Council Member Fowler gave the Invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. PROCLAMATION • San Antonio 164 Chapter of Service Corps of Retired Executives “Score” (Dave Palmer to accept) Mayor Baldwin presented the proclamation to Tony Irwood as Dave Palmer was unable to attend. EMPLOYEE INTRODUCTIONS • 311 – new employee Nancy Johnson-Hilla Mayor Baldwin recognized Rita Duprat-Waldo, Assistant to City Manager and Supervisor of 311, who introduced new employee Nancy Johnson-Hilla. REPORT • Update from Election Administrator on County election issues. Mayor Baldwin recognized Sue Basham, Guadalupe County Elections Administrator who provided information regarding the recent joint election. City Council Regular Meeting November 18, 2008 293 HEARING OF RESIDENTS Mayor Baldwin recognized the following: • Francis Rushing, Schertz Chamber of Commerce President, who announced the following: -Chamber monthly luncheon will be held Friday, November 21, 2008 at the Civic Center Darren Shower with GVEC will be the speaker. -Announced that the Schertz Chamber of Commerce presented the Library with a $3000 donation. -Christmas Lighting Contest for the Festival of Angels, Schertz Chamber will be judging on December 10, 2008 and presentation of awards will take place at the December 16, 2008 Council meeting. -November 25, 2008 at 2:30 p.m. is planned for the ribbon cutting at El Jalisco Restaurant. • Basil McDerris, 600 River Road spoke regarding citation received on parking of RV and addressed his concerns. • Billy George, 407 River Road who also spoke on issues of not being able to park RV’s. Mayor Baldwin stated that this item will be placed on a December meeting agenda for further discussion. • Robert Brockman, 1001 Elbel Road who spoke on the following: Holiday Lockup for Blue Santa, Festival of Angels parade route, snow, and commented on Charter amendments. • Tony Wilenchik, 1040 Ivory Creek who mentioned that he was a board member on the Chamber Board of Directors and provided information on money paid to the chamber from the city. REGULAR AGENDA 1. Minutes -Consideration and/or action regarding the approval of the minutes of the Regular Meeting of November 4, 2008 and Special Meeting of November 12, 2008. Mayor Baldwin recognized Council Member Trayhan who moved, seconded by Council Member Fowler to approve the minutes of November 4, 2008 and November 12, 2008. Vote was unanimous. Motion Carried 2. Utility Billing Write-Off – Consideration and/or action regarding approval of the utility billing write-offs. (K. Garcia) This item was pulled from the agenda. 3. Resolution No. 08-R-52 – Consideration and/or action approving a resolution for a Infrastructure Development Agreement between SCC Development Company, LLC., and the City of Schertz Economic Development Corporation in the amount of $28,600 (J. Jewell) Mayor Baldwin recognized Jeff Jewell, Economic Development Specialist, who introduced this item answering questions from Council. Mayor Baldwin recognized City Attorney City Council Regular Meeting November 18, 2008 294 Michael Spain who mentioned some minor changes that were made to the agreement. Mayor Baldwin recognized Council Member Scagliola who moved, seconded by Council Member Fowler to approve Resolution No. 08-R-52 approving an Infrastructure Development Agreement between the EDC and SCC. Vote was unanimous. Motion Carried 4. City of Schertz Official Posting Board – Consideration and/or action changing the location of the City Of Schertz Official Posting Board. (B. Dennis) Mayor Baldwin recognized City Attorney Michael Spain who introduced this item answering questions from Council. Council discussed this item in detail. Mayor Baldwin recognized Council Member Fowler who moved, seconded by Council Member Carpenter to approve the change of location of the City of Schertz Office Posting Board to the City Council Chambers Building and provide information to the public by posting a notice that the location has been changed. Vote was 5-1-0 with Mayor Pro-Tem Wilenchik Wilenchik voting no. Motion Carried DISCUSSION ONLY 5. Mayor Baldwin recognized Misty Nichols, Planner II, who introduced this item stating that all requirements to the site plan have been met and answered questions from Council. Mayor Baldwin recognized Steve White, Chair of the Economic Development Corporation who came forward mentioning that he had met with the applicant and was satisfied and approves the Self-Storage Facility being at this location. Council Members briefly discussed their views. No action was taken. DISCUSSION AND POSSIBLE ACTION 6. Consideration and or action action on questions and possible items to be placed on the next agenda. (Mayor/City Council) Mayor Baldwin recognized Council Member Fowler who asked if an item could be placed on a future agenda to discuss the possibility of implementing classes or internships to the high schools and colleges regarding Municipal Government. City Manager Don Taylor stated that the city currently participates in an internship program. No action taken. City Council Regular Meeting November 18, 2008 295 7. Announcements by City Council Members, Mayor and City Manager: Council Member Scagliola mentioned the Schertz Humane Society Cause for Paws Golf Tournament was held on Monday, November 10, 2008, he also mentioned the recent Ribbon Cutting was held Wednesday, November 12, 2008 for Sports Occupational & Knee Surgery 6051 FM 3009 #260 Mayor Baldwin mentioned the recent Schertz Humane Society Cause for Paws Golf Tournament was held Monday, November 10, 2008. Mayor Baldwin thanked all involved; he also mentioned he attended the Northeast Partnership meeting, Thursday, November 13, 2008. ADJOURNMENT As there was