AN ORDINANCE PROVIDING FOR CERTAIN LAND
TRANSFERS, INCLUDING THE RELEASE OF CERTAIN LAND
FROM THE EXTRATERRITORIAL JURISDICTION OF THE
CITY OF SCHERTZ TO THE EXTRATERRITORIAL
JURISDICTION OF THE CITY OF NEW BRAUNFELS, TEXAS,
AND THE ACCEPTANCE OF CERTAIN LAND FROM NEW
BRAUNFELS INTO THE EXTRATERRITORIAL JURISDICTION
OF THE CITY OF SCHERTZ, AND RELATED MATTERS
WHEREAS, the City Council of the City of Schertz wishes to release certain land
described on Exhibit A from its extraterritorial jurisdiction (the "Released ETJ'); and
WHEREAS, the City of New Braunfels, Texas ( "New Braunfels ") has requested the City
of Schertz to release the Released ETJ from the City of Schertz's extraterritorial jurisdiction to
the extraterritorial jurisdiction of New Braunfels; and
WHEREAS, the City of Schertz has requested New Braunfels to release certain land
within its extraterritorial jurisdiction described on Exhibit B (the "New ETJ ") to the City of
Schertz, and New Braunfels has agreed to do so; and
WHEREAS, the City Council of the City of Schertz hereby finds that it is in the best
interest of the City of Schertz and the citizens thereof that the City of Schertz and New Braunfels
exchange a portion of their respective extraterritorial jurisdictions as described herein.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SCHERTZ, TEXAS:
SECTION 1. The City of Schertz hereby releases the Released ETJ from its
extraterritorial jurisdiction to the extraterritorial jurisdiction of New Braunfels, effective as of the
date the New ETJ is released to the City of Schertz.
SECTION 2. The City of Schertz hereby accepts the New ETJ into its extraterritorial
jurisdiction, effective as of the date the New ETJ is released to the City of Schertz.
SECTION 3. The City Manager is hereby authorized to execute all documents necessary
to accomplish the purposes of this Ordinance.
SECTION 4. This Ordinance shall be in full force and effect from and after its final
passage, and it is so ordained.
