85-H-16 REGULATING ANIMALS , , - , ORDINANCE NO. ;?6"""'-- fj -It, AN ORDINANCE AN ORDINANCE REGULATING THE KEEPING OF LIVESTOCK, FOWL, CATS, DOGS, WILD ANIMALS, AND VICIOUS ANIMALS WITHIN THE LIMITS OF THE CITY OF SCHERTZ; PRESCRIBING SANITARY CONDITIONS OF PENS AND ENCLOSURES; PRESCRIBING LIMITS IN DISTANCE FROM LIVING, DINING, OR SLEEPING STRUCTURES; PROVIDING FOR ANIMAL CONTROL OFFICERS, LICENSING, VACCINATING AND IMPOUNDING OF DOGS AND CATS; PROVINDING ANNUAL OCCUPATIONAL PERMITS; PROVIDING IMPOUNDING AND SELLING OF LIVESTOCK RUNNING AT LARGE; PROVIDING A SAVING CLAUSE; PROVIDING PENALTY AND REPEALING CERTAIN ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT. HEREWITH EXCEPT THOSE PROVISIONS IN THE ZONING ORDINANCE WHICH REGULATES THE KEEPING OF LIVESTOCK, FOWL, DOGS, AND CATS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ: ARTICLE 1- Definitions AS used in this ordinance the following terms mean: Animal: Any live or dead vertebrate creature, warm or cold blooded, domestic or wild; Animal Control Facility: any facility operated by the City of Schertz, or its authorized agents for the purpose of impounding, quarantining, or caring of animals held under the authority of this ordinance~ Animal Control Officer: person designated and duly sworn by the City of Schertz as a law enforcement officer who is qualified to perform such duties under the laws of this City and/or this State; Auctions: place or facility where animals are bought, sold or traded except for those facilities defined in this ordinance. This term does not individual sales of animals by private owners; regularly otherwise apply to Cat: any live or dead Felix Catus; Circus: commercial variety show featuring animal acts for public entertainment~ Dog: any live or dead Canis Familiaris; Domestic Animal: tame, domesticated, of or pertaining to the family or household; Fowl: Gallus) ~ A bird of any kind~ domestic cock or hen (Gallus Grooming Shop: commercial establishment where animals are bathed, clipped, plucked or otherwise groomed; Kennel: Any premise wherein any person engages in the business of boarding, breeding, buying, letting for hire, training for a fee, or selling dogs and cats, and/or a facility for keeping more than three (3) animals of the same species; Livestock: Domestic animals used or raised on a farm, especially those kept for profit; Owner: person keeping or harboring one or more animals. An animal shall be deemed to be harbored if it is fed or sheltered for three consecutive days or more~ Performing Animal Exhibitions: spectacle, display, act or event other than circuses in which animals are used; Person: subdivision, association, individual, corporation, government or or agency, business trust, estate, or any other legal entity; governmental partnership, Pet: animal kept for pleasure rather than utility; Pet Shop: person, partnership or corporation whether operated separately or in connection with another business enterprise, except for a licensed kennel, that buys, sells or boards any species of animals~ Public Nuisance: animal or animals which: 1. molest passersby or passing vehicles 2. attack, or attempt to attack other animals 3. trespass 4. repeatedly at large (stray) 5. damage private or public property 6. bark, whine, or howl in an excessive, continuous or untimely fashion 2 Quarantine: cage, isolation manner approved strict confinement under restraint by closed kennel, rabies chamber, padlock or in any other in a rule of board of animals specified; Rabies: an acute viral disease of man and animal affecting the central nervous system and usually transmitted by an animal bite or saliva (hydrophobia); Restraint: animal secured by a leash or lead, or under the control of a responsible person and obedient to that person's verbal commands or within the real property limits of its owner; Riding School or Stable: place which has available for hire, boarding and/or riding instructions any horse, pony, donkey, mule or burro; Stray: animal running free or at large, with no physical or verbal restraint; Veterinary Hospital: a licensed veterinarian diseases and injuries of establishment maintained and operated for surgery, diagnosis and treatment animals~ by of Vicious Animal: animal or animals that constitute or are physical threats to human beings or other animals; Wild Animal: live monkey (non-human primate), raccoon, skunk, armadillo, fox, poisonous snake, leopard, panther, tiger, lion, lynx or any other warm or cold blooded animal which can normally be found in the wild state~ Wild State: living in its original, natural condition; not domesticated, tame, regardless of state or duration of captivity; Zoological Park: facility other than pet shops or kennels displaying or exhibiting one or more species of non-domesticated animals operated by a person, partnership, corporation or government agency~ ARTICLE 11- General provisions Section I Animal Control Officer: That there shall be appointed an Animal Control Officer(s) whose duty it will be to gather up and impound or quarantine any livestock, fowl, cats, dogs, or other domestic and non-domestic animals found running at large (stray) within the City limits; and to enforce all provisions of this ordinance. 