TAKE NOTICE that an election will be held in the City of Schertz, Texas on May 12,
2007, in obedience to an ordinance duly entered by the City Council of the City on
February 6, 2007, which ordinance reads substantially as follows:

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS, CALLING AN ELECTION TO BE HELD ON
MAY 12, 2007 FOR THE PURPOSE OF ELECTING
COUNCIL MEMBERS FOR PLACE 3, PLACE 4, AND PLACE 5
FOR SAID CITY; MAKING PROVISION FOR THE CONDUCT OF
A JOINT ELECTION; CONTRACTING WITH THE ELECTIONS
ADMINISTRATOR OF GUADALUPE COUNTY TO CONDUCT
THIS ELECTION; AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
SECTION 1. An election shall held on May 12,2007 in and throughout the City of
Schertz, Texas (the "City"), for the purpose of electing Councilmembers for Place 3,
Place 4, and Place 5 for a term to expire in May of 2009.
SECTION 2. The City will hold a joint election with the Schcrtz-Cibolo-Universal City
Independent School District (the "District"), and the Cibolo Creek Municipal Authority
(the "Authority"), as provided pursuant to the provisions of a joint election agreement
between the City, the District, and the Authority adoptcd in accordance with the
provisions of Section 271.002, as amended, Texas Election Code (thc "Codc").
SECTION 3. The City will enter into an agreement with the Elections Administrator of
Guadalupe County (the "Guadalupc County Elcctions Administrator") to conduct all
aspects of this election.
SECTION 4. At said election the candidate receiving the highest numbcr of votes for
Councilmembers f()r Place 3, Place 4, and Place 5, respectively, is deelared clcctcd for a
term to expire in May 2009. Any candidate desiring to have his or her name on the
Ot11cial Ballot for said election shall, no sooner than February 10, 2007 and no later than
March 12, 2007, filc with the City Secretary an application in writing in the form
prescribed by the Texas Election Code requesting that his or her name bc placed on the
Ot11cial Ballot and deeJaring as a candidate for Councilmember for Place 3, Place 4, or
Place 5. Any person failing to file said writtcn application for candidacy by the time
aforesaid shall not be entitled to have his or hcr namc printcd on the Official Ballot. The
name of all eligible candidatcs whosc applications havc bcen duly and timely filed shall
be placed on the ballot pursuant to a drawing as provided by law.
SECTION 5. Pursuant to Section 61.012, as amended, Texas Election Code, the City
shall provide at least one accessible voting system in cach polling place used in the
eJection. Such voting system shall comply with Tcxas and fcdcrallaws establishing the
requirement for voting systcms that permit voters with physical disabilities to cast a
sccret ballot. Touch screen machines shall be used for early voting and elcction day
voting by personal appearance. Certain early voting may be conducted by mail. The
Guadalupc County Elections Administrator shall also utilize a Central Counting Station
(the "Station") as provided by Section 127.001, ct scq., as amcndcd, Tcxas Election

Code. Russell Vcra has been appointed as the Manager and Misty Foss has been
appointed as the Presiding Judge of the Station, and she may appoint Station clerks and
establish a written plan for the orderly operation of the Station in accordance with the
provisions of the Texas Election Code. The Guadalupc County Elections Administrator
has appointcd Russell Vera as the Tabulation Supcrvisor and as the Programmer for the
Station. Lastly. the Guadalupe County Elections Administrator will publish notice and
conduct testing on the automatic tabulation equipment rclating to the Station and conduct
instruction for the oflicials and clerks lor the Station in accordance with the provisions of
the Texas Election Code.
SECTION 6. The City clcction precincts established for this election shall be the
precincts named on Exhibit A attached hereto. A list of the City election precincts and
the polling places designated for each such election precinct are identified on Exhibit A
to this Ordinance, and this Exhibit is incorporated by reference for all purposes. At least
63 days prior to the scheduled election date. the Council. in coordination with the
Guadalupe County Elections Administrator, will identify and formally approve the
appointmcnt of the Prcsiding Judges, Altcrnate Presiding Judges, Election Clerks, and all
other eJection ot11cials for this election.
