PLANNING AND ZONING MINUTES
The Schertz. Planning and Zoning Commission. conducted a publ ic
hearing on Tuesday, May 22, 1990 at 7 :00 P.M. in the Municipal
Complex Council Chambers, 1400 Schertz parkway. Those present
were as follows:

#1 CALL TO ORDER
Chairman Brisgill called the public hearing to order at 7:00 P.M.
~2 PUBLIC HEARING: Zoning Change ~98
To receive citizen input on the request from Von Scheele and
Company for the rezoning of a 2.286 acre tract of land from
General Business (GB) to Garden Home Dwelling District (R-5A).
The land is located at the southwest corner of Schertz Parkway
and Pecan Drive.

Chairman Brisgill called the meeting to order at 7:04 P.~I.
#5 APPROVAL OF MINUTES: Regular Session May 8, 1990
Jim Shriver made a motion to approve the minutes for the regular
session May 8, 1990. George vick seconded the motion and the
vote was unanimous in favor. Motlon carrled.
#6 CITIZENS' INPUT OTHER THAN AGENDA ITEMS
There was none.

CONSIDER AND MAKE RECOMMENDATION:

Merwin Willman, commenting that Steve Simonson's notes to the
Commissioners had said one letter from an investment company had
expressed opposition to the zoning change, asked if they gave a
reason for their opposition. Mr. Simonson replied they had not.

Chairman Brisgill asked the results of the letters sent out, and
Steve Simonson informed the Commission that 61 letters had been
sent and 7 were returned - 6 in favor of the zoning change and 1
opposed.
Merwin Willman made a motion to recommend to City Council
approval of Zoning Change ~98 (the request from Von Scheele and
Company for the rezoning of a 2.286 acre tract of land from
General Business (GB) to Garden Home D"elling District (R-5A)).
Keith Van Dine seconded the motion and the vote "as unanimous in
favor. Motion carried.

CONSIDER AND MAKE
RECOMMENDATION:
Conceptual ETJ and
Annexation Areas
Chairman Brisgi'll reminded the Commission of the letter in their
packages from the sub-committee regarding conceptual ETJ' sand
annexations and asked for comments.
George Vick remarked he thinks the letter lS very good.
Merwin Willman, once again commenting on Steve Simonson's notes
to the Commission, asked why the decision was made not to attach
a map with the letter of recommendation.
Steve Simonson told the Commission since the City is currently in
litigation with one of the cities, they felt a map (even if it is
marked proposed, preliminary, etc.) might be taken out of context
and come back to haunt them later. Mr. Simonson further stated
the sub-committee feels this letter is just as efficient.

Bob Andrews stressed the letter can be sent, by itself, to city
Council to let them know the Commission's wishes . regarding ETJ
agreements and future annexations. If they come back to the
Commission and ask for a map, then we can give them one.

Steve Simonson said it was felt that not attaching a map and
also omitting any mention of Garden Ridge is more prudent at this
time.
Merwin Willman then stated there are other areas the letter could
have been more specific about.
Bob Andrews noted that over the years it has sometimes been felt
by the Commission that City Council has not taken them seriously.
Mr. Andrews wondered if there's any policy against some of the
Commissioners representing their proposals at the City Council
meetings.
Mr. Andrews was informed there is no policy against such
representation.
Steve Simonson emphasized that the letter can be rewritten to be
very specific.
George vick emphasized that the basic goal of the letter lS to
obtain written ETJ agreements with our neighboring cities.
Bob Andrews indicated the Commission has the option of going back
to Council with a stronger letter.
George Vick made a motion to approve sending forward the letter
of recommendation from the Commission to City Council regarding
Conceptual ETJ and Annexation Areas. Bob Andrews seconded the
motion and the vote was unanimous in favor. Motion carried.
NOTE: Merwin Willman said he would go with the majority but
still feels the letter should be more detailed.
#9 CONSIDER AND MAKE RECOMMENDATION: Review of Applications
for Vacancy on the Commission
Chairman Brisgill remarked on the five applications, coples of
which the Commission received in their packages, and asked what
the Staff's. finding were on people who had applied previously.
Steve Simonson told ~lr. Brisgill the five applications he has
copies of are the ones who have been contacted and have said they
h'ou-l d serve.

