07-10-2000BOARD OF ADJUSTMENT MEETING July 10, 2000 The Schertz Boazd of Adjustment convened in regular session on Monday, July 10, 2000 at 6:30 p.m, in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: BOARD OF ADJUSTMENT Eazl Hartzog, Chairman Ted Duigon Kathy Hill James Harris Peggy Brown Joyce Briscoe CITY STAFF Steve Simonson, Asst. City Manager Mary Ybarra, Planning & Recording Secretary MEMBERS ABSENT #1 CALL TO ORDER OTHERS PRESENT Robert W. Rush, 212 Newrock Creek Ronald M. Blakeman & Garnet Blakeman, 108 Webster Drive Chairman Hartzog called the meeting to order at 6:30 p.m. #2 APPROVAL OF MINUTES: Public Heazing of June 5, 2000. At this time, corrections by Ted Duigon and Kathy Hill were reported. On page one; add Joyce Briscoe to Board of Adjustment member list, page two; fifth pazagraph, last sentence change the word "this" with "these". In the last pazagraph correct the spelling of "Flagstone, and delete apostrophe after the number 15. On page three; last paragraph third sentence; correct the wording to read "stated Steve". On page four; sixth pazagraph last sentence correct the "expensive" to read "expenses". On page five; last pazagraph 1 delete the word "that" in the first sentence. On page six; third paragraph add the "Drive" to Flagstone. Delete the apostrophe after the number 15 in the fifth paragraph, third sentence. On page seven; correct "Katy" to read "Kathy" and several other corrections throughout the minutes with the same correction. On page eight; second pazagraph, first sentence add "it" after the word "is", and throughout the document capitalize the word "board" when referring to the Boazd of Adjustment. With no further corrections or additions, Ted Duigon made a motion to approve the minutes of June 5, 2000 as corrected. Kathy Hill seconded the motion. With a vote being called, the motion was approved. At this time, Chairman Hartzog reminded everyone present that the purpose of a public heazing is to receive comments from all interested citizens. The Boazd of Adjustment will take all comments into consideration in making their decision. After the public heazing is closed there will be no other comments taken from the citizens on these matters. #3 Public Hearing: Request from Ronald M. & Garnet Blakeman, 108 Webster for special exception to the zoning ordinance for side yard vaziance from 3' to 0' for placement of storage building. Eazl Hartzog asked for staff input. Steve Simonson reported that in accordance to the city ordinance fifteen letters (15) letters were sent out to property owners within a 200' radius of the property. Of the letters sent out, three (3) letters were received in favor and none were received opposed. Steve Simonson stated that a letter from the next door neighbor stating that he has no problem with the variance request is part of the packet for the Boazd's review. Also, the homeowner has provided pictures, which I will pass azound, stated Steve. At this time, Joyce Briscoe reported that the Planning and Zoning Commission 2 recommended approval, expressing that the Commission felt that the contractor had given the homeowner enough trouble. Chairman Hartzog asked if anyone present would like to speak on the matter before the Boazd. Garnet Blakeman, 108 Webster stated that the contractor had assured them that all necessary permits had been pulled. He had stated that plans were submitted and that approval was given by the city for placement of the storage building. However, the plans that were submitted were not the plans that were followed, this was detected at final inspection by the city inspector, stated Mrs. Blakeman. At this time, Mr. Simonson advised the Boazd that he has not seen the plans. With no further discussion, Chairman Hartzog closed the public heazing. At this time, Chairman Hartzog reiterated the public heazing procedures for everyone present. #4 Public Hearing: Request from Robert & Jacqueline Rush, 212 Newrock Creek for a special exception to the zoning ordinance to encroach into the reaz yard setback from 20' to 9' for construction of a covered deck. Steve Simonson stated that in accordance with city ordinance thirty-one (31) letters were sent out to property owners within 200' radius of the property. Of the letters sent out, five (5) letters were received in favor and none were received opposed. Mr. Simonson stated that there are no utility easements at the reaz or the sides of the home. Joyce Briscoe stated that the Planning and Zoning Commission recommended approval 3 on the standard request before the Boazd of Adjustment. At this time, Chairman Hartzog asked for citizen comments. With no further comments or concerns, Chairman Haztzog closed the public hearing. #5 CONSIDER AND TAKE APPROPRIATE ACTION: Request on the above special exception to the Zoning Ordinance for Ronald M. & Garnet Blakeman, 108 Webster. At this time, Chairman Hartzog asked for discussion or comments. Ted Duigon asked if the plan submitted was followed in the construction of the shed, and was advised that the plan from the contractor showed the 3' variance, however when the contractor placed the shed the measurement was off. Mr. Blakeman stated that problem was brought to his attention by the inspection department. Mr. Blakeman also stated that he has had many problems with the contractor. Mr. Blakeman informed the Board that the shed is a 10x12-foot shed, and the way it is placed he would have to teaz up the deck. With no further discussion, James Harris moved to approve the request from Ronald M. & Gaznet Blakeman, 108 Webster for a special exception to the zoning ordinance for a side yazd vaziance from 3' to 0' for placement of storage building. Kathy Hill seconded the motion. With a vote being called, the vote was as follows: Ayes: Earl Hartzog, Kathy Hill, James Harris and Peggy Brown. Opposed: Ted Duigon Motion carried. #6 CONSIDER AND TAKE APPROPRIATE ACTION: Request on the above 4 special exception to the Zoning Ordinance for Robert & Jacqueline Rush, 212 Newrock Creek. Chairman Hartzog asked for comments or discussion at this time. With none voiced, Peggy Brown moved to approve the request from Robert & Jacqueline Rush, 212 Newrock Creek for a special exception to the zoning ordinance to encroach into the reaz yazd setback from 20' to 9' for construction of a covered deck. Ted Duigon seconded the motion. With a vote being called, the motion was approved. #7 GENERAL DISCUSSION: Pegsv Brown• Peggy had no comments. James Harris• Jim had no comments. Ted Duigon: Ted had no comments. Kathy Hill: Kathy questioned the washing of cazs that is going on in her neighborhood. Kathy was advised that caz washing and hand watering is allowed. Steve advised Kathy that he would look into the watering situation. Joyce Briscoe• Joyce reported that she and her granddaughter would be leaving town on Thursday. They will be visiting New York for two weeks. Her granddaughter has been invited to The Juilliazd School. 5 Steve Simonson Steve reported on the purchase of property adjacent Greenfield Village along FM 3009 to FM 78. All the required information for any type of development has been given to the property owner. Steve also mentioned that Bob Bomer (Bob Bomer Oldsmobile) would be ready to start construction azound the first of the yeaz. He also reported that the FM78 project is ahead of schedule.