3 I, The Animal Control Officer is hereby designated as the Health Authority for the purpose of this ordinance. Section II Reports: It shall be the duty of the Animal Control Officer to report in writing monthly the total number of animals impounded and/or quarantined, the total number of animals redeemed or sold to private parties, the total number of animals humanely disposed of under the provisions of this ordinance, the animal population as of the last work day of the month at the Animal Control Facility. Section III Fee Deposits: It shall be the duty of the Animal Control Officer to payor cause to be paid all monies collected by him/her under the terms of this ordinance to the City of Schertz. Section IV Limiting the number of Domestic Animals: l. It shall be a violation of this ordinance for any person to possess, own or otherwise keep more than three (3) animals of the same species in any developed residentially zoned section or area of the City of Schertz, except in cases of newly born or hatched litters or clutches under the age of three (3) months old. 2. This section shall not apply to commercial kennels, veterinary establishments or animal hospitals operated by a licensed veterinarian, or Pet Shops and Grooming Shops located on property zoned for such purposes. Such establishments, however, must meet sanitation requirements and keep animals securely caged or penned. 3. This section shall not apply to any person keeping or harboring animals in a cage, yard, lot, other fenced or enclosed boundry the extreme perimeter of which will not be closer than one thousand (IOOO) feet from any house, home, apartment or domicile of any person(s). Section V Abattoirs and packing houses and stock yards: That the provisions of this ordinance shall not be construed to prohibit any person engaged in operating any abattoir, packing house or stock yard from keeping livestock for a reasonable length of time awaiting their use in connection with the operation of such abattoir, packing house or stock yard which had been zoned for such use. 4 ARTICLE III Licensing/Permits Section I Licensing Procedures: I. Any person owning, keeping, harboring or having custody of any animal over three months of age within this municipality must obtain a license as herein provided. This provision may not apply to the keeping of small caged birds, aquatic and amphibian animals or certain reptiles solely as pets, or livestock when in the enviorment of a farm located within an undeveloped residentially zoned section. 2. Written application for licenses shall be made to the Animal Control Officer which shall include: Name, address of applicant, name of animal, description of the animal, a rabies certificate issued by a licensed Veterinarian or anti-rabies clinic and the appropriate licensing fee. License fees may not be required for seeing eye dogs or governmental police dogs, however other requirements of other sub-paragraphs under this article shall remain in force. 3. The licensing period shall begin with the fiscal year, (October), annually. Applications for license may be made thirty days prior to and up to sixty days after the start of each fiscal year. In addition, an application for a license must be made within thirty days after obtaining a dog or cat over three months, except that this requirement will not apply to a non- resident keeping a dog or cat within the municipality for no longer than ninety days. Persons applying for a license after one hundred twenty days (May) application period shall be required to pay 50% of the fee stipulated in Article XI. Section II License acceptance and use: Upon acceptance of the license application and fee the Animal Control Officer shall issue a durable tag stamped with an identifying number and the year of issuance. Tags will be designed so that they may be conveniently fastened or riveted to the animals collar or harness. Dogs and cats must wear identification tags or collars at all times when off the premises of the owners. It shall be the duty of the owner of any animal to procure a duplicate tag from the Animal Control Officer in the event that the original tag is lost or destroyed. There will be a fee of 50% of fee charged in Article XI for each replacement tag. No person may use any license for any animal other than the animal for which it was issued. 5 " The Animal Control Officer shall maintain a record of the indentifying numbers of all tags issued. The fee(s) will be pro-rated per month left within the fiscal year. 4. No fee(s) shall be required of any veterinary hospital, governmental operated animal shelter, government operated control facility, or government operated zoological park. 6 " Section IV License and Permit Issuance and Revocation: l. The City of Schertz may revoke any permit or license if the person(s) holding the permit or license refuses or fails to comply with this ordinance or any law governing the protection and keeping of animals. 2. Any person(s) whose permit or license is revoked shall, within ten (lO) days thereafter, humanely dispose of all animals owned, kept or harbored by such person and no part of the permit or license fee shall be refunded. 3. It shall be a condition of the issuance of any permit or license that the City of Schertz shall be permitted to inspect all animals and the premises where animals are kept any reasonable time of the day and shall, if permission for such inspection is refused revoke the permit or license of the refusing owner named on the permit or license. 4. If the applicant has withheld or falsified any information on the application, the City of Schertz shall refuse to issue a permit or license. 5. No person (s) who has been convicted animals shall be issued a permit or license commercial animal establishment. of cruelty to to operate a 6. Any person(s) having been denied a permit or license may not reapply for a period of one hundred and twenty (120) days. ARTICLE IV Restraint and Animal Care Section I Restraints: l. All dogs and cats shall be kept under restraint and not allowed to run at large, stray. 