August '17,1998
The Schertz Board of Adjustment convened in regular session on Monday August 17,
1998, at 6:30 p. m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway,
Schertz, Texas. Those present were as follows:

#1 Call to Order:
Chairman Hartzog called the meeting to order at 6:35 p.m.
#2 Approval of Minutes: Regular session of July 27, 1998.
Chairman Hartzog asked for any comments or corrections to the minutes.
Jim Harris moved to approve the minutes of July 27, 1998 as written. Anita Clark
seconded the motion that carried unanimously.

#3 Public Hearing: To receive citizen input on a request from Jenkins &
Associates, Inc. for a Special Exception to the Zoning Ordinance for a rear yard setback
from 10' to 4.6' to build a home on block 8, lot 9R, Oak Forest Subdivision. (BOA #111-
98).
Chairman Hartzog stated that the purpose of the public hearing is to receive comments
from interested citizens. The Board of Adjustment will take all of the comments into
consideration in its decision. After the public hearing is closed there will be no other
comments taken.
Earl Hartzog asked for staff input.
Steve Simonson stated that in accordance with the city ordinance 12 letters were sent
out to property owners within 200' radius of said property. Of the letters sent six letters
were received back. Five (5) in favor and one (1) opposed to the request.
Steve Simonson explained that the house built will back up to a 20' alleyway. It will not
abut to another house. It will encroach into the 10' building setback still leave 6' from the
alleyway, which is a total of 26' separation from the adjacent lot. Steve Simonson
added that no one will be abutting to each other.
Chairman Hartzog asked for citizen comments.
Carroll Albright, 1549 Circle Oak stated that she had no objections to the request.
Phyliss Orr likewise, asked for the board's consideration on the request.
With no further comments or questions, Chairman Hartzog closed the public hearing.
#4 Public Hearing: To receive citizen input on a request from Allan A~ei~ II,
216 Marilyn Dr. for a Special Exception to the Zoning Ordinance for a side yard setback
from 7' to 2' to widen driveway and build a carport. (BOA #112-98).

Chairman Hartzog stated that the purpose of the public hearing is to receive comments
from interested citizens. The Board of Adjustment will take all of the comments into
consideration in its decision. After the public hearing is closed there will be no other
comments taken.
Steve Simonson stated that in accordance with the city ordinance 27 letters were sent
out to property owners within a 200' radius of said property. Of the letters sent three
letters (3) were received back in favor and none were received opposed to the request.
Steve Simonson explained that the area is a R2 zoned area, which allows for carports in
the front of the property up to the ROW line of the City street.
Earl Hartzog stated that a letter from his neighbor, Mr. Kallestad is part of the packet,
stating that he has no objection to the request.
Wth no further comments or questions, Chairman Hartzog closed the public hearing at
6:40 p.m.
#5 Consider and Take Appropriate Action: On the above Special Exception
request from Jenkins & Associates, Oak Forest Subdivision. (BOA #111-98).
Earl Hartzog asked the board members if there are any questions or comments.
With no further discussion, Jim Harris moved to approve the request from Jenkins &
Associates, Inc. for a Special Exception to the Zoning Ordinance for a rear yard setback
from 10' to 4.6' to build a home on block 8, lot 9R, Oak Forest Subdivision. Peggy
Brown seconded the motion that carried unanimously.
#6 Consider and Make Appropriate Action: On the above Special
Exception request from Allan A. Biegert III, 216 Marilyn Dr. (BOA #112-98)

Earl Hartzog asked the board members if there are any questions or comments.
With no further discussion, Peggy Brown moved to approve the request from Allan A.
Biegert, III, 216 Marilyn Dr. for a Special Exception to the Zoning Ordinance for a side
yard setback from 7' to 2' to widen driveway and build a carport. Jim Harris seconded
the motion and the vote was as follows:
Ayes: Jim Harris, Peggy Brown, and Anita Clark.
Opposed: Earl Hartzog
Motion carried.
#7 GENERAL DISCUSSION:
Peggy Brown:
Peggy apologized for her late arrival. She was caught in traffic due to a bus accident on
I H35.
Jim Harris:
Jim had no comments.
Anita Clark:
Anita commented that how wonderful, it finally rained.
Earl Hartzog:
Earl asked if the new appointed board members have all come in to get sworn in, and
was advised that the only member that has not is Norman Slocum.

Steve Simonson:
Steve reported that the growth in the City is not slowing down. Carolina Crossing will be
expanding to the west side of Schertz Parkway, houses can't be built fast enough.
Steve sees the house market going into the year 2000. Steve added that a retail
business (Schlotskys Deli) is coming into the City.
Earl Hartzog asked if there are plans for Schertz Parkway to be widen and was advised
that Schertz Parkway will be a boulevard and plans for landscape medians, sidewalks
on one side and a bike and hike on the other side.
Steve reported that the FM78 project will start construction sometime in April of 1999,
however, there will be some pre-preparation construction for the relocation of sewer
lines, waterlines and gas lines very soon.
#7 ADJOURNMENT:
Chairman Earl Hartzog adjourned the meeting at 6:50 p.m.
