1981S29- AMENDING THE ZONING ORDINANCE 79S15 ORDINANCE NO.-.!lJ - s-?-If. AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE (NO. 79-S-15) OF THE CITY OF SCHERTZ, TEXAS, IN ACCORDANCE WITH ARTICLE XIX, SECTION 2-2.1 WHICH AUTHORIZES THE CITY COUNCIL TO, FROM TIME TO TIME, AMEND, SUPPLE~1ENT, CHANGE, MODIFY, OR REPEAL THE REGULATION STANDARDS AND BOUNDARIES OF THE CITED ORDINANCE, THIS ORDINANCE DOES AMEND ORDINANCE NO. 79-S-15 BY ADDING A NEW PARAGRAPH ENTITLED "HOME OCCUPATIONS" WHICH ESTABLISHES THE REGULATION OF TYPES OF HOME OCCU- PATIONS AUTHORIZED WITHIN THE CITY OF SCHERTZ, TEXAS; AND STIPULATING EMERGENCY ACTION. WHEREAS, the Planning and Zoning Commission has recommended to the Mayor and City Council that the changes made in this ordinance be adopted; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I The Zoning Ordinance of the City of Schertz, Texas, Ordinance No. 79-S-15, is hereby amended to establish the following: "ARTICLE XXIII Administration Section 4. Home Occupation Any occupation or activity which is clearly incidental and secondary to the use of the premises for dwelling purposes and which is carried on wholly within a main building by a member of a family residing on the pre- mises, in connection with which there is no advertising other than an identification sign of not more than one (1) square foot in area placed flat against the building, and no other display or storage of materials or generation of substantial volume of vehicular or pedestrian traffic or parking demand or other exterior indication of the home occupation or variation from the residential character of the building; and in connection with which no person outside the family is employed and no equipment used which creates noise, vibration, smoke, dust, odors, heat or glare, any of which is offensive to persons of ordinary sensibility in the neighborhood. When, within the above requirements, a home occupation includes the following: (a) Art Studio; (b) Dressmaking; (c) professional office of a lawyer, engineer, architect, accountant, salesman, real estate agent, insurance agent; (d) teaching with musical instruction limited to one or two pupils at a time; however, a home occupation shall not be interpreted to include barber shops, beauty parlors, restaurants, or the conduct of business involving retail sales, but it intended to include only those personal services which are subor- dinate to the use of the premises as a dwelling," Ii The public importance of this measure constitutes and creates an urgent public necessity requiring that this ordinance be passed 'and take . effect as an emergency measure, and shall take effect and be in force immediately upon and after its passage. Stomackin, Sr. MAYOR Richard L. Howe COUNCILMEMBER Barbara Taylor COUNCILMEMBER Jeff Duffield COUNCILMEMBER Earl W. Sawyer COUNCILMEMBER Jacqueline Lawler COUNCILMEMBER ABSENT AND June G. Krause CITY SECRETARY Jimmy G. Gilmore CITY MANAGER There being a quorum present, the meeting was called to order by the Mayor; and, among other proceedings had were the following: The Mayor introduced the following captioned ordinance which was read in full by the Mayor, Council member Sawyer moved that said ordinance be considered by the Council as an emergency measure, which motion was seconded by Councilmember Mr. Howe Whereupon said motion was fully discussed and considered. The Mayor put the motion to consider said ordinance as an emergency measure to the members of the City Council and said motion was approved and adopted by the following vote: AYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler NAYS: None The Mayor then introduced the hereinafter set forth ordinance as an emergency measure. Thereupon it was moved by Council member <;i1"\y'ilr and seconded by Councilmember Howe that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: AYES: Council members Howe, 'Taylor; Duffield;'Sawyer and Law'ler NAYS: none I
