08-20-2001 ""'......... ~ \I' BOARD OF ADJUSTMENT MEETING August 20, 2001 The Schertz Board of Adjustment convened in regular session on Monday, August 20, 2001, at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: BOARD OF ADJUSTMENT CITY STAFF Earl Hartzog, Chairman Ted Duigon James Harris Norman Slocum Kathy Hill William Sommers, P&Z Commissioner Ron Youngblood, City Planner Mary Ybarra, Planning & Recording Secretary MEMBERS ABSENT OTHERS PRESENT David & Cindy Broschat, 4604 Flagstone Dr. Steven Burg, 2609 Kingsland Circle Larry Fortner, 2405 Witten Will Brown, 2601 Kingsland Cr. #1 CALL TO ORDER Chairman Hartzog called the meeting to order at 6:30 p.m. #2 APPROVAL OF MINUTES: Regular session of May 21, 2001. Chairman Hartzog asked for any corrections and/or additions ofthe above minutes. Ted Duigon pointed out several corrections; on page one under item #2, fourth sentence; correct the word "acerbate" to read "exacerbate"; page two under item #3, fourth sentence of William Sommers comments correct the word "carport" to read "carports"; in the next paragraph comments made by Ted Duigon correct the statement to read ........concrete slab and cover are 5' ......; and delete the rest ofthe statement beginning with..... ...Roof just being, etc...... "; on page three under item #6 correct the word, "chang" to read ~ '" "-,40 "change"; and on page four last paragraph last sentence to have it read :".. ...consenses that the agenda item "General Discussion:" be changed to read.........." . Without further corrections or additions, James Harris moved to approve the minutes of May 21, 2001 as amended. Kathy Hill seconded the motion. With a vote being called, the vote was as follows: Ayes: Kathy Hill, Ted Duigon, James Harris and Earl Hartzog. Abstained: Norman Slocum. Motion approved. At this time, Chairman Hartzog explained that the Board would be considering three public hearing issues, and advised that the purpose of the public hearing procedure is to receive comments from interested citizens. The Board of Adjustment will take all comments into consideration in making its decision. After the public hearing is closed there will be no other comments taken. #3 PUBLIC HEARING: To receive citizen input on a request from Steve Burg, 2609 Kingsland Circle, Woodland Oaks Subdivision Unit 2B, block 12, lot 58, for a for a special exception to the zoning ordinance to encroach into the 20' rear building setback from 20' to 14' for construction of a patio cover. At this time he asked for staff input. Ron Youngblood stated that in accordance with the city ordinance 29 letters were sent out to the property owners within a 200' radius of said property. Of the letters sent (8) letters were received in favor and none were received opposed. Mr. Youngblood added that the inspection department has been contacted and found that there are no concerns due to other carports in the area with the same configuration. Mr. Youngblood stated that the request is pretty straightforward and advised the Board there are no utilities that would be effected. The request has been coordinated with the building official and other staff members and no adverse action was found. Chairman Hartzog stated that a letter from the Planning and Zoning Commission recommending approval is part of the Board's packet. #4 PUBLIC HEARING: To receive citizen input on a request from Larry Fortner, 2405 Witten, Horseshoe Unit 2A, block 10, lot 7, for a for a special exception to 2 ... ....... "'" .. the zoning ordinance to encroach into the 20' rear building setback from 20' to 12' for construction of a covered patio. At this time Chairman Hartzog asked for staff input. Without further comments from any other citizens, Chairman Hartzog closed the public hearing. Chairman Hartzog stated that the purpose of the public hearing is to receive comments from interested citizens. The Board of Adjustment will take all comments into consideration in making its decision. After the public hearing is closed there will be no other comments taken. Chairman Hartzog asked for staff input. Ron Youngblood stated that in accordance with the city ordinance 23 letters were sent out to the property owners within a 200' radius of said property. Ofthe letters sent (4) letters were received in favor and (1) was received opposed. Mr. Youngblood added that the inspection department has been contacted and found that there are no concerns due to other carports in the area with the same configuration. #5 PUBLIC HEARING: To receive citizen input on a request from David & Cindy Broschat, 4604 Flagstone Drive, Forest Ridge Subdivision Unit 1, block 3, lot 2, for a for a special exception to the zoning ordinance to encroach into the 15' utility easement for construction of a storage building. #6 CONSIDER AND TAKE APPROPRIATE ACTION: On the above Special Exception request from Steve Burg, 2609 Kingsland Circle. #7 CONSIDER AND TAKE APPROPRIATE ACTION: On the above Special Exception request from Larry Fortner, 2405 Witten. #8 CONSIDER AND TAKE APPROPRIATE ACTION: On the above Special Exception request from David & Cindy Broschat, 4604 Flagstone Drive. 3 ." .. ...~.. Without further discussion, Ted Duigon moved to approve the request from Gloria Clark, 307 Aero Ave., Aviation Heights for a special exception to the zoning ordinance to encroach into the side yard setback from 7.5' to 5" for construction of a carport to cover existing double driveway. James Harden seconded the motion. With a vote being called the vote was unanimous.
