ORDINANCE NO. 73-D-3 , f '73-.D-3 ::::f/)()J AN ORDINANCE a. 0 Of MAKING IT UNLAWFUL FOR ANY DRIVER OF A MOTOR VEHICLE TO CAUSE THE WHEELS OF SAID VEHICLE TO SPIN AGAINST THE STREETS OF THE CITY OF SCHERTZ, TEXAS; DECLARING A VIOLA- TION OF THE PROVISIONS OF THIS ORDINANCE A MISDEr:IEANOR AND PROVIDING FOR PUNISHMENT UPON CONVICTION OF A FINE NOT TO EXCEED $200; PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE; AND ENACTING OTHER PROVISIONS INCIDENT AND RE- LATING 'I'O THE SUBJECT. ******************************************** ~1EREAS, in order to protect the residents of the City of Schertz, Texas, from injuries caused by reckless drivers of motor vehicles, the City Council of the City of Schertz, Texas, finds that it is necessary to enact the following ordinance regulating the driving of motor vehicles in said City; NOW, THEREFORE, BE IT ORDAINED BY THE CI'l'Y COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION I This ordinance shall be known as and may be cited as the "Spinning Wheels Ordinance of the City of Schertz." SECTION II It shall be unlawful for the driver of any motor vehicle being driven upon a public street in the City of Schertz, Texas, to accelerate said vehicle in such a fashion as to cause one or more of the wheels of said vehicle to spin against the surface of the street and thereby leave markings thereon. SECTION III Police officers, ambulance drivers, drivers of fire trucks and other emergency vehicles, and drivers acting under a sudden emergency are exempt from the operation of this ordinance. . . . . . SECTION IV Any person who shall violate any of the provisions of this ordinance shall be deemed to be guilty of a misdemeanor and shall, upon conviction, be punished by a fine not to exceed $200. Each separate violation of this ordinance shall constitute a separate offense. SECTION V The City Secretary is hereby directed to have this ordi- nance published in one issue of the The Valley News , the official newspaper of the City of Schertz, Texas, by either (1) publishing this entire ordinance, or by (2) publishing a descriptive caption or title, stating in summary the purpose of this ordinance and the penalty for violation thereof.
