AN ORDINANCE
OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE
CODE OF ORDINANCES BE AMENDED BY REVISING SECTIONS
12!-3 AND 12!-4 OF SAID CODE TO RESTRICT THE POSSESSION
AND/OR CONSUMPTION OF ALCOHOLIC BEVERAGES IN CITY PARKS
AND RECREATION AREAS DURING CERTAIN HOURS WITHOUT PRIOR
AUTHORIZATION; BY REVISING RESERVATION POLICY FOR SMALL
GROUPS (15 OR LESS PERSONS); AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
SECTION 1. That Section 12!-3 of the Code of Ordinances be revised to
read as follows:
"12 ! - 3. Possession or consumption of alcoholic beverages
in parks and recreation areas.
Alcoholic beverages may be possessed and/or consumed in all
parks and recreation areas between the hours of 6:00 A.M.
and 9:00 P.M., and between the hours of 6:00 A.M. and 12:00
P.M. in authorized areas provided reservations have been
made for the use of a specified .area and authorization has
been granted to possess and/or consume alcoholic beverages
between the hours of 9:00 P.M. and 12:00 P.M.; except
the possession and/or consumption of alcoholic beverages is
not authorized at any time in the ballfield areas, including
the picnic area next to and including the area of the Scout
Hut, that area being in H.P. Thulemeyer Park; Lone Oak Park
in the Lone Oak Subidivsion; and the swimming pool facility
in G. W. Pickrell Park."
SECTION 2. That Section 12 ! -4, subsection 1 A (1) of the Code of
ordinances be revised to read as follows:
"1. Reservation policies:
A. (1) No reservation is required for small groups
(15 or less) usage of picnic and recreation
areas, unless alcoholic beverages will be
possessed and/or consumed by those persons
using an area between the hours of 9:00 P.M.
and 12:00 P.M."
SECTION 3. The public importance of this measure constitutes and creates
an urgent public necessity requiring that this ordinance be
passed and take effect as an emergency measure, and shall take effect and
be in force immediately upon and after its passage.
