2004E17-ELECTIONORDIN~CE NO. ~/-7/- ,~-- / '7 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY GENERAL ELECTION HELD IN SAID CITY ON THE FIFTEENTH DAY OF MAY, 2004; AND DECLARING AN EMERGENCY. WHEREAS, there came to be considered the returns of a City Council General Election duly and legally held in the City of Schertz, Texas on May 15, 2004; and WHEREAS, this City Council has reviewed official election returns which were duly and lawfully provided to said City Council by the Guadalupe County Elections Administrator; and WHEREAS, from said returns, this Council hereby finds that there were cast in said election, by those voters who were resident qualified electors of the City, the following votes: POSITION CANDIDATE VOTES Mayor George Mower 189 Councilmember Place 1 Councilmember Place 2 Hal Baldwin 751 Kelly W. Kismer 362 Carl C. Douglas 544 Steve Simonson 480 Michael R. Carpenter 453 and, WHEREAS, from the above tabulation and findings, this City Council further finds that there were cast in said election a total of 964 votes and that for Mayor, Hal Baldwin received a plurality of votes cast; and for Councilmember, Place 1 Carl C. Douglas received a plurality of votes cast; and for Councilmember, Place 2 Steve Simonson received a plurality of votes cast. NOW TItE~FO~, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT, Hal Baldwin is hereby duly elected Mayor and Carl C. Douglas is hereby duly elected Councilmember Place 1 and Steve Simonson is hereby duly elected Councilmernber Place 2 on the City Council of the City of Schertz, Texas, pursuant to the election duly held within said City on May 15, 2004. II THAT, the public importance of this measure constitutes and creates an urgent necessity to comply with the State Election Law that requires this Ordinance be passed and take effect as an emergency measure and shall take effect and be in fore immediately and after its passage.
