1994M1- ECONOMIC DEVELOPMENT TASK FORCE ORDINANCE NO. 9q-A1-J , AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REPEALING CHAPTER 2, ARTICLE IV, ECONOMIC DEVELOPMENT TASK FORCE AND BY ADDING A NEW CHAPTER 2, ARTICLE IV, ECONOMIC DEVELOPMENT COMMISSION. WHEREAS, it is support the continued of Schertz, and; the express intent of City Council to growth and managed development of the City WHEREAS, the current Economic Development Task Force has completed all tasks assigned in an outstanding manner, and; WHEREAS, a need exists for a stable, on-going body to oversee the Economic Development activity of the City of Schertz over the longer term, and; WHEREAS, continued citizen involvement is crucial to long term economic development policy; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION I THAT, dissolved; the Schertz Economic Development Task Force is hereby and, THAT, in its place shall be created the Schertz Economic Development Commission, and, THAT, the By-Laws of this commission are included as exhibit 1 to this ordinance and made a part of this ordinance. THAT, CHAPTER 2, ARTICLE IV, Sections 2-70, 2-71, and of the Code of Ordinances are hereby repealed and declared and void and of no effect. 2-72 null SECTION II THAT, a new CHAPTER 2, ARTICLE IV of the Code of Ordinances of the City of Schertz, Texas shall read as follows: -1- "ARTICLE IV ECONOMIC DEVELOPMENT COMMISSION Sec. 2-70. Establishment, Composition There is hereby created a Economic Development Commission of at least seven (7) members to be composed of citizens of the City of Schertz, or interested persons employed or owning businesses within the City of Schertz. Sec. 2-71. Appointment of Members. All members of the Commission are to be appointed by the City Council of the City of Schertz. Members shall be appointed for two year staggered terms. Members may be appointed to succeed themselves. Vacancies shall be filled by City Council for the completion of a term of office. Sec. 2-72. Purpose. The purpose of the Economic Development Commission is to oversee the Economic Development activities of the City of Schertz. The commission will provide economic development policy recommendations to the City Council of the City of Schertz on all matters related to economic development. Specific duties and objectives are outlined in Exhibit 1 to this Article, entitled BY-LAWS, SGhertz Economic Development Commission." PASSED, APPROVED, T I'rNo r\'{', ' 'fer AND ADOPTED this the I day of ATTEST: z (Seal of the City) Exhibit 1 BY-LAWS SCHERTZ ECONOMIC DEVELOPMENT COMMISSION Section I: PURPOSE The purpose of the Schertz Economic Development Commission is as follows: (1) Oversee the economic development activities of the City of Schertz; (2) Provide economic development policy recommendations to the City Council of the City of Schertz on all matters related to economic development, includeing Tax Abatement and other economic development incentive requests. Section 2: Duties of the Commission The defined duties of the Commission are outlined below. to be limiting. Additional Council as needed. Schertz Economic Development This listing is not intended duties may be added by City (1) Coordinate and communicate with the Planning and Zoning Commission, the Schertz Development Foundation, the Schertz Parkway Tax Increment Financing Board of Directors, and similar bodies in the City of Schertz on all matters related to economic development; (2) Develop marketing materials, i.e.: Brochures, Videos, Profiles, Fact Sheets, and similar materials or information to be used for promotional activity; (3) Develop research materials needed for marketing, prospecting, and retention of businesses; (4) Serve as the host of the Annual Schertz Business Appreciation Dinner; (5) Serve as the resource cadre for prospect handling missions and visits; (6) Develop the strategic economic development plan for the City of Schertz; (7) Assist the Schertz Development Foundation in all manner of fund raising activity; -1- (8) Develop and host an Annual Commercial Brokers Open House, when appropriate. (9) May participate on marketing trips, conferences, seminars, related to economic development. Section 3: Appointment, Eligibility, and Membership The Schertz Economic Development Commission will consist of at least seven (7) members. All appointments to the Schertz Economic Development Commission will be made by the City Council of the City of Schertz. Members will be appointed to two year staggered terms. Members may be appointed to succeed themselves. Eligibility requirements are as follows: A resident of the City of Schertz; or a person employed in the City of Schertz. Vacancies will be filled by City Council for the completion of a term of office. Section 4,: Term of Office and Organization The term of office will be a two year period effective 1 January each year. The initial set of appointments will have two terms of office. Half of the members will be appointed for a two year period, and half of the members will be appointed for one year. Each appointment made thereafter will be for a period of two (2) years. The determination of which members will serve the initial term of one year will be made by caucus of the entire appointed body during their initial session. During the first meeting each calendar year, the members of the commission will elect a Chairman and Vice Chairman to officiate at meetings. The commission will determine if additional officers are needed. Section 5: Removal from Office A member may be removed from office for the following reasons: (1) Malfeasance in office, or conviction of any crime. Section 8: Meeting and Quorums Meetings will be conducted on a regular basis. meetings will be at the call of the Chairman. Special A quorum is four appointed members of the Commission. A quorum is required to conduct business. For voting purposes a majority of the quorum is mandatory to have effect. Minutes will be recorded for each meeting by a Recording Secretary, such minutes to be distributed to members and other interested parties. Section 9: Disqualification from Voting A member shall be disqualified from voting if he/she finds the following conditions to exist: (1) A personal or monetary interest exists on the project being discussed. (2) The member will be directly affected, personally or monetarily, by the outcome of the vote. Section 10: Compensation The members of the commission will serve compensation, except for re-imbursement of authorized attendant to the performance of their duties. without expenses Section 11: Committees The Chairman may establish permanent committes, or committes may be established for a specific task. Membership on committes may include individuals who are not on the commission. Only a member of the commission may Chair a committee.
