05-13-2002 n/sBOARD OF ADJUSTMENT May 13, 2002 The Schertz Board of Adjustment conducted a public hearing on Monday May 13, 2002 at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz Texas. BOARD OF ADJUSTMENT Earl Hartzog, Chairman Ted Duigon James Harden Kathy Hill William Sommers, P & Z Commissioner Norman Slocum Peggy Brown MEMBER'S ABSENT None CITY STAFF Ron Youngblood, City Planner Misty Nichols, Recording Secretary OTHERS PRESENT Ron Coke, 2716 Star Light Lane Robert Brockman, 4505 Grand Forest #1 Call to Order: Chairman Hartzog called the meeting to order at 6:30 p.m. #2 Approval of minutes: Chairman Hartzog asked if there were any comments or changes to the minutes of April 15, 2002. Mr. Duigon stated he reviewed the minutes at an earlier date and fixed a few grammar errors. Mr. Duigon moved to approve the minutes of April 15, 2002 as amended. Ms. Hill seconded the motion. A vote was taken. The motion carried. Ms. Brown abstained, as she could not vote at last meeting. Chairman Hartzog explained to the citizens that there is one public hearing on the agenda. He stated it will be presented and citizens will be asked to speak if they have any questions or comments. #3 Public Hearing: On a request from Mr. Ron Coke, 2716 Star Light Lane, block 3 lot 25, Woodland Oaks Subdivision for a special exception to the Zoning Ordinance for a rear yard setback from 20' to 15' for the construction of a wood deck. (BOA # 172-02) Mr. Youngblood stated there were 42 letters sent. There were 4 letters returned all were in favor. None were opposed. Mr. Sommers stated this went before the Planning and Zoning Commission on April 23, 2002, the commissioners recommended approval of the request to the Board of Adjustment. Mr. Brockman stated there was an issue at the last City Council meeting about contacting home owners and what action to take if a home in the 200' area is for sale or under contract for purchase. Mr. Harden stated he personally spoke to Mr. Coke who informed him that the house that is for sale; the owners are out of town. After a brief discussion the Board explained to Mr. Brockman that the taxpayer of that property is the individual that is contacted. There were no further comments and Mr. Hartzog closed the Public Hearing. #4 Consider and take appropriate action: On the above request. for a special exception to the Zoning Ordinance. (BOA # 172-02) Mr. Duigon stated this house is in a standard neighborhood and this exception does not seem to create any problems for any of the other property owners in the area. Mr. Harden stated he walked the backyard with the owner and has no issues with .this request. Ms. Brown moved to approve the variance for a wood deck. Mr. Harden seconded the motion. A vote was taken. The motion carried. #5 Items by Board and City. Planner: Mr. Hartzog stated the next meeting is scheduled for June 10, 2002 and it is going to be a long one. There are 7 items set for the next agenda. Mr. Hartzog asked for Mr. Slocum, Ms. Brown, Ms. Hill, and Mr. Harden be scheduled for recommendation to Council for reappointment to the Board. Mr. Hartzog then stated he would like to establish a given Monday of each month for a BOA meeting. After a brief discussion it was noted that the meeting would have to be set no sooner than the second Monday of the month since the Planning and Zoning Commission only holds action meetings the fourth Tuesday of every month. The public notices have to be published and letters have to be sent out a minimum of 10 calendar days prior to a public hearing. Mr. Duigon mentioned the retirement party for Mr. Simonson went exceptionally well. #6 Adjournment: The meeting adjourned at 6:55pm.