2. No owner shall fail to exercise proper care and control of his animal(s) to prevent them from becoming a public nuisance. 3. Every female dog or cat in heat shall be confined in a building or secure enclosure in such a manner that such female dog or cat cannot come into contact with a male animal, except for planned breeding purposes. 4. Every vicious animal, as determined by an Animal Control Officer, shall be confined by the owner within a building or secure enclosure and shall be securely muzzled or caged whenever off the premise of its owner. 7 Section II Care: 1. No owner shall fail to provide his animals sufficient good and wholesome food and water, proper shelter protection from the weather, veterinary care when needed prevent suffering, and with humane care and treatment. with and to 2. It shall be the duty of the owner or keeper of each and every dog or cat kept in the City of Schertz to have such dog or cat vaccinated against rabies by a practising veterinarian at least once every year, provided, however, that such dog or cat must have been so vaccinated within six (6) months of the date of the owner or keeper's application for license as herein required. It shall further be the duty of each owner or keeper to obtain a certificate from such veterinarian certifying that such animal has been vaccinated and produce that document for inspection by the Animal Control Officer when requested. If the vaccination document cannot or will not be produced by the owner or keeper of such animal the Animal Control Officer shall issue a citation for failure to comply with this section of the ordinance. 3. No person shall beat, cruelly treat, torment, overload, overwork, or otherwise abuse an animal, or cause, instigate, or permit any dogfight, cockfight, bullfight, or other combat between animals or between animals and humans. 4. No owner of an animal shall abandon such animal or in case of impoundment by the Animal Control Officer, allow the animal to remain in the Animal Control Facility beyond a seven (7) day maximum for the purpose of adopting at a lesser cost than the fine fee(s). 5. Only a licensed veterinarian shall crop a dog's ears. 6. Only a licensed veterinarian shall dock, clip, or cut a dog's tail. 7. Any person who, as the operator of a motor vehicle, strikes a domestic animal shall stop at once and render such assistance as may be possible and shall immediately report such injury or death to the animal's owner; in the event the owner cannot be ascertained and located such operator shall at once report the accident to the appropr iate law enforcement agency. Failure to do so, shall be a violation of this ordinance. 8. It shall be unlawful for any person to attach or permit to be attached to any animal belonging to him, or in his possession, any cow bell or loud sounding, noisy, or disturbing implement or instrument within the limits of the City. 8 , '. , 9. No person shall expose any known poisonous substance, whether mixed with food or not, so that the same shall be liable to be eaten by any animal, provided that it shall not be unlawful for a person to expose on his own property common rat poison mixed only with vegetable substances. IO. The owner of every animal shall be responsible for the removal of any excretion deposited by his animal(s). Failure to do so, shall be a violation of this ordinance. ARTICLE V Impoundment and Violation Notices: Section I Animal Control Officer(s) Duties: The Animal Control Officer (s) are hereby enpowered during the performance of their duties to: 1. animals. In addition to impoundment a dog or cat found at large, stray, the Animal Control Officer must issue, to the known owner of such animal, a citation for violation of this ordinance. 8. At the discretion of the Animal Control Officer, when the owner of said dog or cat can be located immediately after capture and in lieu of impoundment, the Animal Control Officer 9 may return the animal to its rightful owner and there upon issue a citation for violation of this ordinance. In this case the impoundment fee must be paid, however the boarding fee shall be waived. Section II Ownership: If, after a thorough investigation, the ownership of a dog or cat cannot be substantiated after its capture, it shall be impounded for a period of not less than five (5) working days, and thereafter be considered as abandoned, where upon it shall become the property of the City of Schertz and become available for adoption in a suitable home or humanely euthanized. ARTICLE VI Controlling and Quarantining of Animals Involved in Bite Incidents Section I Enforcement: l. The Animal Control Officer and/or any law enforcement officer shall direct the owner of a suspected animal involved in a biting incident to have it examined for rabies by a licensed veterinarian within twenty-four (24) hours of the incident and submit proof of examination to the Animal Control Officer. 2. Animals involved in a biting incident for which an owner cannot be readily identified and/or contacted expeditiously, will be impounded. The Animal Control Officer will insure that the animal is examined within twenty-four (24) hours by a veterinarian. The animal shall be confined under positive control for ten (lO) days. The animal will be isolated from other animals or possible victims. 