AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
AMENDING THE CODE OF ORDINANCES CITY OF
SCHERTZ, CHAPTER 10, ARTICLE VI, SECTION 10-
100 DEFINITIONS, SECTION 10-101 PERMIT
REQUIRED, SECTION 10-102 APPLICATION FOR A
PERMIT; SECTION 10-103 PERMIT COST; AND
REPEALING ALL ORDINANCES IN CONFLICT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
I
THAT the Code of Ordinances City of Schertz, Texas
Article VI. Garage Sales, Sec. 10-100 Definitions be amended by
changing subsection a to read as follows and by adding
subsections c and d
" Sec. 10-100 . Definitions
a. Garage Sale: Shall include but not be limited to
garage sales, yard sales, auctions, church or non-profit
organizational bazaars, and rummage sales which are conducted for
the sale of new or used merchandise at a location which is not
currently zoned for such sales.
c. Neighborhood Garage Sal e : A neighborhood garage
sale is one in which more than one resident within an area of a
particular subdivision join together to have garage sales which
are held on their individual properties at the same time and on
the same date.
d. Charitable or Non-profit Organization. Includes
church groups, school groups and any organization which has
applied for and receive charitable or non-profit status from the
State of Texas."

THAT the Code of Ordinances City of Schertz, Texas,
Article VI, Garage Sales, Sec. 10-101 Permit Required be amended
by adding the following:

Sec. 10-101. Permit Required.
a. A permit issued by the City of Schertz(City) shall
be required for each garage sale held within the City limits.
b.

charitable or non-profit organizations .
d. Persons who are operating a garage sale which is
held at a location outside the City limits shall be required to
apply for a permit and will be issued authorized signs for
posting at authorized locations within the City."
THAT the Code of Ordinances City of Schertz, Texas,
Article VI, Garage Sales, Sec. 10-102 Application for a Permit be
amended by adding the following:
" Sec. 10-102. Application for a Permit.
f. An application for a neighborhood garage sale
permit may be made by any individual property owner or occupant
who is participating in the neighborhood garage sale. The
application shall include a listing of the name and address of
each resident who will be participating."

THAT the Code of Ordinances City of Schertz, Texas,
Article VI, Garage Sales, Section 10-103 is hereby amended to
read as follows:
" Sec. 10-103. Permit Cost
a. Cost for a permit to operate a garage sale is $5.00
per sale. A numbered permit and two official signs shall be
provided to the applicant.
b. Cost for neighborhood garage sale permit is $5.00
for one numbered permit and two official signs.
c. Charitable and non-profit organization shall not be
exempt from payment of the permit fee.
d. Persons operating garage sales outside the city
limits but who desire to place signs within the City limits shall
pay a permit fee of $5.00.

e. Additional signs may be purchased at a cost of fifty
cents($0.50) per sign. "
IV
THAT all ordinances or parts of ordinances in conflict
are hereby repealed.
