CITIZEN COMMENTS No one spoke. At the request of City Staff, Mr. Spain, City Attorney, was present to discuss some issues relating to Item SC. Therefore, Mr. Richmond moved Item SC to be discussed first. 5. ITEMS FOR INDIVIDUAL CONSIDERATION: C. PC2006-118 Consider and act upon a request for final plat of the Enterprise Industrial Park. The 127.97 f acre tract is located at the intersection of Associate Drive and Lookout Road. The property is zoned Manufacturing District -Light (M-1). Owner /Representative: Tedford Barclay, Trammell Crow Applicant: Jesse Cantu, Civil Engineering Consultants Mr. Spain explained various platting issues, then answered Commissioners' questions on drainage. After some discussion, Ms. Tutschke moved to approve the item. Mr. Van Dine seconded the motion. Vote unanimous. Motion carried. 3. CONSENT AGENDA: Minutes Planning and Zoning Commission January 10, 2007 Page 1 of 6 A. PC2006-061 Consider and act upon a request for a final plat of the Cibolo Valley Baptist Church. The 10.001 acre tract is located at 5500 F.M. 1103. The property is zoned Pre-Development District (PD). Applicant/Owner: Cibolo Valley Baptist Church in care of Pastor Gene Tone. Representative: Mia Herbold, Cude Engineers, L.L.C. There were no items pulled for discussion. Mr. Sommers moved to approve the Consent Agenda item. Mr. Van Dine seconded the motion. Motion carried. ZC2006-017 Hold a public hearing and consider Meadow Creek Subdivision and act upon a request to rezone 28.35± acres from Single Family Dwelling District 2 (R-2) to Two-Family Residential District (R-3) The tract is situated out of the Toribio Herrera Survey No. 68, Abstract No. 153, Guadalupe County, Schertz, Texas. The property is generally located at the intersection of Maske Road and Oak Street. Owner: Paul and Rhonda Corder Representative/Applicant: Linda Carroll-Bradd with Stephen G. Cook Engineering Public Hearing was opened at 6:53 pm. Ivlr. Cook spoke on behalf of the replat request. Mr. Steven White, 805 Main Street, spoke in support of the change. Public Hearing was closed at 6:55 pin. After some discussion, Mr. Sommers moved to recommend approval to the City Council. 1VIr. ZC2006-018 Hold a public hearing and consider and act upon a request to rezone 15.251± acres from Single- Family Residential-7 District (R-7) to Public Use District (PUB). The tract is situated out of the Rafael Garza Survey Abstract No. 138, Guadalupe County, Schertz, Texas. The property is generally located on the north side of Old Wiederstein Road, between Belmont Parkway and FM 1103. Owner/Applicant: Board of Trustees of Schertz-Cibolo-Universal City ISD Representative: John E. Rothe, P.E. with CDS Muery Services Public Hearing opened at 7:01 pm. Dean Kennedy of 5450 FM 1103 inquired about its proximity to FM 1103. Public Hearing closed at 7:03 pm. After some discussion, Mr. Van Dine moved to recommend approval to the City Council. Ms. Tutschke seconded the motion. Vote unanimous. Motion carned. F. ZC2006-019 :Hold a public hearing and consider and act upon a request to rezone 6.926± acres from Residential/Agricultural District (R-A) to Manufacture District -Light (M-1). The tract is situated out of the Stacy B. Lewis Survey No. 138, Bexar County, Schertz, Texas. One lot is generally located on the northeast side of Ware-Seguin Road at Hallie Heights. The other two (2) lots are generally located on the east side of Boenig Drive, north and south sides of Laura Heights. Owner/Applicant: Harry L. Hausman, Laura Heights Estates, L.P. Representative: Rolando H. Briones, Jr., P.E. with Briones Consulting & Engineering, Ltd. Public Hearing opened at 7:08 pm. Grant Gains, Earl & Associates stated that the applicant would like to amend the request from M-1 to GB-3. Public Hearing closed at 7:11 pm. After some discussion, Mr. Sommers moved to recommend approval of the rezoning to GB-3 to the City Council. Ms. Tutschke seconded the motion. Vote unanimous. Motion carried. G. SUP2006-006 Hold a public hearing, and consider and act upon a request for Specific Use Permit of the future platted Block 2, Lot 15, Block 1, Lot 2, and Block 4, Lot 17 in the Laura Heights Estates Subdivision. The proposed commercial lots are within the Air Installation Compatible Use Zone (AICUZ). The property is zoned ResidentiaUAgricultural District (R-A) proposed Manufacture District -Light (M- 1). After a short discussion with Grant Gains, Earl & Associates, the Public Hearing was closed at 7:21 pm. After some discussion, the project was withdrawn by the applicant due to not having the knowledge of what the Specific Use Permit was for. 