no further action, Mayor adjourned the meeting at 7:53 p.m. Special Presentation to Mayor Hal Baldwin followed meeting. __________________________________ Hal Baldwin, Mayor ATTEST: _____________________________________ Brenda Dennis, City Secretary Agenda No. 2 CITY COUNCIL MEMORANDUM/RESOLUTION City Council Meeting: November 25, 2008 Department: Engineering Subject: Bid # 08-PW-41-02 -Park Roads Construction – Recommend to reject all bids and rebid BACKGROUND As part of the development of the City Complex and Recreation facilities, a road network was contemplated with an entrance at Schertz Parkway adjacent to the new Welcome Center and continuing to the ball fields. This Project is collectively known as the Parks Roads Project. This project was bid on October 23, 2008 as a base bid with four additive alternates. Seven contractors submitted bids. A tabulation of the bids is attached. The apparent low bidder on the base bid is JR Sitework with a bid of $695,147.65. As bid, the total project consists of construction of 3,150 lineal feet of new streets, 22,750 square yards of parking lot pavement, sidewalks grading topsoil and associated amenities. FISCAL IMPACT Budgeted : $500,000.00 Low Base Bid $695,147.65 Deficit $195,147.65 RECOMMENDATION The base bid total for the low bidder exceeds the budgeted amount by $195,147.65. In an effort to preserve this project, the City Engineer and the Consultant, Don McCrary and Associates, have reviewed the bids and have evaluated the total project for restructuring the phasing of the construction. It has been determined from this evaluation that the project phasing can be restructured such that the possibility of a re-bid will bring the project in within budget. The City Engineer, therefore, recommends that all bids be rejected and the project be re-bid after modification to the scope of work as determined above. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ: That the above stated staff recommendations are hereby approved and authorized. This project was bid on November 6, 2008 with twelve contractors submitting. A tabulation of the bids is attached. The apparent low bidder is Dean Word Company, LTD. with a bid of $1,851,258.29. As bid, the project consists of construction of drainage system improvements, water and sewer relocations and improvements, and the reconstruction and widening of approximately 9,600 lineal feet of roadway. FISCAL IMPACT Budgeted in 2005 Bond – Streets: $2,583,943.23 Current Estimated total cost, including engineering, construction and incidentals: $2,180,452.29 Excess: $ 403,490.94 RECOMMENDATION The City Engineer concurs with Professional Engineering Design Group’s recommendation that Council award the bid for the Doerr Lane Project to Dean Word Company, Company, LTD. in the amount of $1,851,258.29. This revision proposes the addition of an alternate member to help meet the quorum requirements. On October 14, 2008 this item was brought to Council. At the request of Council this item is being brought back to revise the ordinance that established the TSAC Commission Members. ATTACHMENT Ordinance No. 08-M-51 ORDINANCE NO. 08-M-51 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING AND RESTATING CHAPTER 2, ARTICLE IV, SECTIONS 91-101, “ADMINISTRATION— TRANSPORTATION SAFETY ADVISORY COMMISSION” OF THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I. Chapter 2, Article IV, Sections 91-101 of the Code of Ordinances of the City of Schertz, Texas relates to the Transportation and Safety Advisory Commission and is hereby amended and restated as follows including, in particular, amendments to Section 2-94: “Sec. 2-91. Establishment. There is hereby created a Transportation Safety Advisory Commission (the “Commission”). Sec. 2-92. Purpose. The Commission shall review safety issues relating to transportation in the City to improve the quality of life in the City through a citizen-government partnership that promotes safe and secure roads which provide and promote convenience, recreational and leisure leisure activities, and continued beautification of the City. Sec. 2-93. Duties. (a) Subject to the approved budget of the City for the Commission, the Commission shall undertake the following activities: (1) Coordinate and communicate with the City Manager and the director of public works, and the Planning and Zoning Commission, the Schertz Development Foundation, the Schertz Economic Development Corporation, and similar bodies in the City on matters related to transportation safety; (2) Develop transportation safety materials, including but not limited to brochures, videos, profiles, fact sheets, and similar materials or information; (3) Develop research materials related to transportation safety; (4) Develop a transportation safety plan for the City; (5) Review all existing and proposed traffic ordinances; 50109551.1 1 (6) Develop and sponsor transportation safety courses for the citizens of the City, including but not limited to defensive driving courses, bicycle safety courses, and child car seat inspections; (7) Participate in appropriate fact-finding trips, conferences, and seminars related to transportation safety; and (8) Review plans, plats, site plans, and master plans for traffic safety recommendations when requested by the City Manager. (b) The Commission shall, at least semi-annually, report its activities and recommendations to the City Council through the City Manager. (c) The Commission shall undertake such additional duties and activities as may be approved from time to time by resolution of the City Council. Sec. 2-94 Composition of Commission; Terms of Members; Alternate Members The Commission shall be composed of nine (9) regular members who are residents