84-C-8 BUILDING CODE ORDINANCE NO. ?J'I-~- i AN ORDINANCE ADOPTING THE SOUTHERN STANDARD BUILDING CODE, 1982 EDITION, AS AMENDED, AS THE BUILDING CODE OF THE CITY OF SCHERTZ, TEXAS, AS HEREIN MODIFIED AND REPEALING ALL ORDINANCES IN CONFLICT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS. SECTION I This Ordinance is, shall be known and may be cited as, the Build- ing Code of the City of Schertz. SECTION II The Southern Standard Building Code, 1982 Edition, as amened, revised and corrected, to include all future editions, revisions, amendments and corrections, published by the Southern Building Code Congress, two (2) copies of which are on file with the City Secretary, is hereby adopted and incorporated by reference as the Building Code of the City of Schertz, Texas, subject to and including by reference such amendments as herein shall appear. SECTION III Section 102.1 of the Southern Standard Building Code, 1982 Edition as amended, is hereby amended to read as follows: "102.1 BUILDING OFFICIAL (a) There is hereby established a department called the "Building Department" and the Manager shall act as the Building Official. (b) The Building Official shall serve as the person in charge of the Building Department. As such, he will utilize recognized inspection services, and/or licensed or qualified architects, engineers, build- ing inspectors, master plumbers, master electricians, or other qualified persons as deemed necessary to enforce the Code." to be City SECTION IV Section 102.2 of the Southern Standard Building Code, 1982 Edition as amended, is hereby amended to read as follows: 1 "102.2 INSPECTORS The Building Official with the approval of the City Council may appoint such number of officers, inspectors, assistants, and other employees as shall be authorized from time to time. A person or inspection service shall not be appointed as inspector of construction unless one of the fOllow- ing qualifications are met: (a) Certified or accepted as a building inspector by/for a state or federal agency. (b) Five years experience as a building inspector, builder, engineer, architect, or as a super- intendent, foreman, or competent mechanic in charge of construction. (c) One year experience as a building inspector, builder, engineer, architect, or as a super- intendent, foreman, or competent mechanic in charge of construction. Performance of duties as inspector must be under supervision of persons qualified under sub-paragraph (a) or (b).n SECTION V In accordance with Section 106.2 of the Building Code, the City Council hereby establishes the amount of bond required to be $5,000.00. SECTION VI Section 107.4 of the Southern Standard Building Code, 1982 Edition as amended, is hereby amended to read as follows: "107.4 SCHEDULE OF PERMIT FEES On all buildings, structures or alterations requir- ing a building permit, as set forth in Section 105, a fee for each building permit shall be paid as required at the time of filing application, in accordance with the schedule as established by the Ci ty Council. (See Appendix "K" for fee schedules) .n SECTION VII Section 108.2 (c) of the Southern Standard Building Code, 1982 Edition as amended is hereby amended to read as follows: 2 "108.2 INSPECTIONS REQUIRED (c) The Building Official upon notification from the permit holder or his agent shall make the following inspections of buildings: (1) Sewer Inspection to be made before back- fill and water tested 24 hours. (2) Foundation Inspection to be made after trenches are excavated and form erected, steel complete, copper in place. (3) Frame Inspection to be made after the roof, all framing, fire-blocking and bracing is in place and all pipes, chimneys, and vents are complete. (4) Insulation Inspection to be made after wall insulation complete. (5) Flat Work dr i veway, and steel in place. Inspection to be made for walk, patio formed, backfilled and (6) Final Inspection to be made after the building is completed and ready for occupancy. NOTE: V.A. Inspection of foundation, framing, flatwork, and final will be accepted in lieu of City inspections. Trench inspection of sewer line to main installed prior to backfill. (d) Work shall not be done on any part of a building or structure beyond the point indicated in each successive inspection without first obtaining the written approval of the Building Official. Such written approval shall be given only after an inspection shall have been made of each successive step in the construction as indicated by each of the foregoing inspections." SECTION VIII The Building Code of the City of Schertz shall be amended to read as follows: "Section 111.1 The Board of Adjustments and Appeals created by Section 8.02 of the Charter is hereby empowered to hear and rule on all appeals filed under this ordinance. 