2000F25-DROUGHT PLANORDINANCE NO. AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDIN~CES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 19-96, DROUGHT CONTINGENCY PLAN FOR PUBLIC WATER SUPPLY; AND PROVIDING A REPEALING CLAUSE; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS SECTION 1 THAT, Stage 3 - Restrictions, paragraphs (a) and (g) be changed to read as follows and paragraph (i) be added as follows: Stage 3- Restrictions Water Use Restrictions "(a) Residential Landscape watering by sprinkler system, soaker hose or in-ground irrigation system is restricted to one day every other week as specified in Stage 1 and 2 beginning on the second Monday after Stage 3 has been declared and is limited to the morning hours of 3:00 a. rm to 8:00 a.m. and the evening hours of 8:00 p.m. to 10:00 p.rm (g) Watering with hand-held bucket, hand-held hose, or properly installed drip irrigation system is allowed Tuesday, Thursday and Saturday, but limited to the morning hours of 3:00 a.m_~ to 8:00 a.n~ and the evening hours of 8:00 p.m_~ to 10:00 p.m. (i) Soaker hoses may be used for foundation watering." SECTION 2- REPEALING CLAUSE THAT, all ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed. SECTION 3- EFFECTIVE DATE THAT, this Ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law in such cases provides. SECTION 4- EMERGENCY CLAUSE i THAT, the need for timeliness requires this Ordinance to be acted on as an emergency, requiring the suspension of the Charter provision that no ordinance be passed on the day it is introduced, and such Charter provision is accordingly suspended and this Ordinance is declared to be an emergency measure. The Public Works Dept. is requesting the roles for Stage 3 be amended to be equal as to the City of San Antonio. These roles will only be in effect if and when Sta~ e 3 is activated by the E.A.A. According to the E.A.A Officials they made a mistake by activating a sprinkler ban. This ban should have been activated in Stage 3, officials from the E.A.A. said i~ the San Antonio Council meeting on September 14, 2000.
