2002M09-BIDS FOR PURCHASE & SAL ORDINANCE NO. ~2 -/)7- ~ AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ AMENDING THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS, CHAPTER2, ADMINISTRATION, ARTICLE 1, IN GENERAL, SECTION2-8, COMPETITIVE BIDS FOR PURCHASES AND SALES; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. WHEREAS, Section 2-8 of the Code of Ordinances of the City of Schertz (the "Code of Ordinances") provides for certain procedures with respect to certain purchases and sales by the City as more fully described in such Section; and WHEREAS, Section 7.08 of the City Charter provides that the City Manager shall be responsible for the preparation of purchase procedures which he shall submit to the City Council for approval; and WHEREAS, general Texas law provides purchasing and sales procedures available to the City; and WHEREAS, pursuant to Section7.08 of the City Charter, the City Manager has recommended that Section 2-8 of the Code of Ordinances be amended to provide that the City will comply with general Texas laws with respect to purchases and sales, as such laws may be in effect from time to time; and WHEREAS, it is in the best interests of the citizens of the City that the City Council authorize the matters set forth in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: Section 1. Amendment of Section 2-8 of Code of Ordinances. Section 2-8 of the Code of Ordinances is hereby amended to read as follows: "Sec. 2-8. Competitive bids and competitive proposals for purchases and sales. All purchases, except as described in Section 2-9, and all sales shall be made in accordance with Texas statutes in effect from time to time with respect to competitive bidding and competitive proposals, the notice and award process relating thereto, and exceptions, exemptions, and alternative procedures." Section 2. Effect of Headings. The Section headings herein are for convenience only and shall not affect the construction hereof. 20032924.1 Section 3. Inconsistent Provisions. All ordinances and resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Ordinance are hereby repealed to the extent of such conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters ordained herein. Section 4. Governing Law. This Ordinance shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. Severability. If any provision of this Ordinance or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Ordinance and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Ordinance would have been enacted without such invalid provision. Section 6. Construction of Terms. If appropriate in the context of this Ordinance, words of the singular number shall be considered to include the plural, words of the plural number shall be considered to include the singular, and words of the masculine, feminine, or neuter gender shall be considered to include the other genders. Section 7. Incorporation of Preamble Recitals. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a part of the judgment and fmdings of the City Council of the City. Section 8. Public Meeting. It is officially found, determined, and declared that the meeting at which this Ordinance is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Ordinance, was given, all as required by Chapter 551, as amended, Texas Government Code. Section9. Effective Date; Emergency. The fact that the City's purchasing procedures require prompt modification creates an emergency requiring immediate action and requires that this Ordinance shall become effective fi.om and at~er the date of its passage in a single reading following the aff'n'mative vote of not less than two-thirds of the councilmembers present at the meeting at which this Ordinance is first introduced, all as provided by the Charter of the City of Schertz.
