84-E-7 ELECTING MAYOR , ' ORDINANCE NO. ?fLl-f -7 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CALLING AN ELECTION TO BE HELD ON APRIL 7, 1984, FOR THE PURPOSE OF ELECTING A MAYOR AND THREE (3) COUNCILMEMBERS FOR SAID CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I That an election be held in and throughout the City of Schertz, Texas (the "City"), for the purpose of electing a Mayor and two (2) councilmembers for Places 1 and 2, respectively, to serve for a term of two (2) years and one (1) councilmember for Place 5 to serve the unexpired term of one (1) year. II That at said election the candidate receiving the high- est number of votes for Mayor shall be declared elected; and the candidates receiving the highest number of votes for Place 1 and Place 2, respectively, shall be declared elected for a term of two (2) years, and the candidate receiving the highest number of votes for Place 5 shall be declared elected for the unexpired term of one (1) year. Any candidate desiring to have his or her name on the official ballot for said election, shall at least thirty (30) days prior to said election day, file with the Mayor an application in writing in the form prescribed by the Texas Election Code requesting that his or her name be placed on the official ballot and designating whether he or she is running as a candidate for Mayor or councilman, and if for councilman, such person shall declare as candidate for Place 1, Place 2 or Place 5. That any person failing to file said written application for candidacy by the time aforesaid, shall not be entitled to have his or her name printed on the official ballot. That the names of all eligible candidates whose applica- tions have been duly and timely filed shall be placed on the ballot pursuant to a drawing as provided by law. III That all qualified voters of said City shall be entitled to vote in said election. IV That the poling place for the holding of said election shall be at the Community Center, 1400 Live Oak Road, Schertz, Texas, 78154; and the entire City of Schertz for the purp@se of holding said election, shall be and constitute one municipal election precinct. :IflNes1illJ-€- kJ/lI~i L is hereby appointed Presiding Judge of said electi n, and RItL~k r"to Kfl[)oRIt'i is hereby appointed Alternate Presiding Judge of sai election. - 1 - v That the Presiding Judge of said election shall appoint as many resident qualified electors of the City to serve as clerks in said election as shall be reasonably necessary to conduct said election, with the appointment of such clerks to include the Alter- nate Presiding Judge if present for the holding of said election. The Presiding Judge shall appoint a person fluent in the Spanish language to serve as a clerk of said election to render oral aid in the Spanish language to any voter desiring such aid at the polls on the day of the election. In the absence of the Presiding Judge above named, the Alternate Presiding Judge shall perform the duties of the Presiding Judge of said election. VI That absentee voting in said election shall be conducted at the Office of the City Secretary, Municipal Complex, 1400 Live Oak Road, Schertz, Texas 78154, and the City Secretary is hereby charged with the duty of conducting absentee voting in said election as required by law. The City Secretary shall appoint a Deputy Absentee Voting Clerk who is fluent in the Spanish language to render oral aid to any voter desiring to vote absentee in said election who requests such aid. That with the exception of Saturdays, Sundays and offi- cial State holidays, the Municipal Complex shall remain open from 8:30 o'clock a.m. to 4:30 p.m. for the purpose of conducting absen- tee voting for said election. VII That the polls of said election on the day of said election shall be open from 7:00 o'clock a.m. to 7:00 o'clock p.m. VIII That the ballots to be used in said election shall be prepared in conformity with V.A.T.C.S. Election Code, as amended. That in the holding and conducting of said election, voter forms, instructions and other materials required therefor, including the ballots, shall be in both the English and Spanish languages. IX Notice of said election shall be given in accordance with the provisions of Article 4.05, Texas Election Code. X That the City Secretary is hereby authorized to post notice of said election, in both the English and Spanish languages, on a public bulletin board at the Municipal Complex of said City, at the polling place for the holding of said election, and at one other p~blic place within said City, all of which notices shall be posted at least twenty (20) days prior to the date set for said election. - 2 - , ' ~ . ' XI That the City Secretary is further authorized and directed to cause notice of said election to be published one time not more than twenty-five (25) nor less than ten (10) days prior to the date set for said election in a newspaper published and of general cir- culation in the City.