3. The Animal Control Officer shall cause all un inoculated and unlicensed animals involved in a biting incident to be impounded in a suitable facility for a period of ten (lO) days at the owners expense. The animal will be released back to the owner, after the animal has been vaccinated against rabies by a licensed veterinarian. All cost are to be paid by the owner. 4. Inoculated animals involved in biting incidents, upon the owners request in writing, and the Animal Control Officers and/or veterinarian's approval, may be confined under positive control on the owners premises isolated from other animals or possible victims. lO 5. A final examination by the veterinarian at the termination of the ten (lO) days quarantined is required and proof of the examination and release shall be furnished to the Animal Control Officer. Section II Reports of Exposure to Rabies: I. Persons having knowledge of an animal bite or scratch or other attack on an individual that the person could reasonably foresee as capable of transmitting rabies or of an animal that the person suspects is rabid, shall report the incident or animal to either the Schertz Police Department and/or the Animal Control Officer of the City of Schertz. This report shall include the name and address of any victim and of the owner of the animal, if known. 2. The owner of an animal that is reported to be rabid or to have attacked an individual or that the owner knows or suspects to be rabid or to have attacked an individual shall submit the animal for quarantine to the Animal Control Officer of the City of Schertz. 3. If a quarantined animal is found to be rabid the Animal Control Officer will cause to have the animal humanely eutharized. If an animal dies or is eutharized while in quarantine, the Animal Control Officer will cause to have the head or brain of the animal removed and submit it to the nearest Texas Department of Health Laboratory for testing. 4. If a quarantined animal is found to be free from rabies, the Animal Control Officer shall release it to the owner following the quarantine period. 5. The owner of an animal that is quarantined under this ordinance shall pay the City of Schertz the cost of the quarantine and disposition of the animaL The Animal Control Facility may sell and retain the proceeds, keep, grant, or euthanize an animal that the owner or custodian does not take possession of on or before the seventh (7th) working day following the end of the quarantine period. 6. Immediately after acquiring knowledge that his animal has been bitten by a rabid animal, it shall be the duty of the owner or keeper to cause such animal to be given anti-rabies treatment, and to impound such animal for a period of six (6) months in a place approved by the Animal Control Officer or to eutharize such animal in a humane manner. 11 .', ' ARTICLE VII FOWL AND OTHER SMALL ANIMALS Section I Stray: That it shall be unlawful for any person raising or keeping chickens, turkeys, geese, guineas, ducks, pigeons, or other fowl to permit or allow the same to run-at-large (stray) within the limits of the City of Schertz. Straying shall be intended to mean the same as in Article I of this ordinance. Section II Pen, Coop or Enclosure of Fowl: It shall be the duty of every person raising or keeping chickens, turkeys, ducks, geese, guineas, pigeons, or other fowl to keep them in pens, coops or enclosures, which shall be a distance of at least fifty (50) feet from every building/structure used for sleeping, dining or living and shall be kept in a sanitary condition and shall also be kept in such a manner as will be reasonably calculated not to become offensive to neighbors or to the public. Section III Keeping Rabbits, Quinea pigs, White rats, Etc.: It shall be the duty of every person raising or keeping rabbits, guinea pigs, white rats, white mice, hamsters and other small animals to keep such animals in pens, coops or enclosures and such pens, coops or enclosures shall be a distance of at least fifty (50) feet from every building/structure used for sleeping, dining or living and shall be kept in a sanitary condition; and shall be kept in such a manner as will be reasonably calculated not to become offensive to neighbors or to the public. Section IV Not applicable to authorized Veterinary Hospitals: Provided, that this article shall not apply to authorized veterinary hospitals for the treatment of domestic animals. Provided further, that this article shall not apply to the keeping of dogs or cats as domestic pets only and not for breeding or for gain. ARTICLE VIII Livestock Section I Stray: It shall be unlawful for the owner, keeper or person in charge of any horse, mule, jack, jenney, cow, cattle, hog, sheep or goat, or similar animal to allow or permit the same to run at large (stray) within the limits of the City of Schertz. Straying 12 , : shall be intended to mean the same as in Article I of this ordinace. Every such animal shall be kept in a stable, shed, pen or other enclosure wherever located within the City of Schertz, for keeping of such animals shall be a distance of at least one thousand (1000) feet from every building/structure used for sleeping, dining and living and shall be kept in a sanitary condition and shall also be kept in such a manner as will be reasonably calculated not to be offensive to neighbors or to the public. Section II Impounding: The Animal Control Officer shall take up or cause to be taken up any such animal found running at large within the limits of the City of Schertz, and shall impound any such animals in a suitable place provided for that purpose. Section III Notice of