AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS, TRANSFERRING AND
ASSIGNING THE INTEREST OF THE CITY
IN ONE CERTAIN EIGHT (8) INCH WATER
MAIN, EXISTING VALVES AND A THIRTY
(30) FOOT WATER PIPELINE EASEMENT
AND RIGHT OF WAY TO THE CITY OF
UNIVERSAL CITY, TEXAS, AND
DECLARING AN EMERGENCY.
WHEREAS, Alma Ida Schertz obtained a perpetual 30 foot
water line easement and right of way from Herbert Kraft, recorded
by Deed dated May 3, 1950, in Vol. 2833, Page 224 of the Deed
Records of Bexar County, Texas; Sam Schaefer and John A. Lewis,
recorded by deed dated May 3, 1950 in Vol. 2833 of Deed Records
of Bexar County, Texas and Joe Turner recorded by deed dated
May 3, 1950, in Vol. 2833, Page 221 of Deed Records of Bexar
County, Texas; and

WHEREAS, said 30 foot water pipe line easement and right of
way beginning at the location of the water wells owned by the
Schertz Water Works and extending to the common city limit
boundary line between Schertz and Universal City was conveyed
jointly to the cities of Schertz and Universal City at the time
that the Schertz Water Works, Inc., properties were sold to the
City of Schertz, said property to include all property, water
mains and lines,existing valves, fire hydrants, water meters and
hose connections, easements and right of way; and
WHEREAS, said 30 foot water pipe line easement is the location
of an 8 inch water main of approximately 6,000 feet leading from
the water well to the common city limit line between Schertz and
Universal City; and
WHEREAS, saidu8 inch water line is not of sufficient size to
adequately transport a required volume of water from the water
well site into the City of Schertz water system; and
WHEREAS, the City of Schertz has acquired new easement from
the water well site into the City water system, for purposes of
laying a 20 inch water transmission line; and
WHEREAS, this City Council has determined that the aforesaid
Water main and appurtenances and easement and right of way are no
longer required and needed by the City of Schertz but that the
same is needed by the City of Universal City, and the City of
'Schertz now desires to assign and transfer all of its right,
title and interest in said water main and appurtenances and the
said easement and right of way to the City of Universal City;
now, therefore:

BEGINNING at a point N, 60 El,lE" from the east corner
of a 1.01 acre tract ~I l~ha cOnveyed by Herbert Kraft
to Alma Ida Schertz, by deed dated March 14, 1950 of
Record in Vol. 2813, page 3 of the Deed of Records of
Bexar County, Texas, which point is the center line of
a 20 foot right of way conveyed along with said 1.01
acre tract;

3 feet from the northeast line of the Pat Booker
THENCE S 710 37' E parallel to and 3 feet N.E. of the
N.E. line of said Pat Booker Road, 1023.4';
THENCE S 610 55' E to a point on the East line of the
property of the grantor and on the' west line of Universal
City Subdivision second filing;
THENCE N 600 E, 1239' more or less to a point on the
east line of the 47.14 acre Sam H. Schaefer and John A.
Lewis tract;
THENCE N 600 E, 900' more or less;
TH~CE N 730 E, 750' more or less;
TH~~CE N 840 E, 326.3';
THEijCE N 600 E continuing to the center line of the
Cibalo Creek; said line being the common city limit
line. between Schertz and Universal City;

Tog~her with the right of ingress and egress for the
purpose of laying, maintaining and repairing same.

The City of Schertz reserves the right to use such line
at no cost until the new 20" water line is completed, tested
and certified by the City Engineer.

The public importance of this measure constitutes and
creates an urgent public necessity requiring that this ordinance
be passed and take effect as an emergency measure, and shall
take effect and be in force immediately upon and after its
,passage.
