1994M15- REVISING SECTION 2.2 OF SAID CODE ORDINANCE NO. :/-Y-/'!-/_'" AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 2.2 OF SAID CODE; PROVIDING FOR THE ESTABLISHMENT OF RULES, TIMES AND PROCEDURES FOR CONDUCTING CITY COUNCIL MEETINGS. WHEREAS, Section 4.09(d) of the City Charter of the City of Schertz provides that the City Council (the Council) shall, by ordinance, determine its own rules and order of business with respect to meetings of the Council; and WHEREAS, it is deemed advisable for the Council to establish rules for the conduct of Council meetings, both formal and informal, and to establish rules of conduct and courtesy for those persons attending meetings of the Council; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I THAT Section 2.2 of the Code of Ordinances of the City of Schertz, Texas be amended so that such section shall read as follows: "Section 2.2 Rules, times, places and procedures for conducting Council meetings. Section 2.2.1 Aqenda and Notice. (a) The Council shall conduct itself in accordance with the general laws of the State of Texas, the City Charter and as specified in this Ordinance. (b) The Mayor and the City Manager shall direct the City Secretary to prepare the agenda for each meeting of the Council. Any three (3) Councilmembers or the City Manager may enter items on the agenda; provided, the Mayor may defer items for later agendas if he or she determines that items submitted would constitute an unmanageable workload for the Council session concerned. (c) Notices of meetings of the Council shall be posted and otherwise provided at the times and in the places required by the general laws of the State of Texas and the City Charter. Section 2.2.2 Time and Place of Meetinas. (a) The Council shall conduct its regular meetings in the Council Chambers in the Municipal Complex on the first and third Tuesday of each month beginning at 7:00 p.m., unless otherwise officially established by the Council. (b) The Council shall conduct other meetings or informal work sessions on a regular or as-needed basis, as determined by the Council from time to time. (c) The Council shall conduct special meetings upon the written request of the Mayor, the City Manager, or on application of three members of the Council. Special meetings shall be convened in the Council Chambers or at such other location in the Municipal Complex as is specified in the notice of such meeting. (d) After convening in the location set forth in the notice of a meeting, the Council may adjourn to another place to conduct its business after which the Council shall reconvene at its regular place of business prior to a permanent adjournment of the meeting. Section 2.2.3 Conduct of Meetinas. (a) Meetings of the Council shall be called to order by the Mayor, or in the absence of the Mayor, by the Mayor Pro-Tem; in the absence of both the Mayor and Mayor Pro-Tem, a meeting shall be called to order by the City Secretary. In the absence of both the Mayor and Mayor Pro-Tem and with a quorum being present, Councilmembers present shall designate one of their members as the temporary presiding officer for the meeting. (b) The Mayor or other presiding officer shall ensure that dignity is maintained at all times during meetings of the Council. Members of the Council shall not impugn the motives of other Councilmembers and shall confine their remarks to questions under discussion. No member shall address the Council from any place other than his or her own seat or until after being recognized by the presiding officer. The presiding officer shall assure that each member of the Council has a reasonable opportunity to speak at the appropriate time on matters before the Council. (c) Council meetings shall be conducted in accordance with Robert Rules of Order. (d) No speaker shall verbally attack or or degrade the dignity or conduct of Council. otherwise disrupt business of the Section 2.2.4 Citizen Participation (a) In accordance with Section 4.09(d) of the City Charter, all citizens shall have a reasonable opportunity to be heard at any meeting of the Council with regard to any matter relevant to the government of the City. (b) Any citizen wishing to address the Council must sign the register which will be provided by the City Secretary and shall indicate the item or items on the agenda such person wishes to address. If a person wishes to speak on a matter which is not a listed item on the agenda, the person must indicate the subject matter on the register. Each speaker shall be limited to five minutes unless otherwise agreed by the presiding officer. All of those who have registered to speak shall be called upon during "Hearing of Residents" or a similar designated point in the Council meeting to speak in the order that they have registered; provided, persons who wish to speak in connection with an announced public hearing shall be permitted to speak during such public hearing. Citizens addressing the Council shall speak from the designated area provided and shall give their name and address and identify the subject or subjects they wish to discuss. (c) No person attending any Council meeting shall delay, interrupt, or disrupt the proceedings or refuse to obey the orders of the presiding officer. No demonstrations of any kind shall be permitted in the Council Chamber. (d) The presiding officer at any meeting is authorized to have any person violating the provisions of this Section removed from such meeting. II Incorporation of Recitals. The recitals contained in preamble hereof are hereby found to be true, and recitals are hereby made a part of this Ordinance for purposes and are adopted as a part of the judgement findings of the Council. the such all and III Inconsistent Actions Repealed. All ordinances and resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Ordinance are hereby repealed to the extent of such conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters ordained herein. IV Governinq Law. This Ordinance shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. V Severabilitv. If any provision of this Ordinance or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Ordinance and the application of such provision to other persons and circumstances shall nevertheless be valid, and the Council hereby declares that this Ordinance would have been enacted without such invalid provision. VI Ooen Meetinqs. It is officially found, determined and declared that the meetings at which this Ordinance is considered and adopted were open to the public and public notice of the time, place and subject matter of the public business to be considered at such meetings, including this Ordinance, was given, all as required by Chapter 552, as amended, Texas Government Code. VII Effective Date. This Ordinance shall be in force and effect from and after its final passage and it is so ordained. Approved on first reading the ~~ day of Sfj~/' 1994.
