AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, AUTHORIZING THE CITY
ATTORNEY TO FURNISH A LEGAL DEFENSE TO
MEMBERS OF THE CITY COUNCIL, PLANNING AND
ZONING COMMISSION AND OTHER CITY OFFICIALS.
WHEREAS, a suit numbered SA-86-CA-1118, styled Leon
Parker and Frank Glass dba Pecan Grove Mobile Home Park v. Earl
Sawyer, et al (the "Parker Suit") has been filed and is
presently pending in the United States District Court for the
. Western District of Texas, San Antonio Division; and
WHEREAS, said action seeks relief against the Mayor
and members of the City Council (collectively the "Council")
and certain members of the Planning and Zoning Commission (the
"Commission") in their representative capacities, and also
seeks judgment against said individuals and certain other City
officials, personally; and
WHEREAS, all actions on the part of members of the
City Council, Zoning Commission and other City officials were
done in their official capacity as members of the Council,
Commission and employees of the City and the City Council is of
the opinion that the City should furnish a defense to such
persons in their individual capacity; now, therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS:
SECTION 1: That the City of Schertz shall furnish
legal representation through the City Attorney to each member
of the Council, Commission and other City officials named as
defendants in the Parker Suit in connection with their defense
of such suit, upon their request for such representation.
SECTION 2: That the City Manager is hereby directed
to contact each member of the Council, the Commission and each
City official named as a defendant in the Parker Suit to
determine whether such persons wish the City to furnish such
representation.
PASSED, ADOPTED AND APPROVED on the ~ day of
August, 1986.
