ORDINANCE NO. 76-E-1 THE STATE OF TEXAS ~ COUNTIES OF GUADALUPE, BEXAR ~ AND COMAL ~ CITY OF SCHERTZ ~ On this, the 17th day of February, 1976, at 7:00 o'clock P.M., the City Council of the City of Schertz, Texas, convened at a regular meeting at the regular meeting place in the Municipal Building in the City of Schertz, Texas, pursuant to due call and notice to all of the members of said City Council, which meeting was at all times open to the public, and at which meeting the following members were present, to-wit: ROBERT C. ARNOLD MAYOR COUNCILWOMAN COUNCILMAN COUNCILMAN COUNCILMAN COUNCILWOMAN AND CITY SECRETARY CITY MANAGER There being a quorum present, the meeting was called to order by the Mayor, and among other proceedings had were the following: The Mayor introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 3rd day of February, 1976. It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council . Thereupon it was moved and seconded by Councilmember by Councilmember ~A-~ ~ . The Mayor put the motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: AYES: All councilmembers present voted "AYE" NAYS: None I -;;tF-7&-E-1 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CALLING AN ELECTION TO BE HELD ON APRIL 3, 1976, FOR THE PURPOSE OF ELECTING THE MAYOR AND TWO (2) COUNCILMEN * * * * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I That an election be held in and throughout the City of Schertz, Texas, for the purpose of electing a Mayor and two (2) councilmen for said City to serve for a term of two years. The Councilmen are to be elected for Positions Nos. I and 2, respec- tively. II That at said election the candidate receiving the most votes for Mayor shall be declared elected; and the candidates receiving the highest number of votes for Position No. I and Posi- tion No.2, respectively, shall be declared elected. Any candidate desiring to have his or her pame on the official ballot of said election, shall at least thirty (30) days prior to said election day, file with the Mayor an application in writing in the form prescribed by the Texas Election Code requesting that his or her name be placed on the official ballot and designating whether he or she is running as a candidate for Mayor or councilman, and if for councilnan, such person shall declare as a candidate for Position No.1 or Position No.2. That any person failing to file said written application for candidacy by the time aforesaid, shall not be entitled to have his or her name printed on the official ballot. That the nanes of all eligible candidates whose appli- cations have been duly and timely filed shall be placed on the ballot pursuant to a drawing as provided by law. " III That all qualified voters of said City shall be entitled to vote in said election. IV That the polling place for the holding of said election shall be at the Fire Station, 604 Live Oak Road, Schertz, Texas; and the entire City of Schertz, Texas, for the purpose of holding said election shall be and constitute one municipal election pre- cinct. :)ANe,)'t,;;e. kVFtp,'L is hereby appointed Presiding fit! A1 R- ore ft tV C 0 L L I ~<) Judge pf said election, and is hereby appointed Alternate Presiding Judge of said election. V That the Presiding Judge of said election shall appoint as many resident qualified electors of said city to serve as clerks in said election as shall be reasonably necessary to conduct said election, with the appointment of such clerks to include the Alternate Presiding Judge if he be present for the holding of said election. The Presiding Judge shall appoint a person fluent in the Spanish language to serve as clerk of said election to render oral aid in the Spanish language to any voter desiring such aid at the poll on the day of said election. In the absence of the Presiding Judge above named, the Alternate Presiding Judge shall perform the duties of the Presiding Judge of said election. VI That absentee voting in said election shall be conducted at the City Ha~l, 100 First Street (corner of Main Street and First Street), Schertz, Texas, ,and the City Secretary is hereby charged with the duty of conducting absentee voting in said election, as required by law. The City Secretary shall appoint a Deputy Absen- tee Voting Clerk who is fluent in the Spanish language to render oral aid to any voter desiring to vote absentee in said election who requests such aid. That with the exception of Saturdays, Sundays and of- ficial State holidays, the City Hall shall remain open fron 8:00 o'clock a.m. to 4:00 olclock p.m. for the purpose of conducting absentee voting for said election. VII That the polls for said election on the day of said election shall be open from 7:00 olclock a.D. to 7:00 o'clock p.m. VIII That the ballots to be used in said election shall be prepared in conformity with V.A.T.C.S. Election Code, as amended. That in the holding and conducting of said election, voter forms, instructions and other materials required therefor, including the ballots, shall be in both the English and Spanish languages. IX That a copy of this ordinance designated as a notice shall serve as proper notice of said election. .Notice of said election shall be given in accordance with the provisions of Article 4.05, Texas Election Code. x That the City Secretary is hereby authorized and directed to post notice of said election, in both the English and Spanish languages, on a bulletin board at the City Hall of said City, at the Fire Station (the polling place for the holding of said elec- tion), and at one other public place within said City, all of which notices shall be posted at least twnety (20) days prior to the date set for said election. XI That the City Secretary is further authorized and direc- ted to cause notice of said election to be published, in both the English and Spanish languages, one time not more than twenty- five (25) days nor less than ten (10) days prior to the date set for said election, in a newspaper published and of general circu- ... ~ " I"" lation in the City of Schertz, Texas.
