July 12, 1999
The Schertz Board of Adjustment convened in regular session on Monday, July 12,
1999, at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Schertz, Texas. Those present were as follows:

Chairman Hartzog called the meeting to order at 6:30 p.m.
#2 APPROVAL OF MINUTES: Regular session of June 21, 1999.
Earl Hartzog asked for any correction or additions to the minutes of June 21, 1999?
With no further corrections or additions, a motion was made by Ted Duigon and
seconded by Anita Clark to approve the minutes of June 21, 1999 as written. With a
vote being called, the motion was as follows:
Ayes: Earl Hartzog, Anita Clark, Ted Duigon, and James Harris
Abstention: Peggy Brown (absent at said meeting).

#3 PUBLIC HEARING: The Board of Adjustment is to receive citizens input
on a request from Andy & Laura Mendez, 1104 Morning Rose for a Special
Exception to the Zoning Ordinance to encroach 4' into the 20' rear yard building
setback for construction of a deck.
Chairman Hartzog stated that the purpose of the public hearing is to receive
comments from interested citizens. Chairman Hartzog thanked the citizens' for their
interest and concerns. The Board of Adjustment will take all comments into
consideration in making its decision. After the public hearing is closed there will be
no other comments taken.
Earl Hartzog asked for staff input.
Steve Simonson reiterated his comments made in his notes in reference to Mr.
Mendez's request. It's a straight forward request and added that in accordance with
the City ordinance 26 letters were sent to property owners within the 200' radius of
said property. Of the letters sent, five letters were received in favor and non-opposed.
Chairman Hartzog mentioned that Joyce Briscoe was not present to give a report from
the Planning & Zoning Commission however, a letter from the Commission is part of
the packet recommending approval.
Earl Hartzog mentioned that one of the letters points out that they are in favor of the
request however, would like the deck to be no more than two feet from ground level.
Earl remarked that the request is irrelevant, the Board can not stipulate the two feet
requirement. Earl asked Mr. Mendez, how high would the deck actually be from the
ground? Mr. Mendez stated he believed it would not be more than two feet from
ground level.
With no further comments voiced, Chairman Hartzog closed the public hearing.
#4 CONSIDER AND TAKE APPRQPRIATE ACTION: Consider and take
action on the above Special Exception request from Andy & Laura Mendez, 1104
Morning Rose.
Chairman Hartzog asked for any discussion or comments on the request from Andy &
Laura Mendez?
Ted Duigon stated that he had one comment "why not a swimming pool instead of a
but tub, this is south Texas". James Harris remarked that he had a hot tub that he
enjoyed very much. They are very enjoyable and relaxing.
With no further discussion, a motion was made by James Harris and seconded by
Peggy Brown to approve the request from Andy & Laura Mendez, 1104 Morning
Rose for a Special Exception to the Zoning Ordinance to encroach 9' into the 20' rear
yard building setback for construction of a deck. With a vote being called, the motion
was approved.
#5 CONSIDER AND MADE RECOMMENDATION: Appointment of
Board Members.
Chairman Hartzog informed the members that his term and Ted Duigon's term is up
for re-appointment. He and Ted are interested in continuing to serve in their present
positions, unless someone would like to volunteer far one of the positions. If no one
is interested, a motion is needed recommending the re-appointment and forward it to
the City Council for consideration and approval.
The Board members were in agreement that Earl Hartzog and Ted Duigon continue in
their positions, a motion was made by James Harris and seconded by Anita Clark to
forward recommending re-appointment of a two year term to the City Council for
their consideration. With a vote being called, the vote was as follows:
Ayes: Earl Hartzog, Anita Clark, James Harris and Peggy Brown.
Abstention: Ted Duigon.
#7 GENERAL DISCUSSION:

Peggy had no comments.
James Harris:
Jim asked if anyone was familiar with the Texas Home Busmen Program? It's an
advocate for nursing homes that requires certification (two years) by the State of
Texas. The program enables you to visit nursing homes to assist the residents and
their relatives in technical matters. It's athree-month training program and if anyone
is interested in helping, volunteers are welcomed. Jim stated that he has received his
certification and would like to get the word out that it is a good program. He is
visiting the Lavernia nursing home at least once a week.

Anita Clark•
Anita reported a successful 4`~ of 3uly for the City.
Steve Simonson:
Steve reported that the Tri-County Business & Industrial Park area is running out of
land, there are only a few tracts of land left. If you haven't driven out to the area
please do, especially dawn Comdor Parkway. Lots of construction staking going up
and before too long a lot of construction will begin. Steve reminded the Board
members that one owner (Zemex) purchased the land from Resolution Trust. If the
Board recalls the (Zemex) owners came in and spent money to up grade the area and
hired a good marketing company and as you can see have done a good job.
The developments in the Tri-County area such as: Benevest Subdivision (Spec.
buildings); Cal-Tex; Southeastern Freight, etc. are getting together and designing a
sewer plant lift station, which will provide sewer lines for the entire development
down Tri-County Blvd.'s. drainage channel off of FM 3009.
Steve discussed Old ~Viederstein Road and the possibility the City had that Cibolo
would connect to it, and do what the City of Schertz did with Schertz Parkway.
However, as you well know Cibolo might connect to it but will not build a nice wide
road. At the present time Cibolo is proposing to build 450 homes (60x120 lots) right
off of Green Valley Road. There is a second tract adjacent to this tract that is under
contract and if that is purchased that means another 450 homes, totaling 900 homes.
Green Valley Road can not withstand all the traffic that would be placed on the road.