5. ITEMS FOR INDIVIDUAL CONSIDERATION A. PC2006-ll3 Consider and act upon a request for preliminary plat of the Hubertus Retail. The 7.999±-acre tract is located on the south east corner of Interstate Highway 35 and FM 1103. The property is zoned General Business District {GB). Owner/Applicant: Steven Heible, SCC Texas Group, Inc. Representative: Fernando Saenz, Macina Bose Copeland, Inc. After some discussion, Ms. Tutschke moved to approve the item. Mr. Sommers seconded the motion. Vote unanimous. Motion carried. B. PC2006-114 Consider and act upon a request for preliminary plat of the Lack's Subdivision. The 48.034±-acre tract is located at IH 35 and Schwab Road. The property is zoned Manufacture District -Light (M-1). Applicant/Owner: Melvin Lack /Lack Properties, Inc. Representative: Steven D. Eklund, P.E. /Bury & Partners-SA, Inc. After some discussion, Ms. Tutschke moved to approve the item. Mr. Van Dine seconded the motion. Vote unanimous. Motion carried. D. PC2006-055 Consider and act upon a request for site plan and two variances fora 522,112 square foot office/warehouse of the Enterprise Industrial Park, Warehouse #2. The 125.59 ~ acre tract is located at the intersection of Associate Drive and Lookout Road. The property is zoned Manufacturing District -Light (M-1). Vote unammous. G. PC2006-093 Consider and act upon a request for preliminary plat and replat of Oaks at Green Valley II. The 3.196± acre tract contains one commercial lot. The tract is located at the northeast corner of FM-3009 and Arroyo Verde. The property is zoned Neighborhood Services (NS). Owner/Applicant: Oaks at Green Valley, II, Ltd., Steve Braha Representative: MBC & Associates, Fernando Saenz After some discussion with Mr. Batchelder about the plat and saving trees, Mr. Van Dine moved to approve this item. Ms. Tutschke seconded the motion. Motion carried. Vote unanimous. I3. PC2006-094 Consider and act upon a request for preliminary plat for the Links at Scenic Hills Unit 2. The 10.277± acre tract is located near Columbia and Jimmy Walker Streets south of I-35 N. The plat contains fifty- one residential lots. Owner/Applicant: KB Homes Lone Star LP, Joe Hernandez Representative: Carter & Burgess, Inc., Billy Classen After some discussion, Mr. Sommers moved to approve this item. Mr. Van Dine seconded the motion. Motion carried. Vote unanimous. I. PC2006-095 Consider and act upon a request for preliminary plat for the Links at Scenic Hills Unit 3. The 23.464± acre tract is located near Columbia and Jimmy Walker Streets south of I-35 N. The plat contains eighty-eight residential lots and one Home Owners Association Greenbelt/Parkland lot. Owner/Applicant: KB Homes Lone Star LP, Joe Hernandez Representative: Carter & Burgess, Inc., Billy Classen After some discussion on who will maintain the Greenbelt/Parkland, Ms. Tutschke moved to approve this item. Mr. Sommers seconded the motion. Motion carried. Vote unanimous. 6. ITEMS FOR DISCUSSION A. City Council Councilman Carpenter inquired as to the status of the Planning and Zoning minutes and the reason as to why they are not up to date on the city's web site. Minutes Planning and Zoning Commission January 10, 2007 Page 5 of 6 Mr. Truitt responded that it is a workload issue. There was discussion in reference to the re-zoning of the city and its status. B. Director's Report Mr. Truitt informed the commission that Mr. Michael Brooks is no longer working for the City of Schertz. Mr. Truitt discussed the monthly report that he handed out to the commissioners and welcomed any feedback. Mr. Truitt also discussed that he is working on the zoning map and a proposed amiexation plan. C. Planning Commissioner Comments R~Te Tntcrhlra• Asked Councilmember Michael Carpenter why city council overturned their decisions on the zoning cases. She also stated that they were acting under the direction of the city council. Mr. Carpenter approached the podium to respond to her question. She also commented that she will not attend the January 24, 2007 meeting. Mr. Van Dine: Inquired as to how much of a certain property on FM 1518 is commercial. He was informed by staff that that particular property is in the PUD district. Mr. Evans: Inquired from staff about the drainage in Kensington Ranch Estates. He also discussed with staff about the Pecan Grove sign. Mr. Riclunond: Discussed with staff that he is frequently seeing banner signs with the new businesses. He also discussed commuter rail information. Also they discussed a possible joint City Council and Planning and Zoning meeting on January 30, 2007. 7. ADJOURNMENT The meeting adjourned at 8:45 P.M.
