11-30-1998BOARD OF ADJUSTMENT MEETING November 30, 1998 The Schertz Board of Adjustment convened in regular session on Monday November 30, 1998, at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Board of Adjustment Ci Staff Earl Hartzog, Chairman Steve Simonson, Kathy Hill, Alternate Asst. City Manager Anita Clark Mary Ybarra Jim Harris Planning Secretary Peggy Brown Joyce Briscoe, P & Z ex-officio Members Absent Others Present Ted Duigon, (late arrival 6:50 p.m.) Joey Evans, 4338 Shallow Water #1 Call to Order: Chairman Hartzog called the meeting to order at 6:30 p.m. Chairman Hartzog reported that Ted Duigon is running late due to traffic, Kathy Hill, will sit in as alternate. #2 Approval of Minutes: Regular session of September 28, 1998. Chairman Hartzog asked for any comments or corrections to the minutes. 1 Jim Harris stated that on page three in the last sentence delete the word "when" to "within". Chairman Hartzog suggested that the time of arrival be placed if any member is late to any said meeting. With no further corrections, Jim Harris moved to approve the minutes for September 28, 1998, as amended. Anita Clark seconded the motion and the vote was as follows: Ayes: Earl Hartzog, Peggy Brown, Katy Hill, Jim Harris, and Anita Clark Motion carried. #3 Public Hearing: To receive citizen input on a request from Joey Evans, 3024 Greenshire Dr., for a Special Exception to the Zoning Ordinance to reduce the 20' rear yard building setback form 20' to 16' to allow a large single story home to be built. Chairman Hartzog stated that the purpose of the public hearing is to receive comments from interested citizens. The Board of Adjustment will take all of the comments into consideration in its decision. After the public hearing is closed there will be no other comments taken. Chairman Hartzog asked for staff input. Steve Simonson stated that in accordance with the city ordinance 7 letters were sent out to property owners within a 200' radius of said property. Of the letters sent out three (3} letters were received in favor, none were received opposed to the request. Steve Simonson stated that the house is single story on a lot with a slight curve. In building the size house wanted it would encroach 4' into the 20' rear yard building 2 setback. Steve Simonson added that there are no utility easements involved with this request. Earl Hartzog asked for staff input from the Planning and Zoning representative, Joyce Briscoe. He was advised that the Planning and Zoning Commission could not see a problem and recommended approval. With no further discussion, Earl Hartzog closed the public hearing at 6:35 p.m. #5 Consider and Take Appropriate Action: On the above Special Exception request from Joey Evans, 3024 Greenshire Dr. Earl Hartzog asked if there any questions or comments. With no further discussion, Jim Harris moved to approve the request from Joey Evans, 3024 Greenshire Dr., for a Special Exception to the Zoning Ordinance to reduce the 20' rear yard building setback form 20' to 16' to allow a large single story home to be built. Peggy Brown seconded the motion that carried unanimously. #7 GENERAL DISCUSSION: Kathy Hill: Kathy commented she was glad to be present. Peaav Brown: Peggy had no comments. Jim Harris: Jim asked if there were any meetings planned for the month of December, and was advised that there are plans for a meeting before the end of the year. Jim wanted to wish everyone a Merry Xmas and Happy New Year if the Board does not meet. 3 Anita Clark: Anita mentioned that the tree lighting is scheduled for Thursday at 6:30 p.m. Santa will be present and refreshments are planned. Anita added that the City decorations look great. Joyice Briscoe: Joyce mentioned that the Planning and Zoning Commission is working on strengthening the tree ordinance for the City. It has been an ongoing concern that Gary Wallace has undertaken. The document will be introduced to the P & Z Commission for review and recommendation, and forwarded to City Council for their consideration. Steve Simonson added that public hearings would be held sometime in January of 1999. Steve Simonson: Steve mentioned that the request for the Centurion Mini Storage on FM3009 withdrew the request. They also cancelled the purchase contract with Barshop. Steve reported that there are several changes to UDC that will come about at the first of the year. These are necessary changes that would help the City in future development. For instance, the change to the tree ordinance will help the city protect the treed areas in future development. For example, re-planting trees in areas where trees are removed or damaged. Steve mentioned that a new subdivision (Woodbridge) is starting construction behind Woodland Oaks Subdivision, which will finally bring Woodland Oaks Dr. out onto Schertz Parkway. Steve also mentioned that the signal light has been activated (flashing for awareness) at Woodland Oaks Dr. and FM3009. Another item to report is that Oak Trail Subdivision has stated construction behind Oak Forest. 4 Steve reported that Unit 3 of Forest Ridge Subdivision has been approved and would be starting construction soon. When complete it will have approximately 300 + basic units in the gated community. The original master plan shows that Wiederstein Road will be used as an emergency exit gate to be used only under emergency situations. Wiederstein Road is intended to have a 42' roadway from the where the road starts out to the end of the developer's property, which is 300' short of FM3009. Steve pointed out that Tri-County Business Park & Industrial Park is breaking ground for new development. If you haven't had a chance to drive out there, you should.
