08-15-1989 .\ FI LE PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission and City Council conducted a Joint Public Hearing on Tuesday, August 15, 1989 at 7:00 P.M. in the Municipal Complex Council Chambers, 1400 Schertz Parkway. Those present were as follows: PLANNING & ZONING COMMISSION TY BRISGILL, CHAIRMAN KEITH VAN DINE, SECRETARY MERWIN WILLMAN BOB ANDREWS JIM SHRIVER CITY COUNCIL EARL W. NORMAN AGEE, POLICE CHIEF 11 CALL TO ORDER Mayor Earl Sawyer called the meeting to order at 7: 00 P'.M. Mr. Sawyer read a proclamation declaring the week of September 17-23 as Constitution Week in the City of Schertz. The proclamation was presented to Mrs. Donald Ellis, representative_ of the Daughters of the American Revolution. Mayor Sawyer then presented 1 ifeguards Greg Copeland and Kerry Dodd with certificates honoring their achievements to "Super Guard" . At this time Mayor Sawyer turned the meeting over to Planning and Zoning Chairman Ty Brisgill. Chairman Brisgill explained the rules of procedure that would be used for the public hearing. 12 PUBLIC HEARING: Amendment to Zoning Ordinance - ZC #95 To receive citizen. comments on an amendment to clarify non- conforming use and c~ange in ownership or tenant. Chairman Brisgill briefly explained the proposed amendment and opened the floor to questions. There were none and the public hearing on ZC #95 was closed. #3 PUBLIC HEARING: Amendment to Zoning Ordinance - ZC #96 To receive citizen comments on an amendment to clarify a change to setback requirements. Chairman Brisgill briefly explained the proposed amendment -and opened the floor to questions. There were none and the public hearing on ZC #96 was closed. 14 PUBLIC HEARING: Amendment to Zoning Ordinance - ZC #97 To receive citizen comments on an amendment to establish guidelines for regulating adult-oriented businesses. Chairman Brisgill briefly explained the proposed amendment and opened the floor to questions. Leon Davis of 1017 Gettysburg asked if the proposed amendments will be published and also asked for the definition of adult- oriented business. . Chairman Brisgill re~d Mr. Davis the definition of adult-oriented business and also informed Mr. Davis he could pick up a copy of the proposed amendments any time at City hall. Leon Davis then asked if it is the City's intention to prohibit adult-oriented businesses. Chairman Brisgill replied the City is. not trying to prohibit them, just regulate them. Councilmember Ken Greenwald commented the City is trying to limit where such businesses can be located. City Manager, Kerry Sweatt, spoke at this time saying the City, where it has none today, is trying to establish some controls on this type of business. Mr. Sweatt further advised the guidelines will be followed up with licensing regulations which the City is currently researching and drafting into an official document. Bob Andrews pointed out the public hearing is basically to get citizen input on the proposed amendments to the ordinance. Leon Davis questioned then exactly what the City is trying to control. Bob Andrews repl ied they are trying to control the number of adult-oriented businesses and their location. -2- ; i 1 I ,l There being no further discussion, the public hearing on ZC #97 was closed. 15 PUBLIC HEARING: Amendment to Zoning Ordinance- ZC #98 To receive citizen comments on an amendment concerning scheduling of public hearings before the Planning and Zoning Commission and the City Council. Chairman Brisgill briefly explained the proposed amendment and opened the floor to questions. There were none and the public hearing on ZC #98 was closed. Before adjournment of the public hearing Leon Davis spoke again and told the Commission and City Council it would be nice, if when they are having a public hearing, the citizens knew what they (the Commission and City Council) were talking about. Chairman Brisgill explained that the agendas are posted outside the Municipal Complex for the public to see, a notice of the public hearing is published in the Recorder and the citizens are welcome to come by City Hall to discuss or obtain a copy of anything on which they may have questions. #6 GENERAL DISCUSSION There was none. #7 ADJOURNMENT OF PUBLIC HEARING At this time Chairman Brisgill turned the meeting back over to Mayor Sawyer who closed the public hearing at 7:17 P.M. The Schertz Planning and Zoning Commission convened in a Special Session, after the Joint Public Hearing, in the Municipal Complex Conference Room. 18 CALL TO ORDER Chairman Brisgill called the meeting to order at 7:21 P.M. #9 CITIZENS' INPUT OTHER THAN AGENDA ITEMS There was none. 110 CONSIDER AND MAKE RECOMMENDATION: ZC #95 Bob Andrews made a motion to recommend to City Council approval of ZC #95, amendment to clarify non-conforming use and change in ownership or tenant. Keith Van Dine seconded the motion and the vote was unanimous in favor. Motion carried. I -3- , ! \. , '11 CONSIDER AND MAKE RECOMMENDATION: ZC #96 Bob Andrews made a motion to recommend to City Council approval of ZC #96, amendment to clarify a change to setback requirements. Motion carried. 112 CONSIDER AND MAKE RECOMMENDATION: ZC #97 Bob Andrews made a motion to recommend to City Council approval of ZC #97, amendment to establish guidelines for regulating aault-or1ented business. Keith Van Dine seconded the motion and the vote was unanimous in favor. Motion carried. 113 CONSIDER AND MAKE RECOMMENDATION: ZC #98 Bob Andrews made a motion to recommend to city Council approval of ZC #98, amendment concerning schedul ing of publ ic hearings _ before the Planning and Zoning Commission and the city Council. Keith Van Dine seconded the motion and the vote was unanimous in favor. Motion carried. 114 GENERAL DISCUSSION Keith Van Dine: still some bad potholes in Pfeil Road. (steve Simonson said he is working on getting some repairs for the road.) Bob Andrews: (a) Brought a clipping for everyone about Gemcraft. (b) Reminded everyone about the Business Appreciation Dinner this Thursday evening. (c) Asked if "Super C" on the corner of Aero and Schertz Parkway has permits for their portable sign. steve Simonson said yes they do. Steve Simonson: Was glad to see the' article about Gemcraft. Informed the Commission there is still some building going on in Woodland Oaks and Savannah Square and that Greenshire Oaks is doing very well. -4- I ::1 . . " Chairman Brisgill: (a) Remarked on Jack's Auto and T & M on FM 1518 and asked about requirements for fences and for gates. (Steve Simonson said he would check into it.) (b) Showed slides of different sections of Schertz which he is using in preparation for his presentation at the APA Conference ip October at Lubbock. The Commission offered their opinions and gave suggestions on what they thought were the most important points to bring out about the City of Schertz. (c) Requested that discussion on the Sign Ordinance and the proposed amendment on parkland, be placed on the agenda of the next regularly scheduled meeting. #15 ADJOURNMENT Bob Andrews made a motion to adjourn the meeting.
