The Schertz Board of Adjustment convened on April 27, 2009 at 6:00 p.m. at the Municipal Complex,
Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

CALL TO ORDERlROLL CALL
Mr. Hartzog called the meeting to order at 6:01P.M.

HEARING OF RESIDENTS
Norman Slocum, 1516 Greenwood, recognized, congratulated, and welcomed all board members.

Consider and act upon the Board of Adjustment minutes for December 1,2008.

Following reading of the agenda item, Mr. McQueen moved to approve the item. Mr. Slocum seconded the
motion. Vote was unanimous. Motion carried.
4.
PUBLIC HEARINGS:
A.
BOA 2009-001 Pet's Barn Store # 11 - 2765 FM 3009
Hold a public hearing and consider approval of a variance to Article 11 of the Unified Development
Code (UDC), Sec. 21.11.11, relating to the maximum height, maximum area and minimum setback of
a permitted monument sign, for a business located on Lot 43, Block 1 of the Horseshoe Oaks
subdivision.
Public hearing opened at 6:05 pm.
Ms. Wood reviewed staff comments and advised the Board the applicant is present.
Mr. Toye gave a short presentation on this property.
There being no one else to speak the Public hearing closed at 6: 14 pm.
Mr. Slocum questioned the hardship qualifications.
Mr. Toye stated that he was trying to duplicate the O'Reilly sign.
After a short discussion, Mr. Slocum moved to disapprove the variance requests related to exceeding the
maximum height and maximum area and moved to approve the encroachment of 5' into the minimum front
setback. Mr. McQueen seconded the motion. Vote Aye: Mr. Slocum, Ms. Price, and Mr. McQueen.
Vote Nay: Mr. Hartzog and Mr. Adams. Motion disapproved.

ITEMS FOR DISCUSSION:

Alternate Board Members meeting participation (E. Hartzog)

Mr. Hartzog advised the members that the City Attorney has notified him and the alternates are
permitted to sit on the dice and participate in the discussion.
B. Discussion regarding the recently adopted Unified Development Code Sec. 21.3.4 Board of
Adjustment. (E. Hartzog)
Mr. Hartzog advised the members that information was provided in the packet for the duties of the
Board to review.

REQUESTS AND ANNOUNCEMENT:

Mr. Hartzog briefed the Board on the AP A Conference attended and classes he attended.
Ms. Price briefed the Board on the AP A Conference attended and requested a joint workshop
with the Planning and Zoning Commission to discuss and share information received at the
Conference.
Mr. McQueen briefed the Board on the AP A Conference.