Sale: That the Animal Control Officer shall within three (3) days after such animal has been impounded post two notices, one at the Municipal Complex, and one in some other public place, giving therein full description of such animal so taken up and impounded and stating a day and place of sale of such animal, which date of sale shall not be less than ten (IO) calender days from date of posting notice, and said animal shall be sold at a public auction to the highest bidder for cash. Section IV Reclaiming Before Sale: The owner of any animal impounded may reclaim the same from the Animal Control Facility at any time before sale by paying all fees, fines and expenses of taking up and keeping such animal. Section V Records: The Animal Control Officer shall keep a well-bound book in which he shall record a description of all animals impounded, the date of impoundment, the date of sale, the amount realized from the sale, the fees and expenses due for impounding and keeping same, the name of owner, if known, and the name of the purchaser. Section VI Redemption: At any time within fourteen (14) calender days from the date of sale, the owner of any animal impounded and sold under the provisions of this ordinance shall have the right to redeem the same paying to the purchaser thereof double the amount paid by 13 said purchaser for such animal in addition his reasonable expenses incurred in keeping the same. Section VII Staking and Grazing: It shall be unlawful for any person to stake any livestock for the purpose of grazing upon or within the reach of any public street, alley, sidewalk or park, within the limits of the City of Schertz. Section VIII Riding of Animals: It shall be unlawful for any person to ride an animal, drive an animal or animal pulled vehicle within any developed residentially zoned area, or public street, alley, sidewalk, or park within the City of Schertz without special permission from the City Manager. Exception, City sponsored parade or special event as authorized by the City Council. ARTICLE IX Wild Animals and Performing Animal Exhibitions Section I Keeping of Wild (non-domesticated) Animals: I. No person shall keep or permit to be kept on his premises any wild or vicious animal for display or for exhibition purposed, whether gratuitously or for a fee. This section shall not be construed to apply to zoological parks, performing animal exhibitions, circuses, and veterinary hospitals. 2. No person shall keep or permit to be kept any wild animal as a pet. 3. The City of Schertz may issue a temporary permit for the keeping, care and protection of an infant animal native to this area which has been deemed to be homeless. 4. The Animal Control Officer shall have the power to release or order the release of any infant wild animal kept under temporary permit which is deemed capable of survival. Section II Performing Animal Exhibitions: 1. No performing animal exhibition or circus shall be permitted in which animals are induced or encouraged to perform through use of chemical, mechanical, electrical or manual devices in a manner which will cause, or is likely to cause, physical injury or suffering. 14 , " . Cats receive: Feline 3-way (one dosage includes Rhinotracheitis, Calici virus, and Panlenkogsenia virus); Rabies vaccine according to age requirement and any other serums directed by a veternarian. Section II Examination by veterinarian: All animals adopted from the Schertz Animal Control Facility shall be examined by a veterinarian for health conditions prior to adoption. Section III Medical treatment by veterinarian: Animals, other than dogs and cats, may receive inoculations or other medical treatment as recommended by a veterinarian, prior to adoption. Section IV Fees Passed on: All costs, debts and/or fees created by this Article shall be passed on to the adopter and must be paid prior to receiving custody of the animal(s). License fee will be waived for adopted animals, only during current license period. However a proper tag will be issued in accordance with Article III. Section V Adoptions final: All adoptions from the Animal Control Facility are final. ARTICLE XI Fees Schedule (See Exhibit A attached) 15 . , , " ARTICLE XII Special provisions Section 1- Enforcement: The civil and criminal prOVl.Sl.ons of this ordinance shall be enforced by those persons or agencies designated by municipal authority. It shall be a violation of this ordinance to interfere with an Animal Control Officer in the performance of his duties. Section II- Penalty: Any person who shall violate any of the prOVl.Sl.ons of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not exceeding $200.00. Each and every day of such violation shall be deemed a separate and complete offense. Minimum fines levied per offense: (See Exhibit B attached) Section 111- Savings Clause: If any section, part, or provision of this ordinance is declared unconstitutional or invalid, then, in that event, it is expressly provided and it is the intention of the City Council in passing this ordinance, that all other parts of this ordinance shall not be affected thereby and shall remain in full force and effect. Section IV Repealing Clause: That all ordinances and part of ordinances in conflict with the terms of this ordinance are hereby repealed~ provided, however, that the provisions of the zoning ordinance which regulate the keeping of livestock, fowl, and dogs within the limits of the City of Schertz shall remain in full force and effect and shall be in addition to the regulations prescribed by this ordinance.
