AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PRESCRIBING 1\ f 6- " Hr n f)j
FOR WATER AND SEWER SYSTEM EXTENSIONS AND SERVICE LINE
INSTALLATIONS:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
That the City of Schertz, Texas, may contract with applicants for
water and sewer system extension and service line extensions ..",'_u LL_
upon the followi~g conditions:
1. That such applicants agree to make all necessary installations
of such sewer and water system extensions and service line installations
at their own cost.
2. That such extensions and installations shall be in accordance with
plans and specifications approved by the City Engineer of the City of
Schertz, Texas.
3. That the City of Schertz, Texas, will from the date of installa-
tion of such extensions remit annually to the applicant 25% of the profit
accruing from revenue received for water and sewer service furnished
through such extensions. Such revenues shall not include cost of meter
connections or tapping fees. The determination of such profit to ,be made
by the bookkeeping and accounting department of the City of Schertz, Texas,
in accordance with the standard bookkeeping and accounting procedures
employed by such departments of the City of Schertz, Texas, at the time
such revenues are received. No refunds will be made for the cost of
service lines installed to serve customers from such water and sewer line
extensions and no refunds shall be made by the City of Schertz, Texas, to
customers for water and sewer connections. Under no conditions shall the
City of Schertz, Texas, refund such profits to such applicants for a period
in excess of seven (7) consecutive years after the commencement of such
service. Under no condition shall the refund to such applicants, exceed
50% of the cost of the water and sewer system extension installed by such
applicant. Any such applicant for water and sewer extension shall furnish
the City of Schertz, Texas a bond, guaranteeing all material, labor and
workmanship in connection herewith, approved by the city of Schertz, Texas,
,guarranteeing same for a period of 1 year. Such bond shall be in such form
and written in such manner as approved by the City of Schertz, Texas, and

shall indemnify and be payable to the City of Schertz, Texas.
4. All such water and sewer line extensions installed by any
applicant shall become upon completion and acceptance by the City of
Schertz, Texas, unconditionally the property of the City of Schertz,
Texas.
All Ordinances and parts of Ordinances in conflict herewith are
herewith expressly repealed.
