82-F-19ORDINANCE NO. -F+ L9 AN ORDINANCE AMENDING GUTIERREZ DISPOSAL INC. CONTRACT TO OPERATE A GARBAGE COLLECTION SERVICE IN THE CITY OF SCHERTZ, TEXAS, SCHEDULE "A" PROVIDING FOR A SERVICE FEE INCREASE. WHEREAS, Gutierrez Disposal, Inc. was granted a five -year contract to operate a garbage collection service on October 1, 1980; and WHEREAS, the contract contains a rate increase option based on proof of increased operating costs; and WHEREAS, Gutierrez Disposal Inc. desires to exercise the option of increasing charges by nine percent (9 %) due to increased operating costs effective with February 1983 billing; NOW THEREFORE, BE IT ORDAINDED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT Gutierrez Disposal Inc. be granted a service fee increase of nine percent (9%), this increase to be effective with the February 1983 billing; and THAT, the service fees herein approved and attached hereto will remain in effect during the remainder of the contract period; and THAT, no additional increase in service fees will be negotiated or considered during the remaining period of this contract, the expiration date being 30 September 1985; and THAT, if this option is not accepted by the Contractor and said acceptance in writing filed with the City Secretary within 30 days after passage hereof, all rights granted by this ordinance shall be null and void.