Each Presiding Judge shall appoint not less than two (2) resident qualified voters of the
County to act as clerks to properly conduct thc clcction. However, if the Presiding Judge
appointed actually serves, the Alternate Presiding Judge shall serve as one of the clerks.
The appointment of such clerks may include a person fluent in the Spanish language to
serve as a clerk to rendcr oral aid in the Spanish language to any voter desiring such aid
at the polls on the day of the election. In the absence of the Prcsiding Judge named
abovc. the Alternate Presiding Judge shall perform the duties of the Presiding Judgc.
The election shall be held in the City as prcscribed by applicable law and on the day 0 f
the clection, the polls shall be open from 7:00 o'clock a.rn. to 7:00 o'clock p.m.
The Guadalupe County Elections Office, 1101 Elbel Road, Schertz, Texas 78154. is
hereby designated as the main early voting place at which early voting shall be
conducted. Sue Basham, the Elections Administrator of Guadalupe County (whose
mailing address is Post Oflice Box 1346. Seguin. Texas 78156) is herehy appointed as
thc Early Voting Clerk to conduct such early voting in the election. The Early Voting
Clerk shall appoint not less than two (2) Deputy Early Voting Clerks in accordance with
the provisions of the Texas Election Code. Early voting shall be conducted at the main
early voting place from April 30, 2007 through May 8. 2007, with the exception of
Saturdays, Sundays. and official State holidays. The hours for early voting shall be from
7:00 a.m. to 7:00 p.m. on May 7, 2007 and May 8, 2007. and from 8:00 a.m. to 5:00 p.rn.
on all other early voting days. Applications for ballots by mail must be rcccived by the
Early Voting Clerk not later than the closc ofbusincss on May 4.2007.
An Early Voting Ballot Board is hereby established for the purpose of processing early
voting results. Missy Doss is appointed the Presiding Judge of the Early Voting Ballot
Board. The Prcsiding Judge shall appoint not less than two (2) nor more than tcn (10)
resident qualified voters of the County to serve as members of the Early Voting Ballot
Board.

SECTION 7. All resident qualified voters of the City shall be permitted to vote at the
election and on the day of thc election, such voters shall vote at anyone of the designated
polling places. The election shall be held and conducted in accordance with the
provisions of the Texas Elcction Code, as amended, and the provisions of Texas Revised
Civil Statutes Annotated Chapter I of Title 22, as amended, and as may bc required by
any other law. All election matcrials and procccdings shall be printcd in both English
and Spanish.
SECTION 8. A substantial copy of this Ordinance shall serve as a proper notice of the
election. This notice, including a Spanish translation thereof, shall be posted at the City
Hall not less than twenty-one (21) days prior to the date the election is to be held, and be
published in a ncwspaper of general circulation in the City, not more than thirty (30)
days, and not less than ten (10) full days prior to the day of the election.
SECTION 9. The Council authorizes the City Manager, or his designee, to negotiate and
enter into a joint election agrecment with the District and the Authority in accordance
with the provisions of the Texas Elcction Code.
SECTION 10. Thc Council authorizes the City Manager, or his dcsignee, to negotiatc
and enter into a contract with thc Guadalupe County Elections Administrator to conduct
the election in accordance with the provisions of the Texas Election Code. The rate of
pay for all election otIicials shall bc established in this election agrccment.
SECTION 11. The recitals contained in the preamble hereof are hereby found to be true,
and such rccitals are hereby made a part of this Ordinancc for all purposcs and are
adopted as a part of the judgment and findings of the Council.
SECTION 12. All ordinances and resolutions, or parts thereof, which are in conflict or
inconsistcnt with any provision of this Ordinance are hereby repealed to the extent of
such conflict, and the provisions of this Ordinancc shall be and remain controlling as to
the matters ordered hcrcin.
SECTION 13. This Ordinance shall bc construed and cnforced in accordance with the
laws of the State of Texas and thc United Statcs of America.