Chai~man Brisgill asked that the five applicants be invited to
the next meeting for the purpose of being interviewed.
Merwin Willman noted that the applicants should be advised that
whoever is selected will be appointed until October of this year,
and then considered for reappointment at that time. The selectee
will be filling Joe Potempa's place, and his term lS due to
expire in October, 1990.

Bob Andrews made a motion recommending the applicants be invited
to the June 12, 1990 meeting for the purpose of being interviewed
and possibly selected to fill the vacancy on the Commission.

#10 CONSIDER AND TAKE APPROPRIATE ACTION: Election of Vice-
Chairman for Planning and Zoning Commission

#11 CONSIDER AND TAKE APPROPRIATE ACTION:
Historian for Planning and Zoning Commission
Selection of
Jim Shriver indicated his desire to be the Historian if no one
else wants the job. The Commission agreed unanimously to appoint
Mr. Shriver as their Historian.

i12 GENERAL DISCUSSION
Keith Van Dine:
(a) Again brought up the fact that the roads in Schirmerville are
fall ing apart and something needs to be done about it. (steve
Simonson said Mr. Sweatt is aware of the problem and even though
the budget is being revised, there's money that will stay with
the budget for road repair. Mr. Simonson al so informed the
Commission the City is revising its request for Federal Urban Aid
for the road system and listing Pfeil Road as one of the
priorities.)
Jim Shriver:
(a) What is the status of the response from Wuest's on the
Commission's request to have arrows painted on the adjoining
entrances off Schertz Parkway? (Steve Simonson repl ied that no
one from Wuest's had ever responded, but Winn's and the Savings
Co. said they were willing to help if the City could get everyone
to cooperate.)

(a) On FM 1518, where the used car lot was,

tons of dirt. Mr. Vick said every time he drives by, he sees
someone filling in the land with more dirt.
(c) If Universal City does not border on IH-35, how can the
police write tickets under the bridge at 1604? (It was suggested
perhaps the police chased the vehicle out of Olympia.)
Merwin Willman:
(a) On April 10, the Commission had a request from Steve Young of
515 Aero for an exception to the Junked Vehicle Ordinance
regarding his antique vehicle. Mr. Willman said since that time
he has been keeping track of the vehic le and he hasn't seen it
for a while. Mr. Willman was wondering if Steve Young got rid of
it, and if so shouldn't this request be taken off the tabled
list.
Chairman Brisgill remarked the other tabled items regarding
antique vehicles need to be cleared up also.

Suggesting steve Young might have moved, Chairman Brisgill

(b) Asked if the recommended changes to the subdivision Ordinance
regarding non-access easements have gone to City Council? Upon
being informed they have gone forward, Mr. Wi llman stated he
would like to have a copy of the proposal.

(a) Reminded everyone to turn ln their tickets for the Firemen's
Picnic by May 29th.

Steve Simonson:
(a) Noted everyone had received their monthly invitation to the
San Antonio APA Chapter's luncheon, and asked if anyone was
interested in attending. (No one expressed a desire to attend.)
(b) Informed the Commission they should be receiving information
on the annual conference and he would appreciate their responses
and/or commitments as early as possible.
Chairman Brisgill:

(a) Reminded everyone the next meeting is a public hearing.
(b) Told the Commission that Councilperson Ken Greenwald has been
reappointed as the liaison between City Council and Planning &
Zoning.

(d) Reported that several citizens had asked him about the sign
on the wat~r tower in Garden Ridge and their main concern was the
money.
Councilperson Ken Greenwald said it ,,,as only $300 to paint it
out. Chairman !3risgill said $300 is still an expense to which
Mr. Greenwald replied, even with the painting out, they are still
under what was budgeted.

i13 ADJOURNMENT
Chairman Brisgill adjourned the meeting at 7:45 P.M.
The next scheduled meeting is June 12, 1990 and it will be a
public hearing.
