August 21, 1995
The Schertz Board of Adjustment convened in regular session on
Monday, August 21, 1995 at 6:00 p.m. in the Municipal Complex
Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those
present were as follows:

#1 CALL TO ORDER
Chairman Hartzog called the meeting to order at 6:00 p.m.
#2 APPROVAL OF MINUTES: Regular Session June 12, 1995.
Anita Clark moved to approve the minutes, as written, for June
12, 1995. Norman Slocum seconded the motion, which carried
with a unanimous vote.
#3 PUBLIC HEARING: The Board of Adjustment to receive
citizen input on a request from Reb Waldrop, 813 Mitchell, for
a Special Exception to the Zoning Ordinance for a variance for
a side yard set back to allow him to build an aluminum carport
(24' X 19') over his driveway. (BOA #64)
Reb Waldrop was at the meeting to represent this request.
Chairman Hartzog advised the purpose of the Public Hearing is
to receive comments from interested citizens. The Board of
Adjustment will take all of the comments into consideration on
their decision. After the Public Hearing is closed there will
be no other comments taken. Chairman Hartzog asked for staff
input at this time.
Steve Simonson stated in accordance with the ordinance for the
Board of Adjustment all property owners within a 300' radius
were notified. There were 45 letters sent concerning this
request, 14 were received back. There were 13 in favor and 1
opposed. The one that is opposed was concerned that it would
become a storage area and not be used as a garage. All the
fees have been paid and all documentation has been received.
This is a straight forward request; carports are authorized in
the City.
Norman Slocum asked if the person that is not in favor is a
neighbor on the opposite side of the request for the carport.
Steve Simonson advised that is correct.
Chairman Hartzog asked Mr. Waldrop if he had any questions or
comments. Mr. Waldrop stated he had none at this time.
With no other discussion or comments, Chairman Hartzog closed
the public hearing at 6:05 p.m. on this item.
~4 CONSIDER AND TARE APPROPRIATE ACTION: Consider and
take action on the Special Exception request from Reb Waldrop.

Anita Clark moved to approve the request from Reb Waldrop, 813

seconded the motion, which carried with a unanimous vote.
~5 CONSIDER AND MARE RECOMMENDATION: Board of Adjustment
Rules of Procedure.
Chairman Hartzog asked about meetings having to be canceled due
to lack of a quorum. Is there a way to have alternates
assigned so if a regular member is out of town the citizens are
not having to wait for their requests?
Steve Simonson stated on page 3 item 6 - E of the Rules of
Procedure it states that there has to be at least 4 members
present to vote on a reversal to the zoning ordinance. If the
BOA is in favor of changing it to include two (2) alternates in
case of an emergency it can be so rewritten.
Norman Slocum asked if the nature of the function that the BOA
does, warrants more members. Steve Simonson advised it is a
state law that there has to be at least 4 members present to be
able to vote.
Chairman Hartzog asked how long citizens are having to wait to
come before the BOA. Steve Simonson advised once the Planning
and Zoning receives the request and the BOA members have been
notified, whenever they will be available for a meeting. You
also have to take into consideration it has to be published at
least 15 days prior to the meeting in the Seguin Gazette and
also the property owners within 300' have to be notified.
Norman Slocum asked if the alternates would have to be present
at the BOA meetings if they were not needed. Steve Simonson
stated they would have to at least attend one or two meetings
to get the feel on how things are handled.

Joyce Briscoe moved to recommend to City Council the approval
of the Rules and Procedures contingent upon the addition of two
(2) alternates. Anita Clark seconded the motion, which carried
with a unanimous vote.
#6 GENERAL DISCUSSION:
Chairman Earl Hartzog:
Chairman Hartzog asked if everyone was going to be available
for the September 11, 1995 meeting that has been scheduled.
Norman Slocum advised that he will not be available as his wife
is surprising him with a trip to Las Vagas. Anita Clark
mentioned she will be out of town on vacation and will not
return until September 12, 1995. Chairman Hartzog at this time
canceled the meeting there not being a quorum. Chairman
Hartzog asked Steve Simonson if the City Manager could
accelerate the appoint of two (2) alternates in an emergency so
the meeting could be held. Steve Simonson advised he would see
if this could be done and get back with Chairman Hartzog.
Anita Clark•
Anita Clark asked about the widening of FM 78 if the City would
have to purchase any of the property that will be in the ROW.
Also how will the off street parking be handled?
Steve Simonson stated the City has not received a ROW map as of
yet. The City is aware of the Shoe Shop having to be purchased
it may be moved, rehabbed and used as a historical building.
There will be some ROW property from Church's Chicken, Car
Wash, Sonic and the old house on the corner of Mill Street that
will need to be taken. The parking will be angle parking. The
parking in front of the buildings now will be eliminated.
Norman Slocum asked about the utility poles on the railroad
side. Steve Simonson advised they will have to be moved. The
Public Works Department, Entex, GVEC have all identified what
will have to be moved. The lanes have been narrowed to help
from destroying any of the trees. Construction is supposed to
begin in FY 1997.
Joyce Briscoe•
Joyce Briscoe mentioned she had taken the tour of the City with
Steve Simonson and thanked him. It lasted about 1 1/2 to 2
hours and was very interesting.
Steve Simonson mentioned to drive the majority of the City it
takes between 1 1/2 to 2 hours. There is a map that we follow
explaining where water and sewer lines are, the growth is, and
why and where it is not.
