1981S23- AMENDING THE ZONING ORDINANCE 79S15 ORDINANCE NO. 'i!/- S -~3 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE (ORDINANCE NO. 79-S-15) OF THE CITY OF SCHERTZ, TEXAS, IN ACCORDANCE WITH ARTICLE XIX, SECTION 2- 2.1 OF ORDINANCE NO. 79-S-15 WHICH AUTHORIZES THE CITY COUNCIL TO, FROM TIME TO TIME, AMEND, SUPPLEMENT, CHANGE, MODIFY, OR REPEAL THE REGULATION STANDARDS AND BOUNDARIES OF THE CITED ORDINANCE. WHEREAS, the City Council of the City of Schertz, Texas, wishes to comply with Article XIX, Section 2, 2,1 of cited ordinance which requires the Planning and Zoning Commission to review the Zoning Ordinance at least every three years and make recommendations to the Mayor and City Council that appropriate amendments be made; and WHEREAS, the Planning and Zoning Commission has recommended to the Mayor and City Council that the changes made in this ordinance be adopted; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT, the Zoning Ordinance of the City of Schertz, Texas, Ordinance No. 79-S-15, is hereby amended as follows: A. ARTICLE II DISTRICTS, DISTRICT BOUNDARIES, OFFICIAL ZONING MAP, NEW AND UNSCHEDULED USES, AND COMPLIANCE REQUIRED Section 1 Di stricts The City of Schertz is hereby divided into types of districts as follows: PO Pre-Development District R-l Single Family Dwelling District R-2 Single Family Dwelling District R-3 Two Family Dwelling District R-4 Apartment/multi-family Dwelling District R-5A Garden Home District-Zero lot line Construction R-5B Garden Home District-Conventional or Traditional Construction MH Mobile Home District OP Office and Professional District NS Neighborhood Service District GB General Business District M-l Industrial District-Performance Standard Group A M-2 Industrial District-Performance Standard Group B S Specific Use Permit PRUD Planned Residential Unit Development District B. ARTICLE X MOBILE HOME DISTRICT Section 1 Use Regulations: A building or premise shall be used only for the following purposes: See Schedule of Uses and Article II, Section 4, "New and Unscheduled Uses". Also see Mobile Home Ordinance No. 81-S-2, and Flood Plain Management Ordinance No. 77-M-9. C. ARTICLE XV Section 1 D. ARTICLE XIX Section 2 2.2.2 E. ARTICLE XIX Section 4 4.3 INDUSTRIAL DISTRICT PERFORMANCE STANDARD GROUP B, M-2 Use Regulations: Any manufacturing, industrial servicing or storage process not prohibited by law and upon approval by the City Council in accordance with the Specific Use Permit procedure established in Article XX, Section 5. A building or premise shall be used only for the following purposes: See Schedule of Uses and Article II, Section 4, "New and Unscheduled Uses". AMENDMENTS Changes and Amendments Petitions shall be reviewed by the Planning and Zoning Commission at its regularly scheduled meeting. The petition shall appear on the agenda that has been published and distributed to them not less than three (3) days prior to such meeting. The application or petition may be recommended for a public zoning hearing by the majority of the Planning and Zoning Commission, if the following conditions are met: 1. The requested change is in keeping with the comprehensive plan adopted by the City Council. 2. There has been environmental and/or economical changes which warrants a change since its original zoning. 3. Granting of the request would not create an incompatible use different from the surrounding property, or show favor to the property under consideration for rezoning. (Spot Zoning) 4. There is an error in the original zoning of the property for which a change is requested. The applicant shall be advised in writing by an appropriate City Staff member of action taken on the petition. Public Notice and Procedures for Amendments: Notice of any public hearing involving the Zoning Ordinance and District Map will be given by publi- cation once in a newspaper of general circulation in the City, and designated as the official publi- cation of the City, stating briefly the change or amendment to be considered at the hearing and the time and place of such hearing which shall be at least fifteen (15) days prior to the public hearing. Such notice shall be sent to the property owners as determined from the most recently approved City tax roll of real property lying within two hundred (200) feet of the property on which the change in classi- fication or specific use permit is proposed. Such notice shall be given not less than ten (10) days before the date set for the hearing. The notice shall be made by depositing the same, properly addressed and postage paid, in the United States Post Office. F. ARTICLE XIX Section 4.6 Added paragraph A denial recommendation shall include specific reason for the denial. The Planning and Zoning Commission may also recommend the rezoning be effective contingent upon the development starting within twelve (12) months of the Councils approval. In the event development has not started within the twelve (12) months, the petitioner for the rezoning will be notified in writing that the land will revert to its original zoning within thirty (30) days. Extension may be granted for legiti- mate delays. G. ARTICLE XIX Section 4.7 Second paragraph In cases when the Planning and Zoning Commission's recommendation against proposed specific use permit or amendment, supplement, change, or repeal of the regulations or restrictions of the Zoning Ordinance or the boundaries of the District Map herein established, or when a written protest against an amendment under consideration is filed with the office of the City Secretary and signed by the owners of twenty percent (20%) or more either of the area of the lots included in such proposed change or those immediately adjoining the same and extending two hundred (200) feet therefrom such amendment, supplement, change, modification or repeal shall not become effective except by the favorable vote of three-fourths (3/4) of the members of the City Council. H. ARTICLE XX SPECIFIC USE PERMITS Section 1.1 Authorized Uses: The City Council of the City of Schertz, Texas, after public hearing and proper notice to all parties affected, in accordance with the notice procedures prescribed under Article XIX for amending the Zoning Ordinance, and after recommend- ation by the Planning and Zoning Commission, may auth- orize the issuance of Specific Use Permits for zoning specific uses set forth in the Schedule of Uses, Apendix A, when situated within the Zoning Districts identified within the schedule. I. SCHEDULE OF USES - APPENDIX A is amended to reflect the following: 1. Heading for R-3, as reflected on each page of Appendix A, is revised to reflect "Two Family Dwell ing District." 2. The following symbols, or lack of symbols, are established for identification purposes as applying to Appendix A: o o m Designated use permitted in district so marked. (Lack of symbol) Designated use prohibited in district. Designates that use may be approved in the district so marked in compliance with the Specific Use Permit provisions established under Article XX. 3, All symbols reflected for PO, Pre-development District, are deleted from Appendix A. All future development within a PO, Pre-Development District, will be established according to a Specific Use Permit. 4, The following changes are made to the Schedule of Uses, Symbol Column: a. Page 44, 45, 46, 47, 48, 50 and 52, as makes reference to "Section 2.1.1", is amended to read "Article II, Section 4". b. Page 44, reference to "Section 2.1.2" is amended to read "Article VIII". c. Page 44, reference to "Section 2.1.3, is amended to read, "Article XXI; Section 1,1.1,1.2". d. Page 44" reference to "Section 2.1.4" is amended to read, "Article X, Section 1 to 3.2". e. Page 52, reference to "Section 2.1.5" is amended to read, "Articl e XIV, Section 1, 2, 3". f. Page 52, reference to "Section 2.1.6" is amended to read, "Article XV, Section 1, 2". g. Page 45, reference to "Section 2.3.3" is amended to read, "Article XX, Section 1.3". h.
