Juty 27, 1998
The Schertz Board of Adjustment convened in regular session on Monday, July 27,
1998, at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Schertz, Texas. Those present were as follows:

Chairman Hartzog called the meeting to order at 6:30 p.m.
#2 APPROVAL OF MINUTES: Regular session of July 6, 1998.
Earl Hartzog asked for any correction or additions to the minutes.
Jim Harris stated that on page four on the last paragraph the addition of the word
"thousand" before "sq.ft."
Ted Duigon stated that on page two third paragraph from the bottom the addition of
the word "not" before the word "require." Ted also added that at the end of the
statement the addition of "a double fee permit will be issued."
With no further corrections or additions, Jim Harris moved to approve the minutes of
July 6, 1998, as corrected. Ted Duigon seconded the motion that carried unanimously.

Peggy had no comments.

Jim had no comments.
Ted Duigon:
Ted stated that he is uncertain and would like clarification on the voting procedures
"for" or "against" on a request. Ted commented that clarification is needed in the
voting procedure when a vote is made a motion and a vote made on a request either
"for" or "against". What is the procedure? Ted was advised that at the present time a
vote of four is needed to approval a request. When only four members aze present
obviously the vote whether it is "for or "against" will affect the outcome.
Steve Simonson commented that the easiest way to clarify the concerns on the voting
procedure would be to make a motion to approve, "that doesn't mean you have to
vote to approve", all that has been done is a motion. If there is a second, that is all that
has been done. Steve added that the motion would then be brought to the table for the
vote and determined at that point whether the request is approved or denied. Steve
suggested that every issue be addressed in this way regazdless whether the voting
member is "for" or "against" the request. Steve added that the BOA's charter is only
to approve a variance and this will eliminate future problems to the outcome of
requests on variances.
Steve reported that the changes to the (UDC) voting procedure has had its first
reading before the City Council and before the next scheduled meeting the change
will be in effect.
Anita Clark:
Anita mentioned that the schools in Schertz had lowered the flags in observance to
the two police officers killed at the Nations Capitol. Anita asked why the flags at City
Hall were not lowered, and was advised that the decision was made not to lower the
flags. The flag is lowered to show sympathy. However, these deaths were not elected
or military officials.
December of this year wag the plan however, the date has been changed to April of
1999 because the engineer with TXDOT that has been working with the Seguin office
concluded a change in design was needed.
