81-C-31 (i'/-(!;- 31 ORDINANCE NO. AN ORDINANCE ADOPTING THE STANDARD HOUSING CODE, 1979 EDITION, WITH 1980 AND 1981 REVISIONS AS THE HOUSING CODE OF THE CITY OF SCHERTZ, TEXAS AND PROVIDING A PENALTY. WHEREAS, within the area of jurisdiction of the City of Schertz, Texas, there are or may be dwellings, dwelling units and accessory structures which are unfit for human habitation and use due to inadequate maintenance, obsolescence or abandonment; contain- ing defects which increase the hazards of fire, accident, or other calamities, and which by reason of the lack of maintenance, inade- quate ventilation, light and sanitary facilities or other conditions render such dwellings and accessory structures unsafe, unsanitary and dangerous or detrimental to the health, safety, morals, and general welfare of the community; and, WHEREAS, experience and accepted national housing surveys have clearly demonstrated that such conditions result in a large measure from improper maintenance, inadequate sanitary facilities, overcrowded conditions in residential occupancies, buildings and premises and from general neighborhood neglect; and, WHEREAS, it has now become common knowledge that these conditions can be relieved, in a measure prevented and often elimi- nated through planned and properly enforced minimum housing standards, resulting thereby in the upgrading of living conditions and an over- all enhancement of the general health, safety, and welfare of all residents and property owners of the community; and, WHEREAS, the Sourthen Building Code Congress, a non-profit association, has developed and made available a set of minimum housing standards which have been recognized as being acceptable as a model housing code; and, WHEREAS, Chapter 21, Section 8 of Vernon's Civil Statutes of the State of Texas provides that such model codes may be adopted by reference; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION I The Standard Housing Code, 1979 Edition with 1980 and 1981 revisions, to include all future editions, revisions, amendments and corrections,pub1ished by the Southern Building Code Congress International, Inc., save and ex- cept such portions as may hereinafter be amended, two (2) copies of which are on file with the City Secretary, and the same are hereby adopted and incorporated as fully as if set forth at length herein, and from the date on which this ordinance shall take effect. The provisions therein shall be controlling in the use, maintenance and occupancy of all dwellings, dwelling units and/or structures within the City of Schertz, Texas. SECTION II Any person, parties in interest or corporation who shall violate any of the provisions of this code or fail to comply therewith or with any of the requirements thereof shall be subject to misdemeanor prosecution and upon conviction shall be punished by a fine not exceeding two hundred dollars ($200.00), and each day that such violation shall be permitted to exist or continue shall constitute a separate offense. SECTION III Every section of this ordinance and every provision of each section is hereby declared to be an individual section or provision and the holding of any section or provision of any section to be void, ineffective or unconstitutional for any cause whatsoever, shall not be deemed to effect any other section or provision thereof. SECTION IV This ordinance repeals Ordinance Number 74-C-17. The pool shall be completely filled with water and in operation before final inspection. All swimming pools shall be completely enclosed by a fence at least four (4) feet in height or a screen enclosure. Openings in the fence shall not permit the passage of a sphere six (6) inches in diameter. It is suggested that cities, counties, states and other governmental entities maintain their Standard Swimming Pool Code up.to-date by ~eferenee to the identifying cover sheet and contents of this pamphlet. 8