or employees of the City and who shall be appointed by the City Council. Each regular member of the Commission shall be appointed by the City Council for a two-year term commencing on the expiration of the prior term of a regular member. In addition, the City Council may from time to time appoint up to three (3) additional persons as alternate members of the Commission. Such persons shall also be residents or employees of the City and may be appointed for terms not exceeding two (2) years. Such persons shall be designated by the City Council as Alternate No. 1, No. 2, or No. 3. Alternate members shall be entitled to receive notice of all Commission meetings. Alternate members may comment on matters coming before the Commission in the same manner that regular members may comment but, except as provided below, shall have no authority to vote and, unless serving in place of an absent regular member as provided below, shall not be considered in determining the presence of a quorum. In the absence from a meeting of the Commission of one or more regular members, alternate members shall, for such meeting, be counted toward a quorum, vote, and have all other rights of regular members (except any absent regular member’s office on the Commission). Alternate No. 1 may so act in the absence of one regular member, Alternate Nos. 1 and 2 may so act in the absence of two regular members, and Alternate Nos. 1, 2, and 3 may so act in the absence of three regular members. The City Council may remove a regular member or alternate member of the Commission at any time, with or without cause. In the event of the death, resignation, or removal of a regular member, the City Council shall appoint a replacement regular member to serve for the remainder of such member’s term. There shall be no limit on the number of terms an individual may serve on the Commission. 50109551.1 2 Sec. 2-95. Staff support and funding. (a) The City shall provide staff support to the Commission through the City Manager in coordination with the director of public works, the chief of police, and a City Council liaison, each of whom shall serve as ad hoc members of the Commission. (b) Funding for Commission activities shall be provided by the City as a line item in the City budget. Sec. 2-96. Officers. The members of the Commission shall select a chair to preside at meetings of the Commission and a vice-chair to serve in the absence of the chair. The City Manager shall provide a member of the City staff to serve as secretary for the Commission. Sec. 2-97. Meetings. Regular meetings of the Commission shall be held at least quarterly. Special meetings may be called by the chair or by any two members of the Commission. Five members of the Commission shall constitute a quorum, which shall be required for the Commission to conduct business. The vote of a majority of the members present shall be required for any action to be effective. Meetings of the Commission shall be conducted in accordance with the Texas Open Meetings Act. Notice of meetings shall be posted in accordance with such Act by the secretary. Minutes of Commission meetings shall be prepared by the secretary, and such minutes shall be distributed to members and shall be made available under standard City procedures to other interested persons. Sec. 2-98. Disqualification from voting. A member shall be disqualified from voting on a matter before the Commission if such member has a personal or monetary interest with respect to the project being voted upon or if the member will be affected, personally or monetarily (other than as a member of the general public), by the outcome of the vote. Sec. 2-99. No Compensation. The members of the Commission shall serve without compensation, except for reimbursement of actual expenses attendant to the performance of their duties as authorized by the City Manager. Sec. 2-100. Committees. The chair may establish permanent or special committees. Amendments. II. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed. Should any portion or part of this Ordinance be held for any reason invalid, unconstitutional, or unenforceable, the same shall not be construed to affect any other valid portion hereof, but all valid portions hereof shall remain in full force and effect. FISCAL IMPACT None RECOMMENDATION The City Council voted to approve Ordinance No. 08-S-49 at their November 4, 2008 regular meeting. WHEREAS, Arrington Self Storage of Schertz, has applied for a Specific Use Permit for approximately 2.820 acres of land described in Exhibit “A”, attached hereto and incorporated herein by reference (hereinafter, the “Property”) for a Self Storage Facility. SECTION VI Any person, firm, association of persons, corporation or other organization violating the provisions of this ordinance shall be deemed to be guilty of a misdemeanor and, upon conviction, shall be fined an amount not to exceed $2,000.00. Potential to partner with university Presentation By: Schertz Historical Preservation Committee History of Schertz Book “Schertz, Texas: The Story of Great Ancestry, Legacy, and Development” The Schertz Historical Preservation Committee (SHPC) will formally announce the release of their Schertz history book, “Schertz, Texas: The Story of Great Ancestry, Legacy, and Development”. The book is a compilation of the history of the City from mid-nineteenth century through 2008. The SHPC will be selling the book tonight at the Council meeting and during working hours at the Water Billing Office at City Hall and the Library. The book will cost $15 before Christmas and $18 after Christmas. Tax and/or shipping are additional. Net revenue from the sale of this book will be set aside to go to a future museum project.
