1983T11- LEGALIZING BINGO IN SCHERTZ ORDINANCE NO. ~3- ;-/1 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, LEGALIZING BINGO WITHIN THE CITY OF SCHERTZ, TEXAS, IMPOSING A ONE PERCENT GROSS RECEIPT TAX UPON LEGALIZED BINGO CONDUCTED BY EACH LICENSEE AUTHORIZED TO CONDUCT BINGO WITH THE CITY OF SCHERTZ, TEXAS; REPEALING CONFLICTING ORDINANCES; AND STIPULATING AND EFFECTIVE DATE AND DECLARING AN EMERGENCY. WHEREAS, a petition was duly accepted by the City Council of the City of Schertz, Texas, calling for an election to legalize bingo in the City of Schertz, Texas; and WHEREAS, the City Council did by resolution call for an election to consider the legalization of bingo within the City of Schertz, Texas; and WHEREAS, on the 16th day of January 1982, an election was held in the City of Schertz, Texas, and by a majority vote said citizens did approve the legalization of bingo in the City of Schertz, Texas; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I THAT as authorized by, and in accordance with, the "Bingo Enabling Act" of the State of Texas; and as a result of an election by the citizens of Schertz, Texas, on January 16, 1982, in which by a majority vote the citizens did express their approval to legalize bingo in the City of Schertz, bingo is legalized within the City of Schertz, Texas, and may be conducted in accordance with the "Bingo Enabling Act" of the State of Texas. II THAT as authorized by, and in accordance with, the "Bingo Enabl ing Act" of the State of Texas, the City of .Schertz, Texas does hereby impose a one percent (1%) gross receipts tax upon each and every licensee to conduct bingo in the City of Schertz, Texas, that does on this date or may hereafter ever exist in the City of Schertz, Texas. III THAT all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. IV THAT the public importance of this measure constitutes and creates an urgent public necessity requiring that this ordinance be passed and take effect as an emergency measure; and shall take effect and be in force immediately upon and after its passage. The Mayor put the motion to consider said ordinance as an emergency measure to the members' of the City Council and said motion was approved and adopted by the following vote: AYES: Councilmembers Sharpe, Baldwin Hoover, and Aguilar NAYS: None The Mayor then introduced the hereinafter set forth ordinance as an emergency measure. Thereupon it was moved by Councilmember Baldwin and seconded by Councilmember Hoover that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: AYES: Councilmembers Sharpe, Baldwin, Hoover and Aguilar NAYS: None ~:,;..
