00A10 Annexation 16.616 acres Comal CountyORDINANCE NO. /® AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF TWO (2) TRACTS OF LAND OUT OF COMAL COUNTY CONTAINING A TOTAL OF 16.616 ACRES. WHEREAS, the hereafter described tracts of land adjoin the corporate limits of the City of Schertz, Texas, and do not exceed one (1) mile in width; and, WHEREAS, public hearings on the question of whether said tracts of land should be annexed to and become a part of the City of Schertz, Texas, were duly called and notice thereof given and said public hearings have been held, all in accordance with law; and, WHEREAS, the City Council of the City of Schertz, Texas, is of the opinion and finds that such territory is suitable for municipal purposes and that it is in the best interest of the City of Schertz, Texas, and the citizens and inhabitants thereof, that said territory be annexed to and made a part of said City; and, WHEREAS, the City Council has directed the City Manager to prepare a service plan that provides for the extension of municipal services into the area to be annexed in accordance with law; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT, the following described territory containing 16.616 acres of land lying adjacent to and adjoining the City of Schertz, Texas, be and the same is hereby added and annexed to the City of Schertz, Texas; and said territory shall hereinafter be included with the boundary limits of said City and the various points contiguous to the area described and hereby altered and amended so As to include said land and territory within the corporate limits of the City of Schertz, Texas; said land being more particularly described by metes and bounds as follows: FA THAT, the Service Plan providing municipal services be attached and made a part of this Ordinance annexing the area and approved as a part of this Ordinance. The Plan shall be construed as a contractual obligation and be valid for ten (10) years and renewal shall be at the discretion of the City of Schertz, Texas. 3 THAT, the territory so described and the areas so annexed shall hereafter be a part of the City of Schertz, Texas, and all taxable property situated therein shall hereafter bear its pro rata part of the taxes levied by the City of Schertz, Texas, and the inhabitants thereof shal[ be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Schertz, Texas. Mayor, City of 8chertz, Texas CiN Secretary, City of Schertz (SEAL OF CITY) SERVICE PLAN PROVIDING FOR MUNICIPAL SERVICES I Pursuant to V.T.C.A. Local Government Code Sections 43.033 and 43.056, the City of Schertz, Texas does hereby propose and adopt the following service plan that provides for the extension of City services to land that adjoins the corporate limits of the City of Schertz, Texas. Said land being herein described by legal description and that said the City of Schertz, Texas, is hereby being considered for annexation by the City of Schertz, Texas. II This plan applies to acre tract of land out of County, described in the attached field notes /metes and bounds and map, and made a part hereof. III That the City of Schertz, Texas proposes and adopts the following plan: A. That upon installation of water and sewer lines as required by ordinances of the City, the City will permit those services to be used according to the general standard and scope of those type of services furnished by the City in other areas of the City of Schertz which have characteristics of topography, patterns of land utilization, and population density similar to this area being annexed. B. That law enforcement services, fire department services, and emergency medical services will be provided by the City of Schertz according to the general standard and scope of those services furnished by the City in other areas of the City of Schertz which have characteristics of topography, patterns of land utilization, and population density similar to this area being annexed. C. That garbage collection service will be made available by the City of Schertz according to the same standard and scope of that type service made available by the City in other areas of the City of Schertz, Texas. D. That other services that may be provided by the city such as planning, code enforcement, animal control, library, park and swimming pool, court, general administration and operation of maintenance of roads and streets will be made available on the effective date of the annexation on the same basis and at the same level as provided throughout the city. E. That this area being annexed, and the residents thereof, are entitled