SECTION 14. If any provision of this Ordinance or the application thereof to any
person or circumstance shall be hcld to be invalid, the remainder of this Ordinance and
the application of such provision to other persons and circumstances shall nevertheless be
valid, and this Council hereby declares that this Ordinance would have been enacted
without such invalid provision.
SECTION 15. It is officially found, determincd, and deelarcd that the meeting at which
this Ordinance is adopted was opcn to the public and public notice of the time, place, and
subject matter of the public business to be considered at such meeting, including this
Ordinance, was given, all as rcquired by Chapter 551, Texas Govcrnment Code, as
amended.
SECTION 16. By votc of not less than two-thirds of the members of the City Council
present at the meeting at which this Ordinance was first considered, the City Council has
determined that an emergency exists which requires immediate action, and this Ordinancc
is hercby adopted on a single reading.

Schertz, en cumplimiento con una orden debidamente inscrita el 6 de febrero de 2007, par el
Ayuntamiento de la Ciudad, cuya orden reza como sigue:

LLEV ARA. A CABO EL 12 DE MAYO DE 2007 CON EL PROPOSITO DE
ELEGIR CONSEJALES PARA EL SECTOR (PLACE) 3, SECTOR 5 Y
SECTOR 5 DE DICHA CIUDAD; DISPONIENDO COMO SE VA A
CONDUCIR UNA ELECCION CONJUNTA; ENTRAR EN ACUERDO
CON EL ADMINISTRADOR DE ELECCIONES DEL CONDADO DE
GUADALUPE PARA LLEV AR A CABO ESTA ELECCION; Y
DECLARAR UNA EMERGENCIA
EL AYUNTAMIENTO DE LA CIUDAD DE SCHERTZ, TEJAS, ORDENA QUE:
SECCION 1: Se lleve a cabo una elecci6n el12 de mayo de 2007, en y a 10 largo de la
Ciudad de Schertz, Tejas (la "Ciudad") con el prop6sito de elegir Concejales para el
Sector (Place) 3, Sector 4 y Sector 5 por un termino que final ice en mayo de 2009.
SECCION 2: La Ciudad llevani a cabo una elecci6n conjunta con el Distrito Escolar
Independiente de Schertz-Cibolo-Universal City (el "Distrito"), y con la Autoridad Municipal de
Cibolo Creek (la "Autoridad"), conforme a la Secci6n 61.012, segun enmendada, del C6digo de
Elecciones de Tejas (el "C6digo").
SECCION 3: La Ciudad entrani en un acuerdo con el Administrador de Elecciones del Condado
de Guadalupe (el "Administrador de Elecciones del Condado de Guadalupe") para llevar a cabo
todos los aspectos de esta elecci6n.
SECCION 4: En dicha elecci6n, el candidato que reciba la mayor cantidad de votos para
Concejal del Sector (Place) 3, Sector 4 y Sector 5, respectivamente, se dec1ara elegido par un
termino que final ice en mayo de 2009. Cualquier candidato(a) que de see so meter su nombre en
la Boleta Oficial para dicha elecci6n debeni registrar una solicitud por escrito con la Secretaria
del Ayuntamiento, conforme a como se dispone en el C6digo de Elecciones de Tejas no antes del
10 de febrero de 2007 ya mas tardar el 12 de marzo de 2007, y dec1ararse como candidato(a)
para Concejal del Sector (Place) 3, Sector 4 0 Sector 5. Toda persona que no registre dicha
solicitud por escrito para la candidatura para la fecha antes mencionada no tendra derecho a que
se imprima su nombre en la Boleta Oficial. El nombre de todos los candidatos elegibles cuyas
aplicaciones hayan sido debida y oportunamente registradas seran colocados en la boleta de
conformidad con un sorteo segun 10 requiere la ley.
