of fees for licenses, permits, and other services provided by the City which have accrued on the effective date of this Ordinance; and any and all accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. Council Meeting: September 2, 2008 Department: Finance Subject: Pubic Hearing on the Proposed FY 2008-09 Tax Rate BACKGROUND In accordance with Chapter 26 of the Texas Tax Code the City Council must hold two (2) public hearings on a proposed tax rate. At the August 12, 2008 regular session the City Council, by record vote, established a proposed maximum tax rate of $0.4090 per $100 of value. This proposed rate is not subject to rollback, as it is the same rate adopted for FY 2007-08. This public hearing will be the first public hearing. The second required hearing will be conducted at the September 9, 2008 regular session. FISCAL IMPACT None RECOMMENDATION Staff recommends that the Mayor open the public hearing, take comments, close the public hearing and announce that the next public hearing on the proposed tax rate will be conducted on September 9, 2008 at 6:30 p.m. in the City Hall Council Chambers. Agenda No. 5 CITY COUNCIL MEMORANDUM City Council Meeting: September 2, 2008 Department: Administration/Council Subject: Discussion and possible action regarding setting policy regarding agenda items BACKGROUND At the City Council meeting of August 26, 2008 City Councilman Michael Carpenter requested an item be placed on the next agenda to address the issue of providing all documentation to the City Secretary for agenda items in their agenda packets, Mayor Baldwin concurred. City Manager Don Taylor addressed this issue at their staff meeting of August 27, 2008 and issued a policy memo to all directors.