to and shall be governed by the Charter of the City of Schertz and all statutes, ordinances, policies and any and all other governing directives that exist or may ever exist for those residents presently within the corporate limits of the City of Schertz. F. That if this area being annexed is ever disannexed, then only those laws, rules, regulations, ordinances and any and all other governing directives that may apply to areas of land within the extraterritorial jurisdiction of the City of Schertz will be in effect. G. That it is the intent of the City of Schertz to comply with the laws of the State of Texas that relate to the annexation of territory. H. That the provisions of this plan will commence upon the effective date of an approved and adopted ordinance annexing this territory into the corporate limits of the City of Schertz. I. That nothing in this plan shall require the City to provide a uniform level of full municipal services to each area of the city, including the annexed area, if different characteristics of topography, land use, and population density are considered a sufficient basis for providing different levels of service. Proposed Annexation of 16.616 -Acres of Land Comal Independent School District, Comal County, Texas. TRACT 1 BEGINNING at a %2" re -bar rod set at a corner post in the Northwest R.O.W. line of F. M. 482, for the south corner of an 11.51 acre tract conveyed by Willie R. Sham to Comal County Rural High School District No- 705 by deed dated February 10, 1958 and recorded in Volume 112 on pages 507- 508 of the Deed Records of Comal County, Texas, and being the east corner of a 2.215 acre tract out of the Francisco Rodriguez Survey No. 99, Abstract 484, Comal County, Texas conveyed by the Willie R. Sham Estate to Isabel Moms by deed dated April 1, 1977 and recorded in Volume 255 on pages 830 -832 of the Deed Records at Comal Country Texas. THENCE with the Northwest R.O.W. line of F. M. 482, the Southeast line of the Isabel Morris 35.558 acre tract, S. 39° 51' 00 ", 144.36 feet to a '/2" re -bar rod set for the South corner of said 2.215 acre tract; THENCE into the Isabel Morris 35.558 acre tract, establishing the Southwest line of said 2.215 acre tract, N 25° 55' 00 W, 661.12 feet to a '/2" re -bar rod set for the West corner of said 2.215 acre tract; THENCE establishing the Northwest line of said 2.215 acre tract, N 52° 47' 42" E, 146.81 feet to a %2" bolt found in the Northeast line of the Isabel Morris 35.558 acre tract, for the West corner of the Comal County Rural High School District No. 705 11.51 -acre tract, for the North comer of said 2.215 -acre tract; THENCE, with the Northwest line of said 11.51 acre tract, along the high bank of a creek, N 70° 02'00" E, 234.00 feet, N 56° 07'00" E, 140.00 feet, and N 46° 55'00" E, 371.00 feet to a post for the North corner of said 11.51 acre tract; THENCE, with the Northeast line of said 11.51 acre tract, S 29° 25' 00" E, 726.54 feet to a point on the Northwest R.O.W. line of F. M. 482, said point being the South corner of Comal County Rural High School District No. 705 11.51 acre tract and the East corner of said 2.215 acre tract, crossing F. M. 482, S 00° 02' 00" E, 66.46 feet to a 1/2" re -bar rod found in the Southwest R.O.W. line of F. M. 482 for the North corner of Lot 2, Block 1, SAHM ACRES, plat recorded in Volume 9 on page 32 of the Map and Plat Records of Comal County, Texas, and being the West corner of the herein described 2.891 acre tract; THENCE with the Southeast line of F. M. 482, N. 60'06' 19" E, 780.75 feet to a %" re -bar rod set at the point of intersection of the Southeast line of F. M. 482 with the Southwest line of Friesenhahn Lane, for the North corner of this 2.891 acre tract; THENCE with the Southwest line of Friesenhahn Lane, S. 28 ° 55' 50" E, 225.50 feet to a '/2" re- bar rod found at the point of intersection of the Northwest R.O.W. line of the Union Pacific Railroad (formerly the M.K. & T. Railroad) and the point of intersection of the City of Schertz City Limits Line ( Annexation No. 75 -A -49) with the Southwest line of Friesenhahm Lane, for the East corner of this 2.891 acre tract; THENCE with the Northwest R.O.W. line of the Union Pacific Railroad, and the City of Schertz City Limits Line ( Annexation No. 75- A -49), S 69° 26' 49" W, 787.11 feet to a '' /2" re -bar rod found for the East corner of Lot 2, Block 1, SAHM ACRES, for the south corner of this 2.891 acre tract; THENCE with the Northeast line of Lot 2, Block 1, SAHM ACRES, N 30° 03' 34" W, 97.71 feet TO THE POINT OF BEGINNING, containing 2.891 acres.