SECCION 5: Conforme a la Secci6n 61.012, segun enmendado, del C6digo de Elecciones de
Tejas, el Distrito proveera al menos un sistema de votaci6n accesible en cada lugar de votaci6n
utilizado para la elecci6n. Dicho sistema de votaci6n cumplira con las leyes federales y del
estado de Texas que establecen el requerimiento de sistemas de votaci6n para permitirles a los
votantes con discapacidades fisicas que emitan una boleta secreta. Las boletas de papel se
pueden utilizar para la votaci6n anticipada por correo. Pantallas sensibles al tacto se utilizaran
para la votaci6n anticipada y para la votaci6n el dia de la elecci6n compareciendo
personalmente. EI Administrador de Elecciones del Condado de Guadalupe tambien hara uso de
la Estaci6n de Conteo Central (la "Estaci6n") conforme a la Secci6n 127.001, y siguientes, segun
enmendado, del C6digo de Elecciones de Tejas. Russell Vera ha sido designado como Gerente y
Missy Doss ha sido designada como Juez Presidente de la Estaci6n y ella puede designar
Secretarios de la Estaci6n y establecer un plan escrito para el buen funcionamiento de la Estaci6n
segun se dispone en el C6digo de Elecciones de Tejas.
SECCION 6: Los precintos electorales de la Ciudad establecidos para esta elecci6n seran los
precintos mencionados en el Documento de Prueba A que se adjunta. Una lista de los precintos
electorales y los lugares de votaci6n designados para cada precinto electoral se identifican en el
Documento de Prueba A de esta Orden y el mismo se incorpora por referencia para todos los
fines. Como minimo sesenta y tres (63) dias antes de la fecha programada para la elecci6n, el
Consejo, en coordinaci6n con el Administrador de Elecciones del Condado de Guadalupe,
identificara y oficialmente aprobara el nombramiento de los Jueces Presidentes, los Jueces
Presidentes Alternos, los Secretarios de Elecciones y todos los demas funcionarios para esta
elecci6n.
Cada Juez Presidente designara a no menos de dos (2) votantes residentes calificados del Distrito
para que se desempefien en calidad de secretarios para poder llevar a cabo la elecci6n
correctamente. De acuerdo a 10 requerido por el C6digo de Elecciones de Tejas, segun
enmendado, u otra ley pertinente, al nombrar esos secretarios se debe incluir a una persona que
do mine el idioma espafiol para que se desempefie como tal y preste ayuda oral, en espafiol, a
cualquier votante que solicite dicha ayuda en las urnas el dia de la elecci6n. Si el Juez Presidente
designado sirve como tal, el Juez Presidente Alterno se desempefiara como uno de los
secretarios. En ausencia del Juez Presidente, el Juez Presidente Alterno desempefiara las tareas
del Juez Presidente.
La elecci6n se llevara a cabo en la Ciudad segun se dispone en las leyes pertinentes y el dia de la
elecci6n, las urnas estaran abiertas desde las 7:00 de la mafiana hasta las 7:00 de la noche.
La Oficina de Elecciones del Condado de Guadalupe, ubicada en el 1101 Elbel Road, Schertz,
Tejas, es por la presente designada como ellugar principal para la votaci6n anticipada en donde
se llevara a cabo dicha votaci6n. Sue Basham, Administradora de Elecciones del Condado de
Guadalupe (cuya direcci6n postal es Post Office Box 1346, Seguin, Tejas 78156) es por la
presente designada como Secretaria de votaci6n anticipada para llevar a cabo dicha votaci6n. La
Secretaria de votaci6n anticipada designara a no menos de dos (2) Secretarios Suplentes de
votaci6n anticipada segun se dispone en el C6digo de Elecciones de Tejas. La votaci6n
anticipada se llevara a cabo en ellugar principal de votaci6n anticipada desde el 30 de abril de
2007 hasta el 8 de mayo de 2007, salvo los sabados, domingos y dias feriados del Estado. Las
horas para la votaci6n anticipada seran desde las 7:00 de la mafiana hasta las 7:00 de la noche el
7 de mayo de 2007 y el 8 de mayo de 2007, y desde las 8:00 de la mafiana hasta las 5:00 de la
tarde los demas dias designados para la votaci6n anticipada. La Secretaria de votaci6n
anticipada tiene que recibir las solicitudes de boletas por correo a mas tardar el cierre de
operaciones el 4 de mayo de 2007.