3 Section 111.2 Repealed." SECTION IX Section 706 of the Southern Standard Building Code, 1982 Edition as amended, is hereby amended by adding the following: "706.4A Wood shingles and shakes are usually made from red cedar, redwood or cypress wood. The shingles are sawed with a taper and applied with nails, exposing one third of the thick end. Shakes are split pieces and resulting in a rough and uneven surface, and are applied like shingles. 706.4B Fire Distr ict - Ordinance No. 78-C-21, adopted on November 21, 1978, establishes the fire limits of the City of Schertz, specifically Fire Distr ict No. 1 which incorporates the General Business Distr ict, more or less, along both sides of Live Oak Road, and along both sides of FM Road 78, a specified width extending the distance of the city limits; and Fire District No.2, which incorporates a General Business District bounded by Oak Street, Pecan Dr i ve, Fr-! Road 1518 and the North line of a natural gas easement." SECTION X Section 706.5 of the Southern Standard Building Code, 1982 Edition as amended, is hereby amended to read as follows and by addition of 706.5A: "Section 706.5 Roof covering outside the Fire District shall conform to Class A, B, or C specifications as set forth herein. If Class B or C treated wood shingles or shakes are to be used, they shall bear the manufacturers name and/or trademark, roof covering classification, the Southern Building Code Congress International Seal and report number. Section 706.5A Roof covering in the Fire District shall conform to Class A or B specifications as set forth in definition as set forth herein. If Class B treated wood shingles or shakes are to be used, they shall bear the manufacturers name and/or trademark, roof covering classifi- cation, the Southern Building Code Congress International Seal and report number." SECTION XI Section 706.6 of the Southern Standard Building Code, 1982 Edition as amended, is hereby amended to read as follows: 4 . . . "Repair/replacement of existing wood shingle or shake roofs will be made with Class B treated wood shingles or shakes within the Fire District, and with Class B or C treated wood shingles outside the Fire District. In all cases, the shingles or shakes shall bear the manufacturers name and/or trademark, roof covering classification, the Southern Build- ing Code Congress Internation Seal and report number. All roof covering installations, new, repair or replacement, will be installed in accordance with the specifications set forth in this ordinance, the Schertz City Code and the Southern Standard Building Code." SECTION XII Penalties. Any violation of this ordinance is declared to be unlawful and a misdemeanor, and any violation thereof shall be punishable by fine not to exceed one thousand dollars ($1000.00). SECTION XIII Severability of Parts of Ordinance. If any provision tutional, such portions of this of this ordinance be declared void or unconsti- declaration shall not affect the remaining ordinance. ' APPENDIX nK" SCHEDULE OF PEill~IT FEES (a) Permit Pees Total Valuation Fee $500 and less Permit required but no fee, unless inspection required in which case a $10.00 fee for each inspection shall be charged. $10.00 per thousand or fraction thereof. $501 to $1,000 $1,001 to $15,000 $10.00 for the first $1,000 plus $6.00 for each additional thousand or fraction thereof, to and in- cluding $50,000. $94.00 for the first $15,000 plus $5.00 for each additional thousand or fraction thereof, to and in- cluding $50,000. $269.00 for the first $50,000 plus $4.00 for each additional thousand or fraction thereof, to and in- cluding $100,000. $15,001 to $50,000 $50,001 to $100,000 $100,001 to $500,000 $469.00 for the first $100,000 plus $$2.50 for each additonal thousand or fraction thereof, to and including $500,000. $500,001 and up $1,469.00 for the first $500,000 plus $1.50 for each additional thousand or fraction thereof. (b) Reinspection For the reinspection of any building or structure, the fee shall be $18.00 per reinspection.
