07-16-2001Board of Adjustment Monday, 7uly 16, 2001 The Schertz Board of Adjustment conducted a public hearing on Monday, July 16, 2001 at 6:30pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. #1 Call to order: Chairman Hartzog called the meeting to order at 6:30pm. #2 Approval of Minutes: Minutes of May 21, 2001 Mr. Duigon noted to make some changes on pages 2, 3, and 4. Mr. Harris moved to approve the minutes of May 21, 2001 as corrected. Mrs. Hill seconded the motion. A vote was taken and the motion carried. #3 Public hearing: Request from Steve Burg, 2609 Kingsland Circle Woodland Oaks Subdivision Unit 2B, Block 12, lot 58 for a special exception to the zoning ordinance to encroach into the 20' rear building setback from 20' to 14' for construction of a patio cover. (PC#157-01) Mr. Youngblood noted that 29 letters went out, 8 came back with approval and 0 opposed. No utilities are in the easement. Chairman Hartzog stated that they have a letter from Planning and Zoning with a recommendation for approval. Will Brown of 2601 Kingsland Circle stated that he received a letter as well and that he supports Mr. Burg's request. Chairman Hartzog asked if there were any additional comments or concerns. He then closed the public hearing. #4 Public hearing: Request from Larry G. Fortner, 2405 Witten horseshoe Unit 2A, block 10, lot 7 for a special exception to the zoning ordinance to encroach into the 20' rear building setback from 20' to 12' for construction of a covered patio. (PC#158-01). Mr. Youngblood stated that 19 letters went out, 2 came back in favor, none opposed, and two that were undeliverable. It has also been pre- coordinated with the Inspections Department and they have received permission from his Homeowners Association. There are no utilities affected. It was noted that Planning and Zoning has recommended approval for this item. There being no further business to discuss, Chairman Hartzog closed the Public Hearing. #5 Public Hearing: Request from David & Cindy Broschat, 4604 Flagstone Drive, Forest Ridge Subdivision Unit 1, Block 3, lot2 for a special exception to the zoning ordinance to encroach into the 15' utility easement for construction of a storage building. (PC#159-01) Mr. Youngblood noted that 16 letters went out, seven came back in favor, none were opposed, and one came back undeliverable. He stated that this building would not be attached to the foundation, so it can be moved if needed. No Utilities are affected and they have received permission from their Homeowners Association. Planning and Zoning has recommended approval on this item. There being no further business to discuss, Chairman Hartzog closed the Public Hearing. #6 Consider and Take Appropriate Action: Request on the above special exception to the zoning ordinance for Steve Burg, 2609. Kingsland Circle. (PC#157-01) Chairman Hartzog asked if there was any discussion or comments at this time. He then asked for a motion. Mr. Duigon moved to approve the request from Steve Burg for special exception to the zoning ordinance to encroach into the 20' rear building setback from 20' to 14' for construction of a patio cover. Mr. Harris seconded the motion. A vote was taken and the motion carried. Chairman Hartzog informed Mr. Burg that he could go to the City the next day to pick up his construction permit. #7 Consider and Take Appropriate Action: Request on the above special exception to the zoning ordinance for Larry G. Fortner, 2405 Witten.. (PC#158-01) 2 With no further discussion on this issue, Kathy Hill moved to approve the request from Larry G. Fortner, 2609 Witten Horseshoe Unit 2A, Block 10, lot 7 for a special exception to the zoning ordinance to encroach into the 20' rear setback from 20' to 12' for the construction of a covered patio. Mr. Duigon seconded the motion. A vote was taken and the motion carried. #8 Consider and Take Appropriate Action: Request on the above special exception to the Zoning Ordinance for David & Cindy Broschat, 4604 Flagstone Drive. After little discussion, Mr. Harris moved to approve the request from David and Cindy Broschat, 4604 Flagstone Drive, Forest Ridge Subdivision Unit 1, Block 3, lot 2 for special exception to the Zoning Ordinance to encroach into the 15' utility easement for construction of a storage building. Mr. Slocum seconded the motion. A vote was taken and the motion carried. #9 ITEMS BY THE BOARD AND CITY PLANNER: Ron Youngblood • New Library Village and Playscape Park. Mrs. Head is Chairwoman of this project and staff is now very involved as well. Briefing held at Alamo Area Council of Governments (AACOG) to obtain Grant money for this project. Approximate Cost is $640,000.00. A 50/50 grant with the City of Schertz and the Texas Department of Wildlife, contingent upon approval. The concept is to put together a Library Village that consists of some old historic buildings. Construction will probably start after the first of the year. • Informed the Board that there are some people that would be willing to donate some right-of-way to get an access from FM3009 all the way down to IH-10. • Stated that sometime in August the City will get the 2005 call for MPO projects in that year. If the City can obtain the right-of-ways, then this 2005 project would be moved back to a more current year. • Stated that they are working with TxDOT to try and restrict the amount of trucks around the area of IH-10.