Por la presente se establece una Junta de Boletas para la votaci6n anticipada para fines de
procesar los resultados de la votaci6n anticipada. Missy Doss es designada como Juez
Presidente de la Junta de boletas para la votaci6n anticipada. La Juez Presidente designara no
menos de dos (2) y no mas de diez (10) votantes calificados residentes del Condado para que se
desempenen como miembros de la Junta de Boletas de votaci6n anticipada.
SECCION 7: A todos los votantes calificados residentes de la Ciudad se les permitini votar en
la elecci6n y, en el dia de la misma, esos votantes votanin en uno de los colegios electorales
designados. La elecci6n se llevani a cabo como se dispone en el C6digo de Elecciones de Tejas,
segun enmendado, y como se dispone en los Estatutos Civiles Revisados de Tejas, Anotado en el
Capitulo 1 del Titulo 22, segun enmendado, y segun 10 exija otra ley pertinente. Todos los
materiales de la elecci6n y los procedimientos se impriminin en ingles y en espanol.
SECCION 8: Una copia substancial de esta orden servini como convocatoria correspondiente de
la elecci6n. Esta convocatoria, incluso una traducci6n al espanol de la misma, se publicani en el
Ayuntamiento no menos de veintiun (21) dias antes de la fecha de la elecci6n y se publicani en
un peri6dico de circulaci6n general en la Ciudad no mcis de treinta (30) dias y no menos de diez
(10) dias antes del dia de las elecciones.
SECCION 9: El Consejo autoriza al Administrador Municipal, 0 a su designado, a negociar y
entrar en un acuerdo de elecci6n conjunta con el Distrito y la Autoridad segun se dispone en el
C6digo de Elecciones de Tejas.
SECCION 10: El Consejo autoriza al Administrador Municipal, 0 su designado, a negociar y
entrar en un contrato con el Administrador de Elecciones del Condado de Guadalupe para llevar
a cabo la elecci6n segun se dispone en el C6digo de Elecciones de Tejas. EI salario para todos
los funcionarios de la elecci6n se estableceni en este acuerdo de elecciones.
SECCION 11: Las narraciones contenidas en este preambulo son fieles y exactas y por la
presente las mfsmas pasan a formar parte de esta Orden para todos los fines y son adoptadas
como parte del fallo y determinaciones del Consejo.
SECCION 12: Todas las 6rdenes y resoluciones, 0 partes de las mismas, que estan en conflicto
o son inconsistentes con cualquiera de las disposiciones de esta Orden por la presente se revocan
en cuanto a dicho conflicto, y las disposiciones de esta Orden seran y permaneceran regentes con
respecto a los asuntos ordenados en este documento.
SECCION 13: Esta Orden sera interpretada y se hara valer conforme a como se dispone en las
leyes del Estado de Tejas y de los Estados Unidos de Norteamerica.
SECCION 14: Si cualquiera de las disposiciones de esta Orden 0 la aplicaci6n de la mismas se
considerase invalida para cualquier persona 0 bajo alguna circunstancia, el resto de esta Orden y
la aplicaci6n de dicha disposici6n a otras personas 0 circunstancias, no obstante, seran validas y
el Consejo por la presente declara que esta Orden hubiese sido aprobada sin dicha disposici6n
invalida.
SECCION 15: Se considera, determina y declara que la reuni6n en la cual se adopt6 esta Orden
estuvo abierta al publico y se dio un aviso publico en cuanto a la hora, lugar y tema de asunto
publico a discutirse en dicha reuni6n, inclusive esta Orden, satisfizo todos los requerimientos del
Capitulo 551, segun enmendado, del C6digo de Gobierno de Tejas.
SECCION 16: Por voto de no menos de dos tercios de los miembros del Ayuntamiento de la
Ciudad presentes en la reuni6n en la cual esta Orden se consider6 por primera vez, el
Ayuntamiento de la Ciudad ha determinado que existe una emergencia que requiere acci6n
inmediata, y esta Orden es por la presente aprobada en una sola lectura.
