AN ORDINANCE
PROVIDING FOR THE APPROVAL OF THE AGREEMENT DATED

CONSTRUCTION, EXISTENCE, USE, OPERATION AND r~IN-
TENANCE OF HIGHWAY SIGNAL PROJECT(S) AT THE LOCA-
TION(S) SHOWN ON EXHIBIT 1, ATTACHED HERETO AND
MADE A PART HEREOF, IN THE CITY OF SCHERTZ; PRO-
VIDING FOR THE EXECUTION OF SAID AGREEMENT
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:

between the State of Texas and the City of Schert , Texas, for the
installation, construction, existence, use, operation, and maintenance
of certain hgihway traffic signal(s) at the location(s) shown on
Exhibit 1, attached hereto and made a part hereof, in the City of
Schertz, Texas, be and the same is hereby approved, and Mayor Robert
C. Bueker is hereby authorized to execute said agreement on behalf of
the City of Schertz, Texas, and to transmit the same to the State of
Texas for appropriate action.
SECTION 2. The fact that the improvements contemplated under the above
mentioned agreement are needed, creates an emergency which for the
immediate preservation of the public peace, health, safety, and general
welfare requires that this Ordinance take effect immediately from and
after its passage, and it is accordingly so ordained.

On this, the 17th day of August, 1976, at 7:00 o'clock
P.M., the City Council of the City of Schertz, Texas, convened at a
regular meeting at the regular meeting place in the Municipal Building
in the City of Schertz, Texas, pursuant to due call and notice to all
of the members of said City Council, which meeting was at all times open
to the public, and at which meeting the following members were present,
to-wit :

There being a quorum present, the meeting was called to
order by the Mayor, and, among other proceedings had were the following;
The Mayor introduced the hereinafter set forth ordinance
which has been read and considered at the last regular meeting of the
City Council on the 3rd day of August, 1976. It was determined that the
City Secretary had caused a short synopsis of said proposed ordinance to
be published in official City newspaper after its consideration at the
last regular meeting of the City Council and prior to this meeting.
Whereupon said ordinance was discussed and further considered
by the Council.

that said ordinance be finally passed and adopted. The Mayor put the motion
to a vote of the members of the City Council and the ordinance was finally
passed and adopted by the following vote:

WHEREAS, by virtue of a Municipal Maintenance Agreement entered into by the
City and the State, the State has been authorized to maintain certain highway routes
within the City; and
WHEREAS, from time to time the City has requested the State to install traffic
signals on certain highways within the City; and
WHEREAS, the State under the provisions of Minute Order 70179, dated July 31,
1975, has authority to install, maintain and operate traffic signals when requested
to do so in cities of 15,000 population or less according to the latest Feceral
Census; and
WHEREAS, the City has a population of less than 15,000 according to the
1970 Federal Census.

NOW, therefore, in consideration of the premises and of the mutual cov~nants
and agreements of the parties hereto to be by them respectively kept and performed,
as hereinafter set forth, it is agreed as follows:

1. This Agreement shall apply to. all ~ighway traffic signal installations
approved by both the State and the City, the City's approval being indicated by
signature of the

on the plan
title sheet for such installation. Highway traffic signal installations made a
part of this Agreement shall contain on the title sheet the following statement:
"The City hereby consents to the construction of this
highway traffic signal as to location and manner of

2. The State will furnish the necessary funds for the. actual construction,
prepare plans and specifications, install said highway traffic signa1(s), supervise
construction, and upon completion of construction, will furnish the power and operate
and maintain said highway traffic signa1(s).
3. The City hereby consents to the construction of the highway traffic
signal(s) by the approval of the location and manner of construction as shown on
plans and described in specifications.
4. The City will exercise no control whatsoever over the operation, mainte-
nance, use or existence of ~he highway traffic signal(s) without written authority
from the State Department of Highways and Public Transportation.
5. The State shall have the authurity to make such changes in the design
and operation of the highway traffic signa1(s) as it l!lay deen necessary and advisable
to promote the safe, convenient, and orderlj movement of traffic.
6. The City will be responsible for th~ police enforcement required for
securing obedience to the highway traffic signal(s).

7. In the event the Lerms of this Agreement are in conE lict with 'the

and/or Contracts.
