A RESOLUTION
CALLING A BINGO LEGALIZATION ELECTION.
* * * * * * * * * * * * * * * *
WHEREAS, a petition for a bingo legalization election,
as authorized by the Bingo Enabling Act, Article l79d,
Texas Revised Civil Statutes, was duly filed with and verified
by the City Secretary; and
WHEREAS, the governing body of the City of Schertz, Texa s ,
has determined that said petition is in due and proper form
and that accordingly a bingo legalization election should be
called and held in accordance with law; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SCHERTZ, TEXAS:
I.
That an election be held in the City of Schertz, Texas,
on the 16th day of January, 1982, for the purpose of submitting
to the resident qualified electors of said City for their~action
thereupon, a proposition relating" to the legalization of bingo
games for charitable purposes as authorized by the Bingo Enabling
Act.
II.
That the entire City of Schertz, Texas, shall constitute
one election precinct for this election, and the Community
Center, 1400 Live Oak Road, Schertz, Texas, shall hereby be
designated as the polling place.
III.
That the following named persons are h~reby appointed
officers of the election:

If the Presiding Judge herein appointed serves in such capacity,
the Alternate Presiding Judge shall act as a clerk.
IV.
That the City Secretary's Office at the City Hall is
designated as the place where absentee voting shall be conducted.
The City Secretary (whose mailing address is P.O. Box I, Schertz,
Texas, 78154), shall act as absentee voting clerk. That with
the exception of Saturdays, Sundays and official State holidays,
said office or place shall remain open from 8:00 o'clock A.M.
to 5:00 o'clock P.M. for the purpose of conducting absentee voting.
V.
That the polls of said election shall be open from 7:00
o'clock A.M. to 7:00 o'clock P.M. on the day of said election.
VI.
That notice of said election shall be given by posting a
substantial copy of this resolution designated as a notice on
a bulletin board in the office of the City Secretary and at
least one other public place in the City at least twenty (20)
days before the election and by publishing a notice at least
one time, not more than twenty-five ( 25) days nor less than ten
(10) days before the election, in at least one newspaper published
and of general circulation within the City. The City Secretary
shall cause a notice of election to be sent to each newspaper
published and of general circulation in the City requesting that
notice in the form of a news release be published nQt more than
twenty-five ( 25) days nor less than ten (10) days before the
election.
VII.
That paper ballots shall be used in conducting said
election. Election ballots shall be prepared in such manner
that the voters may cast their ballots either "FOR" or "AGAINST"
the following ballot proposition:
PROPOSITION
ilLegalizing bingo games for charitable purposes as
authorized by the Bingo Enabling Act in the City of
Schertz, Texas."

VISTO QUE, una petici6n para una eleccitn legalizando juegos
de bingo, como autorizado por el Acto Permitiendo Juegos de Bingo,
Art1culo l79d, Estatutos Civiles Revisados de Texas, fue debida-
mente registrada con y verificada par el Secretario de la Ciu-
dad; y
VISTO QUE, el cuerpo directivo de la Ciudad de Schertz, Texas,
ha determinado que la petici6n est' en forma debida y propia y
que, en conformidad, una e1ecci6n sabre la legalizaci6n de jue-
gas de bingo deber' de llamarse y llevarse a cabo de acuerdo con
la ley; ahara, par 10 tanto,
RESUELVASE POR EL CONCILIO
DE LA CIUDAD DE SCHERTZ, TEXAS:

TAKE NOTICE that an election will be held in the City
of Schertz, Texas, on Saturday, January 16, 1982, in obedience
to a resolution duly entered by the City Council of said City
on the 1 st day of December, .1981, which resol u.tion reads
substantially as follows:
YOU WILL, THEREFORE, take notice of all the matters and
facts set out in the foregoing Notice of Election.

As you know, I submitted a petition to you at our last meeting
asking you to call an election under the Bingo Enabling Act. The
number of signatures on the petition was based on the number of
votes cast in the last governor's election as given to our Staff
by Guadalupe County via telephone. However, when the written
verification arrived, instead of the 652 votes cast as previously
given to us, the figure shown was 1,156 (see attached letter from
the Guadalupe County Election Administrator), I contacted Mrs.
Riecherzer, who had circulated the petition, and she obtained
the additional 41 signatures required per the number in the letter.
I have checked this procedure with Mr. Harris and the Secretary of
State and this procedure is legal. Therefore, tonight I present
the certified petition containing 119 names, which is three more
than the required 116 (10% of 1,156).
