2004M05-CITY COUNCILOrdinance No. ~0 ,t/~_ AN ORDINANCE ESTABLISHING THE CITY COUNCIL AS THE FINAL BODY OF APPEAL FOR ACTIONS BY CITY BOARDS, COMMISSIONS, AND COMMITTEES WHEREAS, the City of Schertz, Texas (the "City") has established various boards, commissions, and committees which may make decisions with respect to the interpretation and implementation of and variances to City policies, roles, regulations, and ordinances; and WHEREAS, the City Council believes that, except as otherwise explicitly required by State law, the City Council should make the f'mal determination regarding any appeal of any such decision by any City board, commission, or committee, unless such authority has by ordinance been assigned to the City Manager; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION 1. Except to the extent otherwise explicitly set forth by State law or unless such authority has by ordinance been assigned to the City Manager, any fmal determination by any City board, commission, or committee may be appealed to the City Council by the person or entity that requested the matter to be acted upon by such board, commission, or committee, and the decision of the City Council with respect to such appeal shall be conclusive. In such case, the City Council may confirm or reverse the decision of such board, commission, or committee and issue a final decision, or it may require such board, commission, or committee to reconsider its action. SECTION 2. All ordinances (including but not limited to the Code of Ordinances of the City and the City's Uniform Development Code) and resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Ordinance are hereby repealed to the extent of such conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters ordained herein. SECTION 3. It is officially found, determined, and declared that the meeting at which this Ordinance is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Ordinance, was given, all as required by Chapter 551, as amended, Texas Government Code. SECTION 4. and it is so ordained. This Ordinance shall be in full force and effect from and after its final passage, 2004. PASSED AND APPROVED on first reading the ,&9~day of January, 2004.
