ORDINANCE NO. 164 . . ORDINANCE NO. I &. 4- AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING RULES AND STANDARDS FOR THE COLLECTORS OF RECEPTACLES OR CONTAINERS OF GARBAGE IN THE CITY OF SCHERTZ, TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION I. All collectors of garbage shall not operate vehicles in any of the alleys, of the city of Schertz, Texas, except in designated commercial districts for the collection of garbage. SECTION 2. Every owner, occupant, tenant or lessee using or occuping any building or structure within the corporate limits of the city; for residence; church; school; college; lodge; commercial, business or other purposes shall provide and maintain metal garbage and trash containers of sufficient number to hold the garba,ge and 1rash that will normally accumulate on the premises. Such containers shall be of not less than five (5) gallons capacity and not more than thirty (30) gallons capacity, constructed of galvanized iron, tin or other suitable metal, with a tight fitting lid or cover. The container must not have any inSide structures, such as inside bands or reinforcing angles, or anything within the container to prevent the free discharge of the contents. Cover for containers shall fit securely so as to prevent unnecessary odors. G~~ss, leaves and branches need not be placed in metal containers. SECTION 3. The lids or covers of all garbage and trash containers shall at all times be kept secure and fastened so that flies and other insects may not have access to the contents thereof. Such lids or covers shall only be removed while the containers or receptacles are being filled or emptied, as the case may be. SECTION 4. Any person, firm, or corporation violating any provision of this ordinance shall be guilty of a, misdemeanor and shall be fined not more than $50.00 for each violation thereof. Ea.ch day that any of the provisions of this ordinance are violated shall be deemed a separate offense. . . . ; SECTION 5. This ordinance repeals Ordinance No. 112 of the City of Schertz, Texas, and all ordinances and parts of ordinances in conflict herewith are herewith repealed.
